REGULAR MEETING A. Welcome, Roll Call, and Introduction to Electronic Meeting - By Mayor Dawn Ramsey Mayor Ramsey welcomed everyone and introduced the electronic meeting. B. Invocation – By Council Member Patrick Harris Council Member Harris offered the invocation. C. Pledge of Allegiance – By Fire Chief Chris Dawson Chief Dawson led the audience in the Pledge of Allegiance. Council Member Zander motioned to amend the City Council meeting agenda to include the words “electronic meeting,” since the mayor is joining electronically. Council Member McGuire seconded the motion; vote was unanimous in favor. Mayor Ramsey thanked all the city staff that has been working so hard to plow the snow and deal with the storm. Those teams have been working around the clock to take care of the city, including the snowplow drivers, Public Works Department, and emergency responders. She also thanked those who are working to put out the public safety announcements. She knows police, South Jordan City 2 City Council Meeting January 3, 2023 fire and other emergency responders responded to over 160 accidents in December alone in the City of South Jordan and asked everyone to please slow down, be mindful and cautious. She appreciates all the hard work, and notes that this is part of what makes South Jordan such an amazing place to live. She also mentioned the passing of Leona Winger, a previous council member for the City of South Jordan. She will miss her and appreciates her service to the city for eight years on the council. D. Minute Approval D.1. December 6, 2022 City Council Study Meeting Minutes D.2. December 6, 2022 City Council Meeting Minutes D.2. December 14, 2022 City Council Strategic Planning Meeting Minutes Council Member Shelton motioned to approve the December 6, 2022 City Council Study Session Meeting Minutes, December 6, 2022 City Council Meeting Minutes, and the December 14, 2022 City Council Strategic Planning Meeting Minutes as published. Council Member Harris seconded the motion; vote was unanimous in favor. E. Mayor and Council Reports Council Member Shelton attended the South Valley Chamber Holiday get together, visited with some folks there for a while. Attended the Legislative Policy Committee Meeting and noted that the council just had an update from Attorney Loose about legislation that is pending. Attended the City Council Strategic Planning Meeting and a DARE Graduation at Golden Fields Elementary. Also took the opportunity for a vacation with his family, and it took them six days to get home from Miami because of the airline issues; they were not on Southwest. Council Member Harris attended many of the events that Council Member Shelton attended, including the City Council Strategic Planning Meeting and the South Valley Chamber Holiday meeting. Also attended a Sewer Board Meeting, with nothing specific to report beyond that. Council Member Marlor on December 14 also attended the City Council Strategic Planning meeting, appreciates staff in all they are doing to get them organized for this coming year. On December 15 he met with a developer regarding a revised proposal on the Rise Development. On December 17 he, Council Member Harris and Manager Lewis attended the SoJo Santa Race; he did the ruck race again, this time with a 20 pound backpack, and it was a lot of fun. His youngest son was there with him as well, and he recommended everyone attend one of those races. He wanted to express condolences on the passing of former council member Leona Winger. He had the opportunity to serve with her for about 6 years on this council, and he is sorry to see her passing. He had a scheduled holiday with his family out of town at the time of the viewing and funeral, so he was unable to attend, but he enjoyed many years of service with her. Council Member Zander was sick for a few weeks and missed the last SoJo race, she hasn’t missed one race this fall before that, but she will be there in January. Attended the Strategic Planning meeting as well and explained to the public what that exactly is. She has had a few South Jordan City 3 City Council Meeting January 3, 2023 emails this last week from residents about the snow, complaining that the plowing isn’t done perfectly. She wanted Public Works Director Jason Rasmussen to pass on to his workers that she thought our snowplows did a tremendous job. Of course, as they go down a road it is going to create a little bit of a berm in front of people’s driveways, and she heard about it from a few, but backed Director Rasmussen and his crew up 100%. She forwarded an email to Director Rasmussen with questions about alleyways in the Daybreak area; her understanding is that alleyways are not public roads, and therefore are plowed by the HOA. Director Rasmussen said most of the alleyways are city right of way, so most of them we do plow. There are areas that are plowed by the HOA, but most are owned and maintained by the city. He responded to that specific email with those questions already, and he has been communicating with her this morning; they got everything taken care of. Council Member Zander met with the public relations group assisting the Rio Tinto Group, who is here tonight. She found that was very enlightening and was very appreciative of that opportunity. Council Member McGuire attended the Strategic Planning meeting like the other council members. Also had an Arts Council meeting that was more of a laid back Christmas celebration; the Arts Council is excited for the new year and to roll out some new projects. He thanked staff for the snow removal policy that our city has in place, where our plows do not do dead ends because of the hazard involved in the plow trucks having to back up. On Sunday morning, one of the HOA properties had a truck that was backing up, it came very close to hitting his car and it was quite the wakeup call as to why that policy is in play. He thanked city staff for looking at the bigger picture of safety, and making sure things are being done