SOUTH ST. PAUL CITY COUNCIL MINUTES OF SEPTEMBER 21, 2015 The regular meeting of the City Council was called to order by Mayor Beth Baumann at 7:15 P.M. on Monday, September 21, 2015. ROLL CALL: Present, Mayor Baumann Councilmembers Hansen, Flatley, Niederkorn, Podgorski, Rothecker Absent, None Also Present, City Administrator, Steve King City Attorney, Kori Land City Clerk, Christy Wilcox City Engineer, John Sachi City Planner, Peter Hellegers 5) Presentations  There were no presentations. 6) Citizens’ Comments  Walt Books appeared to raise several questions about various issues in the City. No formal action was taken.  A resident on 1st Avenue discussed her concerns over the property located at 241 1st Avenue South and also requested that the City consider extending the notice when considering requests for a Special Event License for the VFW.  Steve Mankowski invited residents, City Council and Mayor to the upcoming “On The Road Again” celebration to be held on Saturday, October 3rd. 7) Agenda Moved by Seaberg/Niederkorn MOVED: To approve the agenda. City Council meeting minutes of September 8, 2015 2. Resolution No. 2015-149, approving accounts payable 3. Ratify letter of commitment to participation in the LOGIS administered Parks and Recreation software application (RETRAC) 4. Economic Development Authority meeting minutes of August 31 and September 8, 2015 5. Approve bid from AL Services, Inc. for the removal and restoration of 33 ground outlets along Grand Avenue and 3rd Avenue North in the amount of $23,750.00 6. Resolution No. 2015-146, ordering the property owner of 241 1st Avenue South to secure the property in accordance with Minnesota Statutes, Section 436.251 7. Business Licenses 8. Encroachment Agreement for a retaining wall and steps in the right-of-way at 600 Annapolis Street East Motion carried 7 ayes/0 nays 9a) Assessment Hearing – 2014-008 Oak Park Phase 1 Street Improvement Project Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2015-144, adopting the assessment roll for Project 2014-008 Oak Park Phase 1 Street Improvement. Motion carried 7 ayes/0 nays 9b) Public Hearing - Southview Boulevard/3rd Avenue South Moved by Flatley/Seaberg MOVED: To adopt Resolution No. 2015-145, as amended to include an alternate bid for stop lights on 7th Avenue and 12th Avenue at Southview Boulevard and an alternate bid for a 4 way stop on 12th Avenue and Southview Boulevard, ordering improvement and preparation of final plans and specifications for Project 2015-011 Southview Boulevard/3rd Avenue South. Motion carried 7 ayes/0 nays 10a) First Reading – Ordinance Related to Administrative Citation Hearing Fees Councilmember Rothecker introduced the following proposed ordinance for its first reading: AN ORDINANCE AMENDING CHAPTER 38 OF THE SOUTH ST. PAUL CITY CODE OF 2007 RELATING TO ADMINISTRATIVE CITATIONS City Council Minutes of September 21, 2015 2 10b) 494 Villaume Avenue – Royal Star Auto Sales Conditional Use Permit Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2015-147, approving a Conditional Use Permit to allow auto sales for up to 5 vehicles at 494 Villaume Avenue. Motion carried 7 ayes/0 nays 10c) 521 Stewart Avenue – Variance Request Moved by Niederkorn/Hansen MOVED: To adopt Resolution No. 2015-148, approving a 21-foot front setback Variance and Variance for lot coverage by a building for the property at 521 Stewart Avenue. Motion carried 7 ayes/0 nays 10d) MNDot Grant Agreement for Airport Improvements and Land Acquisition Moved by Rothecker/Hansen MOVED: To adopt Resolution No. 2015-143, approving Minnesota Department of Transportation Grant Agreement for Airport Improvements and Land Acquisition.
