Snohomish County Council Public Hearings Meeting Minutes Megan Dunn, Council Chair Jared Mead, Council Vice-Chair Councilmembers: Sam Low, Nate Nehring, Strom Peterson Wednesday, October 26, 2022 10:30 AM Jackson Board Room & Remote Meeting CALL TO ORDER Council Chair Dunn called the public hearing to order at 10:30 a.m. ROLL CALL The clerk called the roll and stated that all five members were present. ACTION ITEMS PRESENT: Council Chair Dunn Council Vice-Chair Mead Councilmember Low Councilmember Nehring Councilmember Peterson Nicole Gorle, Council Staff Marisa Burghdoff, Surface Water Management Elena Lao, Asst. Ordinance 22-042, amending Chapter 25.20 to add a Surface 2022-0937 Water Service Charge for Invasive Aquatic Plant Management on Lake Roesiger, clarifying the Title of SCC 25.20.050 and repealing SCC 25.20.060 Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Page 1 of 5 Public Hearings Meeting Minutes October 26, 2022 Nicole Gorle, Senior Legislative Analyst, provided a staff report on the proposed amendment to Snohomish County Code to add a service charge to help prevent and reduce invasive plants specifically for Lake Roesiger. She also explained a proposed Amendment 1 to the ordinance, which adds a separate service charge category for undeveloped, lake front parcels. Councilmember Low requested that the Council continue the public hearing to the end of November to allow for additional input and discussion on the proposed ordinance and proposed amendment. Council Chair Dunn opened the hearing for public testimony. The following individuals provided testimony: 1. Lena Coleman-Meyer, resident of Lake Roesiger, testified in support of the ordinance. 2. Pat Jasper, resident of Lake Roesiger, testified in opposition to the ordinance. 3. Karen Christner, resident of Lake Roesiger, testified in support of the ordinance. 4. Paul, resident of Snohomish, testified in support of the ordinance. 5. Ryan Madsen, resident of Seattle, testified in support of the ordinance as a property owner on Lake Roesiger. 6. Ron Johnson, resident of Lake Roesiger, testified in support of the ordinance. 7. Erik Flynn, resident of Lake Roesiger, testified in opposition to the ordinance. 8. John Ewald, resident of Lake Roesiger, testified in support of the ordinance. There were no other persons wishing to testify. Council Chair Dunn noted that public testimony will remain open until the continuation of the public hearing. Councilmember Low thanked residents for testifying and acknowledged the community's concerns. He added that continuing the hearing would allow residents additional opportunity to be heard. Marisa Burghdoff, Surface Water Management, responded to questions and provided additional information. ACTION: Councilmember Low made a motion to continue Ordinance 22-042 to Wednesday, November 23, 2022, at 9:00 a.m. on the General Legislative Session agenda. Councilmember Nehring seconded the motion and it carried unanimously. Ordinance 22-060, authorizing the Snohomish County Executive to 2022-1075 sign on behalf of Snohomish County an interlocal agreement between Snohomish County and Snohomish Health District Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Nicole Gorle, Senior Legislative Analyst, provided an overview of each of the three proposed ordinances that are necessary for the integration of the Health District into the County for the establishment of a new health department. Council Chair Dunn opened the hearing for public testimony. There being no persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. ACTION: Council Vice-Chair Mead made a motion to approve Ordinance 22-060. Councilmember Low seconded the motion. The clerk called the roll and the motion to approve Ordinance 22-060 carried unanimously. 3. Amended Ordinance 22-061, creating a Health Department; 2022-1074 creating a Health Department Fund; adding Chapters 2.300 and 4.127 of Snohomish County Code; and amending Chapters 2.02, 2.03, 2.10 and 2.400 of Snohomish County Code [See notes for staff report under Item #2, Ordinance 22-060.] Council Chair Dunn opened the hearing for public testimony. There being no persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. ACTION: Council Vice-Chair Mead made a motion to approve Ordinance 22-061. Councilmember Nehring seconded the motion. The clerk called the roll and the motion to approve Ordinance 22-061, as amended, carried unanimously. 4. Amended Ordinance 22-062, relating to a County Health 2022-1071 Department; repealing Chapters 7.04, 7.08, 7.12, 7.16, 7.20, 7.24, 7.28 and 7.32 of the Snohomish County Code; amending Chapters 5.12, 6.01, 6.28, 6.40, 7.34, 7.35, 7.37, 7.41, 7.42, 7.44, 7.53, 9.12, 13.50, 30.22, 30.23, 30.28, 30.29, 30.31f, 30.41a, 30.41b, 30.41c, 30.41e, 30.42e, 30.50, 30.53a, 30.53c, 30.62c and 30.86 of the Snohomish County Code [See notes for staff report under Item #2, Ordinance 22-060.] Council Chair Dunn opened the hearing for public testimony. There being no persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. ACTION: Council Vice-Chair Mead made a motion to approve Ordinance 22-062. Councilmember Peterson seconded the motion. Council Vice-Chair Mead made a motion to approve proposed Amendment 1. Councilmember Peterson seconded the motion and it carried unanimously. The clerk called the roll and the motion to approve Ordinance 22-062, as amended, carried unanimously. EXECUTIVE SESSION (Moved from General Legislative Session) Nicole Gorle, Senior Legislative Analyst, stated that the Council will convene into Executive Session pursuant to RCW 42.30.110(1)(i) to discuss a matter relating to pending litigation for an initial five minutes. She indicated that there is no anticipated action to follow and any necessary extensions would be announced. At 11:14 a.m., Council Chair Dunn recessed the Council into Executive Session.
