South Amherst Board of Public Affairs Storm & Water Meeting Minutes for October 16, 2023 Call to order 7:00 PM • Roll Call was conducted, and present were as follows: ▪ SABPA Board- Zoltan Zoltai (present), Mark Leshinski (present), Tom Pellitteri (present) ▪ Council Liaison: Jeri Leigh Siss (present) ▪ Visitors: Mayor Leshinski (present); Guest – None ▪ Water/Storm Operator: Dennis Hevener (absent) ▪ Water Clerk: Cindy Knudsen (present) Agenda Amendments: • Old Business Storm o 6240 Russia Rd. • Old Business Water o Oakdale & Thompson o South Lake & Russia Motion to approve agenda with amendments: • Motion made to approve agenda with amendments by Zoltan Zoltai, Mark Leshinski 2nd. The roll was called and all in favor. • Motion to approve previous minutes from 10/02/2023: Mark Leshinski moved to approve; Tom Pellitteri 2nd. The roll was called and all in favor. Storm Water Operator: • Exhibit D (emailed picture from Water Operator). Work done at 220 Oakdale. This was not a tap in. It was tied into an existing line. I could not find any type of permit on file. The village did not do any work on this property. Mark Leshinski stated from the picture, he believed that the homeowner did all the work and tied into an existing pipe on his property, so he was questioning if the homeowner needed a permit. Zoltan Zoltai stated that a permit is usually needed to do any other type of work. The question was deferred to Mayor Leshinski. Mayor Leshinski stated having not seen this live and in person, but if you look at the picture it looks like the resident tied into an existing drain. In the past, if you tied into any existing drain, it should be inspected, in which this looks like it was, that you did not need a permit. Zoltan Zoltai stated at this time that the board need not take additional action or discussion on the work that was performed. • Zoltan Zoltai brought up that Water Operator has a vacation scheduled for the end of this month and that he is out currently for an injury sustained outside of work. The text message that the Water Operator sent to the Board did not cover the time frame that he would be out. Mark Leshinski believes that Corey Timko is the next in line. At this time Mayor Leshinski stated that the Water Operator stopped today and stated that he told him that his vacation trip was cancelled. Mayor Leshinski stated he does not know how long he would be off. Zoltan Zoltai stated that he would contact the Water Operator to get a dates, an expected timeline that he will be off of work, and when he expects to return to work or at least a rough estimate of a return date. Jeri Legh Siss raised a question that was brought up in council of what the day-to-day operations look like such as if a water break should happen, what other day to day operations need to happen, is Corey Timko the backup, and if Corey is the backup what is the rate of pay looks like. Per Mark Leshinski, Corey Timko is still being paid the full month through the end of October and believes that he should be our number two. Per Zoltan Zoltai, as far as emergencies go Corey Timko is the backup. Until we have more information to go on, the contingency is Corey Timko at his current rate of pay. Per Mayor Leshinski the Water Operator is currently doing water testing at home. Jeri Leigh Siss stated the ask by Council is if the Water Operator is out on medical leave that he does not do roles and responsibilities of any kind just for potential liability on behalf of the Village. The Fiscal Office agreed with this. Per Zoltan Zoltai we need to first find out the status of the Water Operator’s injury and he needs to come in and share it with his employer at which point then further contingency discussion can be had. If the Water Operator is physically out, then we will rely on Corey Timko. Mark Leshinski made a motion to continue to pay Corey Timko full rate until the end of November 30, 2023. Zoltan Zoltai stated that the course of action is that the Water Operator needs to identify what is wrong with him, bring in something to substantiate this, and tell us how long he will be gone. At that time medical leave would then be determined through HR (Michelle Henke, Financial Office) and Mayor Leshinski and what duties if any he can resume. If he is on medical leave, can he work at home or still do testing at home. Mayor Leshinski stated that the record book the Water Operator took home is back here and that if he was going to be doing test at home that he could record it in a notebook. Zoltan Zoltai raised the question that if he is testing at home and got reinjured then it would be a Workers Comp claim. Jeri Leigh Siss stated that conversations were had if the Service Worker is able to do support such as taking tests and that Jeanne Maschari, being the former water clerk, indicated that anyone taking