Village of South Blooming Grove Regular Meeting Monday JANUARY 9, 2023 8:00pm  Call to order Deputy Mayor Weiss called to order the Village Board Meeting at 8:01pm on January 9, 2023, for the Village of South Blooming Grove located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o Abraham Weiss – Deputy Mayor o Yitzchok Feldman- Trustee o Asher Guttman- Trustee o Zalmon Rosner – Trustee o Joel Stern – Confidential Assistant to the Mayor o Scott Ugell Esq. – Village Attorney o Al Fusco- Village Engineer o Kerry Dougherty – Village Clerk o Absent – George Kalaj – Mayor o Absent – Isaac Ekstein – Legislative Aide to Mayor  Correspondence • None  Public Comment • Sue Anne Vogelsberg – At the last meeting there was a little bit of confusion Mr.Gelb had asked to reserve his comments to the end of the meeting and this way we get to hear everything. Are we doing that again because of that’s the case then I’ll reserve my time and we’ll just state the times. Joel Stern stated that’s a little inaccurate Mr. Gelb arrived late to the meeting. • Sue Anne Vogelsberg – I do have comments the exterior lights at 206, 211 and 216 still remain like beacons facing the road so I know Kerry you said that you were going to speak to them or someone was going to speak to them but it’s kind of like a safety danger when you are coming from Round Hill and coming around that turn there. • Sue Anne Vogelsberg asked again about this facebook shouldn’t be used to convey village information as a website and one of the things with the no street parking it’s not posted on the website. Kerry Dougherty stated it’s not on facebook either and Sue Ann states that’s the official way to convey. Website is conveying information and there’s no street parking between November and April and that would be good to be posted because there were some issues on Prospect that if I had to call the police on because cars were parked along the road. Kerry Dougherty states it is on the website as a local law. Sue Anne Vogelsberg states there is no bulk pickup between November 1  Village of South Blooming Grove Regular Meeting Monday JANUARY 9, 2023 8:00pm and April and 185 Prospect they got a couch out there and it looks like pipes out there so it’s going to sit there until April unless they bring it back in. There are other houses too that are putting stuff out that’s not going to be picked up so again if it was on the website. It’s 212 Prospect is under construction and they put an addition on the back it’s fine they got the building permit but there is no dumpster for all the debris. So you got loose stuff and garbage just piled up against the house. Vermin can get into it and there’s litter that comes with that. • SueAnne Vogelsberg – Asks if there any updates with the lights at 208 and Mountain Road, but there are six lights across the top. Cioffi was putting in asphalt last Wednesday looking like they were making a turn late. Joel Stern – states they are working together with DOT. The DOT is still doing some minor calibrations to the sensors to make sure traffic flow is optimized fully and they are not sharing that information with us I know yesterday they installed conditional sensor we can reach out to the DOT to get additional info. All of the work that is being done over there is on the instruction of the NYSDOT. • SueAnne Vogelsberg – States she also put in a FOIL request but she didn’t hear back about the letter that you read at the December 12th meeting about extending the road. Joel Stern says there is just some modifications to the letter so it’s not fully ready to share but when it will be ready we will let you know. SAV– It was read at a couple of meetings and it’s supposed to be available. Joel Stern – It was a verbal draft and not finalized. SueAnne Vogelsberg – You did add it was a verbal resolution that you presented and the Board voted. • Simon Gelb – I would like to prioritize with Ms. Vogelsberg, as you know you have been a member of the Board most of the time so if there is something on the agenda that I’m representing at that time usually it’s up to the discretion of the Board if they allow me to talk while they are discussing the project that I come here to represent so yes you are. • Patricia Morrice – The new garbage company I don’t know if the residents are aware that they are not going to pickup the garbage pails if they are overflowing and they are not going to be picking up garbage outside the garbage pails. So the last pickup there was garbage pails left on the street packed full and garbage on the side of the road. So maybe we should put out a message to the residents that the garbage pail needs to be closed to be picked up. I have a question will we replace the Worley Heights sign and the Capitol Hill signs that came down. • Patricia Morrice – The bus that’s going to be bought for the village is that going to be for everybody and where is that bus going to be going. • Bonnie Rum – I just have a question it can be for the Board