Ordinance By Councilor Ewen-Campen, Councilor Wilson, Councilor Kelly, Councilor (ID # 23-0607) Gomez Mouakad, Councilor Scott and Councilor Strezo Amending Section 9-116 of the Code of Ordinances, the Noise Ordinance, by prohibiting loud and disruptive construction activities on Saturdays and evenings. Councilor Gomez Mouakad assumed the Chair. Councilor Ewen-Campen spoke about some recent blasting of bedrock and the noise it created. He spoke to ISD and the Solicitor’s Office to produce this proposed amendment. He believes that the city’s noise ordinance is flawed and he would rather call out specific activities. Councilor Ewen-Campen reassumed the Chair. Councilor Gomez Mouakad suggested that ISD issue special permits for some activities. Councilor Scott would like to ensure that approval isn’t just needed from ISD. RESULT: REFERRED FOR RECOMMENDATION FOLLOWUP: Legislative Matters Committee 4.9. Order By Councilor Wilson and Councilor Clingan (ID # 23-0608) That the Chief of Police provide this Council with a report containing the information requested within for all incidents where a firearm was discharged since January 1, 2018. Councilor Wilson commented on how common gunfire in the city has become. Councilor Kelly stated that there is some data available going back 3 years. Order By Councilor Gomez Mouakad (ID # 23-0609) That the Director of Infrastructure and Asset Management provide an update on the Building Conditions Analysis and Renovation Potential Assessment of the Winter Hill Community Innovation School and provide a schedule of the projected completion of this analysis and assessment. Councilor Gomez Mouakad would like this information made available for transparency. Councilor Gomez Mouakad noted how the daily lives of municipal workers are being disrupted by these problems. Councilor Gomez Mouakad spoke about the need for a Program Manager for Prevailing Wage, Living Wage, and Wage Theft Ordinance Oversight under a Workforce Development Department/Division. Councilor McLaughlin said that he wants to get the discussion started about city-wide basic plans to increase affordable housing. Order By Councilor Burnley Jr., Councilor McLaughlin and Councilor Davis (ID # 23-0616) That the Chief of Police and the Director of Communications and Community Engagement discuss with this Council the viability of establishing a gun buyback event, focused on those who may be a danger to themselves, including strategic outreach involving community partners in the healthcare industry. Councilor Burnley commented that MA has the 4th lowest rate of suicide in the country, however 124 gun suicides were recorded in MA in 2020. Economic and mental health needs are not being met and need to be addressed in tandem. Buy back programs are a mixed bag in terms of effectiveness. He feels that mental health assistance should be provided in exchange for turning in guns. Councilor Burnley pointed out that, in the past, Somerville had a suicide prevention task force. He went on to say that the city should ensure that residents feel safe and that they can be cared for. Councilor McLaughlin pointed out that a buy back program won’t work unless the community gets involved. Order By Councilor Burnley Jr. (ID # 23-0618) That the Director of Health & Human Services work with this Council and community partners to determine if the city has a current PILOT agreement with Mass General Brigham and other healthcare providers, and how mental health services can be a component of such agreements, particularly as part of a mental health gun buyback program. Councilor Burnley commented that Somerville had a 20 year community services agreement with Brigham that could be amended, upon agreement of the parties. He stated that the city doesn’t have the level of staff required to service the population needing help, although the city is home to various medical institutions, adding that he would like to develop partnerships with them. Order By Councilor Burnley Jr. (ID # 23-0622) That the City Solicitor work with this Council to determine the legality of requiring businesses of a certain size to post in clearly visible spaces, Worker's Rights Bills, which shall include the right to form a union without retaliation and consequences for violating workers' rights. Councilor Burnley commented that there has been a rash of anti-union behavior in Somerville over the past several months and he wants workers to know that the city is a compassionate place to live, work and play. Councilor Gomez Mouakad commented that there is some similar language in the wage theft ordinance. RESULT: APPROVED AND SENT FOR DISCUSSION FOLLOWUP: Legislative Matters Committee 4.20. Order By Councilor Burnley Jr. (ID # 23-0624) That this Council work with the Worker's Center, Licensing Commission, and local unions, to discuss workers' rights and how violations of those rights could impact licenses and permits. Councilor Gomez Mouakad spoke about information from the Attorney General’s Office on this topic that she will share with all councilors. Order By Councilor Burnley Jr. and Councilor Wilson (ID # 23-0626) That the Director of Parking, Director of Mobility, and Director of Communications and Community Engagement, discuss with this Council, efforts to publicize the state's recently implemented vulnerable road users law, including requesting signage from MassDOT detailing the safe passing distance for vehicles nearing vulnerable road users such as cyclists. Councilor Burnley commented that this law recently went into effect and requires 4 feet of space when passing cyclists and vulnerable road users. Resolution By Councilor Burnley Jr., Councilor Kelly, Councilor Wilson, Councilor (ID # 23-0620) Ewen-Campen and Councilor Scott Condemning Northeastern University's anti-union behavior. Resident Sean Spinney, a graduate student worker at Northeastern, was sponsored to speak on the item by Councilor Burnley. He spoke about the university’s efforts to thwart graduate student workers’ efforts to unionize and listed some of the tactics being employed by the school. He asked for the Council’s support of this resolution to put Northeastern on notice that the community is watching and that grad workers, like all workers, deserve a vote. Councilor Burnley stated that union busting tactics will not be taken lightly in the City of Somerville and Councilor Kelly noted that 10% of the city’s population is comprised of graduate students. RESULT: APPROVED 5. UNFINISHED BUSINESS 5.1. Grant of Location Your Space Landscape and Const. Inc applying for a Grant of Location to (ID # 23-0418) install 85 feet of conduit in Professors Row, from Utility Pole 289/13 to a point of pickup at 114 Professors Row. Committee Report Report of the Special Committee on Charter Review, meeting as a (ID # 23-0535) Committee of the Whole on April 12, 2023. Councilor Scott stated that the committee is in the final stages of the review and he urged that the meeting video be viewed. He noted that the administration is working on language for 2 sections. The city council shall make a reasonable request for such legal services, and such request shall not be unreasonably denied by the mayor. The city solicitor and any advisory legal counsel shall consult to the extent practicable prior to the release of any secondary opinion. The legal services provided to the council shall not include representation of the council or any councilor in any litigation, or the issuance of formal legal opinions on behalf of the city. Councilor Wilson reported that the submitted budget priorities are being considered by the administration. Councilor Davis commented that he thought that financing for additional council staff was included in the overall request and Councilor Wilson replied that there was not a sufficient level of support of the notion. Councilor McLaughlin stated that this reinforces the need for the council’s rules to be followed. Councilor Gomez Mouakad suggested that a memorandum of the rules be prepared for next year. Councilor Davis moved to amend the report to include a request to the mayor for additional FY-24 funds for staff for the City Council. City Clerk Wells suggested that the motion not be to amend the report, but rather to be sent to the mayor as an additional funding request. The Committee discussed outsourcing work for the Water and Sewer Department. Councilor Scott spoke about the $600,000 request to cover operations for the Water Department for 3 months. He pointed out that all 11 SHMEO positions in the department have been vacant since at least August of last year. Councilor Scott told the members that his quick calculations show that the city’s yearly total (all in compensation) salary cost for those 11 positions amounts to approximately $641,492, meaning that the taxpayers of Somerville are essentially paying 4 times the cost by not having the work done in-house. The plan will improve the quality of life in the city by helping to have safe streets in the city and to saving lives. Councilor Gomez Mouakad noted the importance of connectivity. Councilor Burnley commented on the amount of data analyzed in the creation of this plan, adding that it will save lives as it’s built out. He asked about timelines for implementation documents and Director Rawson responded that those documents are already in the works and he noted that most of the networks specified in the plan have yet to be built.