tests would be operating under the license of the Water Operator and that they can run the test and take them to where they need to go. Tom Pellitteri suggested that someone call Corey Timko and let him know the situation and that the Service Worker can do the test and Corey Timko would probably be okay with him doing this under his license if he shows him how to run the test. Then for emergencies we will have to rely on contractors. Mark Leshinski questioned how often the test must be taken to Avon Lake. Tom Pellitteri stated that test need to be done daily and Mayor Leshinski stated that he believes the bacterial test need to be taken to Avon Lake once a month. Zoltan Zoltai stated that the first course of action is to get the Water Operator in here and speak with him and identify what we need to know from him. Then we can contact Corey Timko based on what the Water Operator tells us or doesn’t tell us. An emergency meeting may need to be convened between now and the next meeting. Mark Leshinski motioned to put monies aside for Corey Timko to be paid full time through November 30, 2023 if he accepts once we find out the Water Operators status. Tom Pellitteri 2nd. Roll was called and all in favor. Zoltan Zoltai will reach out to the Water Operator to come into the Village Hall hopefully before the end of the week and identify what his status is, what he is capable of or not, what his restrictions are, what kind of accommodations we can make as an employee and documentation of his medical status. Then we can then get in writing what the contingency plan is. Once we get this information, we will then be able to take action. The Clerks report: • Provided copy of open work orders (Exhibit C) o Still looking for price sheet for 5906 Russia Rd. o Jeri Leigh Siss asked to check on the status of the material inventory list and to check with the Fiscal Officer is there is any wiggle room on the date needed by of November 1, 2023. o Mark Leshinski asked if there was any update on the work order 2338. The Water Clerk replied there has not been. Completed tap-ins: 319 W Main – In the Water Operators absence, Mayor Leshinski completed the inspection. Pending tap-ins: None Storm Financial Reports: • Exhibit A Mark Leshinski moved to approve. Tom Pellitteri 2nd. The roll was called with all in favor. Old Business- Storm: New Business – Storm: • 6240 Russia Rd. – Per Mark Leshinski the back lot has a lot of brush and mounds of dirt and was questioning if they require a drainage permit or a grading permit. He asked if the Service Worker could investigate if this is causing any drainage issues. Mark Leshinski questioned if the Service Worker could take pictures that could be presented at the next board meeting. Jeri Leigh Siss stated that she was sure a request could be made to Council and see if that would be viable within his schedule. Zoltan Zoltai also stated that a call must be warranted to the resident before the Service Worker would go to take pictures. Zoltan Zoltai believes that there is currently no actionable item at this time until we get a complaint to the contrary. Mark Leshinski rescinded this request. Water Water Operator: none The Clerks report: • The Community Metrics Reporting Worksheet for 2022 was completed and submitted to the EPA. • Oakdale & Thompson – Valve work was completed. The valve did not need replaced. Bolts were tightened and some were replaced. There is an open PO to purchase a valve. The Board was asked if they wanted to leave the PO open or have the Fiscal Officer close it. o Zoltan Zoltai made a motion to cancel the PO for a valve. Mark Leshinski 2nd. The roll was called and all in favor. Completed Tap-Ins: None Pending Tap-Ins: None Water Financial Reports: • Exhibit B • Mark Leshinski moved to approve, Tom Pellitteri 2nd. The roll was called with all in favor. Old Business: • Oakdale & Thompson - Covered under clerk’s report. • South Lake & Russia – Mark Leshinski wanted to know what happened to the three cones that were there. Mark Leshinski noticed they were missing on Friday. The Water Clerk will check with the Service Worker. Mark Leshinski wanted to know if we could put a work order in for the Service Worker to grade it better there. Mark states that it has settled, and we may need to put more material on it. Tom Pellitteri stated to Mark that he would need to put in a request to Council for this and Jeri Leigh Siss also stated that until we have an order of operations regarding what is happening with the Water Operator you cannot just insert the Service Worker where we would have the Water Operator. Mark Leshinski feels that this is also a street issue. Zolton Zoltai believes that if a request was made to Council to go over this it would perhaps be entertained and stated that this board does not have the authority over the Service Worker.