or Mr. Gelb. I understand that it was in the paper that there were 4 or 5 cease and desist orders from the DEC for what used to be called Clovewood. What’s happened with that? Joel Stern stated in touch with the DEC he said is led by Mr. Fusco is the Village Engineer almost on a daily basis and fully compliant with the DEC. He states that a lot of these allegations and subsequent violations were unfounded or lacking subject matter. The DEC is there every day and they are passing inspections with flying colors. Mr. Gelb states that bottom line it’s not every single day it’s every single week. The DEC is doing full inspections and we are fully in compliance. There were 4 or 5 small minor glitches and everything was corrected and in section with the codes and the rules and regulations. 2  Village of South Blooming Grove Regular Meeting Monday JANUARY 9, 2023 8:00pm • Mr. Friedman/311 Lake Shore – I have two things I want to bring up one is there anyway possible that we should have some sidewalks and the other thing is the the fire bell should be turned off between 7:00PM to 7:00AM. He said they all have pagers and cellphones. Scott Ugell states that he thinks it’s actually required those alarms are kept in place. Joel Stern states we are actually working as part of the zoning amendment that we passed this past summer 2022. We are looking into forming a sidewalk district. It’s a complicated process that requires planning and funding but it’s on the Village Engineer Fusco task list and yes, it’s in the plans. There’s obviously no timeframe of when it’s going to be done. • Barbara Hanley – The roads aren’t clearly defined so I don’t understand. Joel Stern says it’s actually a very good question. The sidewalk district is going to be all the village roads will be widened right now from 25 to 29 feet to 37 feet curb to curb and the sidewalk is going to be after that. That’s part of the project. It’s a project and as I said earlier it’s a complicated project and when we will be at the point of execution where of course we will have a public hearing or a couple of them to inform the community of those plans. Mr. Fusco will lead that project and he will of course explain the process exactly how it’s being executed.  Business o Resolution No. (1) – Resolution of the Village Board of the Village of South Blooming Grove Establishing the polling location and hours of voting for the Village Election on March 21, 2023. Motion to accept by Trustee Rosner, seconded by Trustee Guttman. 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj. o Resolution No. (2) – Resolution of the Village Board of the Village of South Blooming Grove Revising the Budget for the WIIA Water Grant. Motion to accept by Trustee Feldman, seconded by Deputy Mayor Weiss. 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj. o Resolution No. (3) – Resolution of the Village Board of the Village of South Blooming Grove Motion to reject all plans and all bids for the Tanager Playground Park accept by Trustee Guttman, seconded by Deputy Mayor Weiss. 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj. o Resolution No. (4) – Resolution of the Village Board authorizing the mayor to sign the MS4 form for 5 Mangin LLC. Motion to accept by Trustee Guttman, seconded by Deputy Mayor Weiss. 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj. o Resolution No. (5) – Resolution of the Village Board of the Village of South Blooming Grove allowing the mayor to enter into a contract with Maragni Sanitation to authorize a second pickup which will either be Thursday or Friday. Authorize the mayor to instruct for the deal our accounting firm to take care of all the financial and contractual components of the contract, billing methods and schedule and how it will be billed to the village residents for an extra cost. The extra cost will be $20 a month per residence. January 1, 2024, or earlier if possible. Motion to accept by Trustee Guttman, seconded by Deputy Mayor Weiss, 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj. o Resolution No. (7) – Resolution of the Village Board authorizing the mayor and the mayor’s staff, village attorney to look into the creation of a village court system. Motion to accept by Trustee Guttman, seconded by Trustee Rosner, 4 Ayes, Deputy Mayor Weiss, Trustee Rosner, Trustee Feldman and Trustee Guttman. 1 Absent Mayor Kalaj.  