in a safe manner. Mayor Ramsey attended most of the same things already mentioned, minus the ruck. Attended several school holiday programs in South Jordan, and tried to get to as many as possible. There was Christmas for Kids with the Jordan Education Foundation, and Council Member McGuire was there along with Police Chief Jeff Carr, many of our officers, firefighters and paramedics who attended as well and they ended up being needed at one point. Had the opportunity to host the Salt Lake County Council of Mayors, this is only the second time she has had the opportunity to host because of Covid. They all take turns and they only meet a handful of times a year. It was a fantastic meeting with a big turnout, with a lot of good work being done. She thanked Executive Assistant, Melanie Edward, Stefanie Walker, and all the other staff who helped make sure everything was prepared. There was a lot of great work done at EDC Utah, and she doesn’t bring them up very often. She had the chance to spend quite a bit of time working with that organization, it’s a great opportunity for our city to have input. She also thanked Director of City Commerce Brian Preece for all he does with EDC Utah to benefit our city. Spent a lot of time with Wasatch Front Regional Council, there are some exciting changes in the works and she has to wait to say anything; she did note that our city is in a good place to have a good relationship with the WFRC and to play a continued key role there. They did a lot of work as a league with some board meetings, there was LPC, the league officers met with the Governor’s Office, and they have had quite a few of those discussions as they gear up for the legislative session. The city South Jordan City 4 City Council Meeting January 3, 2023 had the chance to host the governor and have his budget press conference here in South Jordan, specifically in Daybreak, for his 2024 proposed budget. There have been several meetings with the people from Daybreak, as they have been working on some projects together and working on getting some applications turned in for some things in Daybreak. Attended the Envision Utah Awards, it was their 25th anniversary. She serves on the executive committee of Envision Utah, and she was privileged to join the leadership of WFRC to go to the stage to receive the 25 year Visionary Partner Award for WFRC. Many people know our city works collaboratively with these organizations, they know the staff, elected body, and that’s a good thing. There was a significant board meeting for The Point, where things are moving along. She also attended several holiday events in her role as mayor, some of the council members were able to be there with her at some of those events as well. F. Public Comment Mayor Ramsey opened the public comment portion of the meeting. Sharon Juneau (Resident) just wanted to say, first of all, thank you to Council Member McGuire for helping us out with the situation we had with the city street sidewalk where it was broken and I had fallen and gotten hurt; it was really addressed quickly, and I wanted to thank you for that. That is kind of why I am here again tonight, because of probably old age and injury, I can no longer be the person who shovels Ojibwa Lane from curb to curb, from 10400 South down to Iron Mountain; it has just gotten too much for me. I have gone to the Streets Department in the past, asked them to pay attention to that. Granted, our Streets Department was overwhelmed by the large snow that we had, but our street didn’t get a plow down it, especially the sides of the road, for almost two days. My son was late to work, we had to find rides for work, so it is really affecting our family and I am just asking that more attention be paid to Ojibwa Lane because it’s just too hard for me to do on my own anymore. The problem is that we don’t do curb to curb with leaves and snow removal. There is a grade there from Iron Mountain to 10400 South which goes down and water can accumulate there, especially in the winter time if it freezes over it’s icy and slick. Right now my husband is hopefully at home clearing out my front so I can get out of the front of my house, because right now I can only use the back door. I don’t know what the answer to the question is, but for the last 13 years I have been shoveling the alley behind my house, Ojibwa Lane, and trying to be a good neighbor. I am here tonight to let you know that I am retiring from snowplowing duty from our neighborhood and I was hoping that the council would be able to do something to give me a hand here and pay a little bit more attention to Ojibwa Lane; it is not a circle, it is not a cul-de-sac, it is a through road and it actually feeds off of 10400 South. I thank you and look forward to some sort of response, hopefully I won’t have to be shoveling snow anymore like this. G. Action Item G.1. Resolution R2023-01, Proclaiming January 16, 2023 as Religious Freedom Day in the City of South Jordan. Mayor Ramsey read the proclamation for Religious Freedom Day. South Jordan City 5 City Council Meeting January 3, 2023 Manager Lewis thanked Grant Horwith, who is here tonight, as he is the one that brought this to the city’s attention several years ago. He works hard to bring attention to this event each year, and works hard in the community to raise awareness for this. Council Member McGuire motioned to approve Resolution R2023-01, Proclaiming January 16, 2023 as Religious Freedom Day in the City of South Jordan. Council Member Marlor seconded the motion; vote was unanimous. Council Member Shelton added that we really don’t realize what a remarkable freedom that is, to have freedom of religion in our country, and he feels blessed for that. Mayor Ramsey noted that many of us don’t realize how at-risk that freedom is at times, and she will stand up all day, every day, to support and defend religious freedom; both of anyone’s faith, or lack thereof, as that is one of the key tenets our republic was founded upon