SOUTH ST. PAUL CITY COUNCIL MINUTES OF SEPTEMBER 8, 2015 The regular meeting of the City Council was called to order by Mayor Beth Baumann at 7:15 P.M. on Tuesday, September 8, 2015. ROLL CALL: Present, Mayor Baumann Councilmembers Hansen, Flatley, Niederkorn, Podgorski, Seaberg Absent, Councilmember Rothecker Also Present, City Administrator, Steve King City Attorney, Kori Land City Clerk, Christy Wilcox City Engineer, John Sachi 5) Presentations  There were no presentations 6) Citizens’ Comments  There were no citizen comments 7) Agenda Moved by Flatley/Podgorski MOVED: To approve the agenda, as amended. Motion carried 6 ayes/0 nays 8) Consent Agenda Moved by Hansen/Podgorski Resolved, that the South St. Paul City Council does hereby approve the following: 1. City Council meeting minutes of August 17, 2015 2. Resolution No. 2015-141, approving accounts payable 3. Resolution No. 2015-142, entering into a Lease Agreement with the South St. Paul Youth Hockey Association (SSPYHA) to operate the Off-Ice Training Facility at Wakota Civic Arena 4. Settlement Agreement with Janice Fritz for her rental property at 259 9th Avenue North regarding sewer service line repair City Council Minutes of September 8, 2015 1 5. Approve the conditional job offer to Brian Wolf as a Mechanic I in the Public Works Department for the City of South St. Paul, contingent on successful completion of a background investigation and work physical 6. Resolution No. 2015-132, accepting gifts and grants from Tony Leitner of Level Up Games to enhance the library’s summer reading programs 7. Resolution No. 2015-134, approving termination of land lease between the City of South St. Paul and BRS, Inc. 8. Resolution No. 2015-136, declaring property surplus and authorize the sale of such property 9. Business licenses Motion carried 6 ayes/0 nays 8d) Resignation from the Planning Commission Advisory Board John Ross appeared before the City Council requesting that his letter of resignation be withdrawn and wishes to remain on the Planning Commission Moved by Seaberg/Hansen MOVED: To accept the withdrawal of the resignation of John Ross from the Planning Commission. Motion carried 6 ayes/0 nays 10a) Re-naming of Wakota Civic Arena (Item was moved) Moved by Niederkorn/Podgorski MOVED: To adopt Resolution No. 2015-140, renaming Wakota Civic Arena as Doug Woog Arena. After much discussion, Councilmember Niederkorn withdrew his second to the motion. Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2015-140, as amended, renaming Wakota Civic Arena as Doug Woog Arena. Motion carried 6 ayes/0 nays The Mayor asked for a 5 minute recess Moved by Seaberg/Podgorski MOVED: To take a 5 minute recess. Motion carried 6 ayes/0 nays City Council Minutes of September 8, 2015 2 The meeting was reconvened at 8:20 p.m. 9a) Preliminary 2016 Tax Supported Funds and Levies Moved by Hansen/Podgorski MOVED: To adopt Resolution No. 2015-129, approving 2016 Housing and Redevelopment Authority property tax levy. Motion carried 6 ayes/0 nays Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2015-137, approving 2016 Economic Development Authority property tax levy. Motion carried 6 ayes/0 nays Moved by Hansen/Seaberg MOVED: To adopt Resolution N0. 2015-138, certifying preliminary 2016 property tax levies and associated budgets to Dakota County and setting date for a Public Hearing on the 2016 Tax Supported Budgets and Property Tax Levy. Motion carried 6 ayes/0 nays 9b) Declare Costs and Call for Public Hearing on assessments – Street Improvement Projects Moved by Niederkorn/Hansen MOVED: To adopt Resolution No. 2015-131, declaring the costs to be assessed and calling for a public hearing for Project 2015-005 Mill & Overlay and 2015-007 Bituminous Removal & Replacement projects. Motion carried 6 ayes/0 nays 9c) Oak Park Phase 2 – Declare Cots and Call for Public Hearing Moved by Flatley/Hansen MOVED: To adopt Resolution No. 2015-130, declaring the costs to be assessed and calling for a public hearing on Project 2015-008 Oak Park Street Projects Phase 2. Motion carried 6 ayes/0 nays City Council Minutes of September 8, 2015 3 10b) Rental License Applications for 220 4th Ave. No., 827 22nd Ave. No. and 405 16th Ave. North Moved by Niederkorn/Seaberg MOVED: To adopt Resolution No. 2015-139, denying the rental license applications by Michele Joy for 220 4th Ave. No., 827 22nd Ave. No. and 405 16th Avenue North. Motion carried 6 ayes/0 nays 10c) Approving Federal Grant Agreement for Airport Improvements Moved by Hansen/Seaberg MOVED: To adopt Resolution No. 2015-133, approving Federal Grant Agreement for Airport Improvements. Motion carried 6 ayes/0 nays 10d) Danner Temporary Rock Crushing IUP Moved by Seaberg/Hansen MOVED: To adopt Resolution No. 2015-107, approving an Interim Use Permit for a Temporary Rock Crushing Operation at 843 Hardman Avenue South. Motion carried 5 ayes/1 nay (Niederkorn) 10e) Danner Temporary Rock Crushing Operation 5th Amendment – 843 Hardman Avenue Moved by Hansen/Flatley MOVED: To adopt Resolution No. 2015-135, approving a Fifth Amendment Agreement with Danner, Inc. Motion carried 6 ayes/0 nays 10f) Interim Use Permit – CAF Event at 310 Airport Road Moved by Hansen/Seaberg MOVED: To adopt Resolution No. 2015-142, approving an Interim Use Permit to host the beer garden for two events on the properties at 310 Airport Road/1725 Henry Avenue. Motion carried 6 ayes/0 nays City Council Minutes of September 8, 2015 4 10g) Interim Use Permit – MadFurther Car Show Moved by Hansen/Flatley MOVED: To adopt Resolution No. 2015-143, approving Interim Use Permit for a car show on the property at 1725 Henry Avenue.