Discussion Al Fusco states the water system rehabilitation project as you know we have the project runs at $6 Million to over $7.8 Million due to inflation and cost and labor it’s the same amount of work but costs more. The grant entered $4.7 Million we applied for . We have received notice Thursday or Friday that by this Friday we would have liked to receive a lot more information from us about the project. Because we have to complete our application for the financing so I contacted Bond Council and I’ve contacted Munistat which is your financial folks and I contacted our accountants and attorneys as well and we have to have contracts for all of these people I just mentioned. We don’t need that immediately we need that before we can get any money back. In the meanwhile what we do need though is to supply the financial information to that and it’s the end of the fiscal year I got everybody scrambling around trying to get that done. We have to show our debt service, debt we have, the debt we don’t have. So I got our financial people putting that all together. It also has to solidify my contract with them which we have and we also have to reidentify some seeker with them. They want some changes in the state and environmental quality review because we did it to get the money now that we have the money we have to do it for the project. That being said I do have a letter requesting an extension of the January 14th date and I will be talking with them on January 13th at noon and we are going to go over everything so I have everything clear and they have everything clear. They have been extremely responsive this environmental facility corporation. I call they call me right back. We have a good relationship going with them so I have a letter at the end of the meeting I’ll ask the vice chairman of the board to sign the letter for an extension and I will get that out tomorrow. I would like to propose a resolution authorizing the mayor and or the deputy mayor to authorize and request a proposal on anything they tell me on Friday. So we may need to go out for additional information and do a request for proposal. Joel Stern we had some issues last summer when Tanager Ballfield bids didn’t come in properly. They couldn’t comply with the bid requirements. We need to reject those plans. Resolution to reject all plans and all bids for the Tanager Playground Park. We have to do it and revise the requirements for this upcoming summer. 4  Village of South Blooming Grove Regular Meeting Monday JANUARY 9, 2023 8:00pm Joel Stern – Santitation – Very good point bought up. I want to give the board the background. We were working with the Town Boards and Supervisor Jeroloman since our private contract was up and they need to go to a new contract. We’re trying to get the best price possible as well as adding an additional pickup throughout the village during the week. Should it be Monday what it’s scheduled now and the other one to be Thursday. Mr. Jeroloman wasn’t able to secure a good bid for the second pickup. He advised us to negotiate the second pickup with his vendors which we hadn’t had time which we were successfully able to negotiate however for whatever reasons Mr. Jeroloman has given at the end he didn’t want to be included in the santiation proposal that was done and the bid that he put out with Marangi won that bid. We tried very hard to get it done and we have excellent price for 2 pickups a week and there wasn’t the cooperation and collaboration from the town to get it done. Maragni’s first pickup I don’t need to tell you as Mrs. Morrice pointed out it’s a mess. They are not doing the job as they are supposed to do. We sent notices to the town that this is a breach of contract and it’s unacceptable. I know US did a super job on time no trash left behind. We notified the town we would still like them to still revisit the second pickup which they officially refused today. Now we went back to Maragni sanitation over the past couple of days and asked them if they would accommodate the second pickup, and accommodate the village on a separate level which they said they would and they will finish. What the plan is and what will be right to do to keep the village streets squeaky clean is to go into a contract with Maragni this will alleviate the loads on Mondays and will also help keep everything clean and condensed and it will make sure that the garbage be picked up twice a week there’s never an overflow and there is no issue vermin and rodent and everything else that comes with that. Joel Stern – Lastly over the past 2 years I’ve been working together with Mr. Gelb and the town to try to recuperate and retrieve the funds from all the summons that have been given on the corridor of the Village of South Blooming Grove. We are sitting in a very business corridor all the way from the Village 17 up to Round Hill Road and by Clove Road and 208. The majority of the speeding tickets are given in this strip and it’s only fair that their should be a fairshare of revenue coming from these summonses should come into the of the village which would greatly alleviate financials when it comes to budgeting it will allow us to expedite many important safety projects like the sidewalks and a lot of other initiatives that the water, sewer and anything else. We have been going back and forth with the town which no success. We even tried special counsel and we weren’t able to accomplish it. Now the only way where the village could get fairshare of those revenues and income would be by initiating and establishing a village court and constable system.