and it is critical that we preserve it. H. Annexation Items H.1. Motion to accept Petition for Annexation from Kennecott Utah Copper, LLC and Jordan Valley Water Conservancy District (By Deputy City Manager Dustin Lewis). Attorney Loose reviewed background information from the Council Report. Council Member Marlor motioned to accept a Petition for Annexation from Kennecott Utah Copper, LLC and Jordan Valley Water Conservancy District. Council Member Shelton seconded the motion. Roll Call vote was 5-0, unanimous in favor. H.2. Motion to receive Certification of Petition for Annexation to the City Council from the City Recorder. Council Member Zander motioned to receive Certification of Petition for Annexation to the City Council. Council Member McGuire seconded the motion. City Recorder Anna Crookston testified that the Petition for Annexation is certified on the record. Roll Call Vote was 5-0, unanimous in favor. H.3. Resolution R2023-05, Accepting Petition for Annexation from Kennecott Utah Copper, LLC and Jordan Valley Conservancy District and authorizing required notices to be sent, further consideration, and related manners. Council Member Harris motioned to approve Resolution R2023-05, Accepting Petition for Annexation from Kennecott Utah Copper, LLC. Council Member Zander seconded the motion. Council Member Shelton is grateful to feel like they are finally kicking this off after talking about it for a very long time. He appreciates Kennecott’s desire to be part of South Jordan, and he thinks that together they can do something great. South Jordan City 6 City Council Meeting January 3, 2023 Council Member Zander noted that one of the reasons she is in favor of this is that the owners of this land had the opportunity to annex into any city they chose, and she thinks it should be well known by the public and the residents of South Jordan that this landowner, Rio Tinto, approached South Jordan requesting to annex into the city. There are a lot of variables, but something that should be known is that city staff is very qualified and equipped to help in this process when it starts to move forward. She thinks there is a great team here at the city that will be able to work on this, and one of the reasons she is voting yes is because she has such confidence in the city of South Jordan. If this land is going to be annexed, she is very confident that this is appropriate and wise to have this land annexed into our city, and looks forward to working on this in tandem with the landowner. Roll Call Vote was 5-0, unanimous in favor. Wayne Bradshaw (Applicant) – thanked the mayor and council for accepting their petition tonight, as well as thanked the staff. A lot of work has gone into this, the staff has worked with them and met on a weekly basis to try and overcome some of the concerns and hurdles that come with annexation. They appreciate the acceptance of the annexation petition, and they know there is a lot more work to do. They will be back to the council when there are more public hearings, and they are excited to be moving this forward and continuing to work with South Jordan. Mayor Ramsey thanked everyone for their hard work on this. Things like this don’t just happen, and they aren’t just “right” for no reason. Finally, she welcomed Rio Tinto to South Jordan. I. Staff Reports and Calendaring Items Manager Lewis reminded everyone that the next ruck is on January 21, known as Break the Freeze. Since it looks like there may be three council members there, staff will do a notice of a potential quorum. Manager Whatcott wanted to publicly thank the staff on the snowplowing event that was three days of heavy snow. We are already short staffed in Public Works, so that put an extra load on those that are there and that was challenging. There were a few equipment failures over the weekend that made it more challenging as well, but they stayed with it and did a good job with an event that large. Attorney Loose noted in addition to sharing that the legislative season is coming up very soon, he wanted to thank Director of Administrative Service Melinda Seager, Director Rasmussen and Deputy Director Jeremy Nielson for their help with getting $1 million in a matching grant for the Pure SoJo Project that was awarded the end of last week. Director Preece shared some sad news regarding one of the city’s corporate partners. Last night he received a text from Steve Peterson, the president of Millrock Development who was one of the partners that built where Avante and Lucid Technology are, that his partner Nathan Ricks died in the Provo plane crash. Director Preece in turn reached out to Mr. Ricks’ son-in-law, Andrew Bybee, who worked with the city on this as well. For those who worked on that project, they know how much work was done and how great they were to work with. South Jordan City 7 City Council Meeting January 3, 2023 Director Klavano shared that the traffic signal at White Peach and 1300 West is up and working. Today was the first day of school and Deputy Director Nielson was out there during drop off and pickup, reporting that the lights worked very well and it helped the kids get across the street safely, which was the goal. Mayor Ramsey asked Council Member Zander if she is planning to attend the Utah Association of Realtors Annual Realtor Policy Summit on January 11. She is triple booked that day and unable to get there, so she wondered if Council Member Zander happened to already be going to the event, or if she could possibly go to represent the city. Council Member Zander said doesn’t already have it in her calendar, but the mayor can send her the information and she will see if she can make that work. Mayor Ramsey also asked if, on that same day, anyone is available to attend the State of the Chamber Address with the South Valley Chamber. Director Preece said he is already planning to attend that meeting. Council Member Zander motioned to recess the City Council Meeting and move to an Executive Closed Session.
