Village of South Blooming Grove REGULAR MEETING Monday November 8, 2021 8:00 P.M.  Call to order o Mayor Kalaj called to order the Village Board Meeting at 8:50 p.m. on November 8, 2021, via Zoom Webinar No. 881 0598 2122 for the South Blooming Grove located at 819 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o George Kalaj- Mayor o Abraham Weiss- Deputy Mayor o Yitzchok Feldman – Trustee o Asher Guttman – Trustee o Zalmon Rosner – Trustee o Scott B. Ugell, Esq. – Village Attorney o Kerry Dougherty – Village Clerk o Joel Stern - Confidential Assistant to Mayor o Isaac Ekstein – Legislative Aide to Mayor o Al Fusco- Village Engineer o Marvin Nyman- Village Accountant o Holly Brown- Treasurer  Mayor’s Comments: o There were two water main breaks on Virginia Avenue, they are both done. He thanked Mr. Kirkpatrick for helping us out on both of them and yes we did loose some water and had to truck some water, but its all taken care of. We are going to work on Pine Hill Road to repave it. Hopefully we can do it by the end of the month, if not we will do it in the spring.  Correspondence: o None  Public Comment o Samantha Giovignoli – Thanked the board and Mr. Nyman for answering the questions that were asked tonight, thank you. o Kristie Johnson – The resolution to approve the budget tonight, she is wondering if the board intends to pass that and would hope that they wouldn’t especially since after a public comment, doesn’t it stay open for like 10 days for written comments to be submitted. If that is true she hopes that you guys would wait because I am sure a lot of people are still reviewing the information to ask questions just to be clear on it and it just helps with the relationship and the trust between us and you. Village of South Blooming Grove REGULAR MEETING Monday November 8, 2021 8:00 P.M. o Sue Anne Vogelsberg – she echoes Ms. Johnson and part of this agenda is the resolutions of all of the questions that we brought up at the public hearing and it really troubles me that we have these public hearings, the public speaks and it seems like for naught because the resolution is right after, to approve it. I hope you do keep it open, Mr. Nyam said I believe until the end of November where we are good with this and people still submitting comments. Please consider that thank you. o Mayor Kalaj advised that they are not going to close the budget public hearing today, we are going to leave it open for 10 days. The public hearing adjournment was amended to keep open for 10 days to receive written comment.  Business o Resolution No. (139) – Resolution of the Village Board of the Village of South Blooming Grove directing that there will not be a separate village voter registration day by Trustee Rosner, seconded by Mayor Kalaj. 5Ayes, Mayor Kalaj, Abraham Weiss Deputy Mayor, Trustee Feldman, Trustee Guttman and Trustee Rosner. o Resolution No. (140) - Resolution of the Village Board of the Village of South Blooming Grove authorizing the application and execution of WIIA grant application(s) and or EFC for construction of various water system improvements in the amount not to exceed $6,000,000 by Mayor Kalaj, seconded by Trustee Rosner. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner. o Resolution No. (141) - Resolution of the Village Board of the Village of South Blooming Grove setting a time and place for a public hearing to determine violations of the village code’s property maintenance provisions (chapter 102) on December 13,2021 at 8:01pm by Mayor Kalaj, seconded by Deputy Mayor Weiss. 5 Ayes, Mayor Kalaj, Deputy Mayor Wiess, Trustee Feldman, Trustee Rosner and Trustee Rosner. o Resolution No. (142) - Resolution of the Village Board of the Village of South Blooming Grove Authorizing the Village Clerk to submit a list of all delinquent village water and sewer charges, rent, fees, Assessments, and the like to the County of Orange for Re- levying on the next Fiscal year’s Real Property Tax Bill by Deputy Mayor Weiss, seconded by Mayor Kalaj. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner. o Resolution No. (143) Resolution of the Village Board of the Village of South Blooming Grove Authorizing the County of Orange to collect delinquent village taxes by Trustee Guttman, seconded by Trustee Rosner. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner. o Resolution No. (144) - Resolution of the Village Board of the Village of South Blooming grove awarding the Pine Hill Road Re Paving Bid to Argenio Brothers by Mayor Kalaj, seconded by Trustee Feldman. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner. o Resolution No. (144B) - Attorney Ugell asked the board to consider a resolution Village of South Blooming Grove REGULAR MEETING Monday November 8, 2021 8:00 P.M. authorizing the village to exceed the tax cap in relation to Section 205 of the Village Law. This is something we would vote on tonight as a resolution and when the budget is finally adopted, which doesn’t require breaking the tax cap we would then do a resolution to rescinding this resolution and we are all good. We do it for prophylactic purposes. It is very unlikely that we would exceed the cap but for whatever reason there are nuances with the NYS to review our budget and for some reason they would find some discrepancy we would be ahead of the curve, so he recommends as new and business and final resolution tonight that we vote to exceed the tax cap in the event that it occurs, Trustee Rosner made the motion, Trustee Guttman seconded. . 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner.  Trustee Comments o Trustee Guttman wanted to thank Delfino for working quickly together with the Town to make sure all the water main breaks were fixed immediately. He is doing a great job.  Abstract o Motion to adopt the Abstract by Trustee Rosner, seconded by Trustee Guttman. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman and Trustee Rosner.  Adjournment o Motion to close the meeting at 8:50 p.m. by Mayor Kalaj, seconded by Trustee Rosner. 5 Ayes, Mayor Kalaj, Deputy Mayor Weiss, Trustee Feldman, Trustee Guttman, and Trustee Rosner.
