SOUTH ST. PAUL CITY COUNCIL
MINUTES OF NOVEMBER 2, 2015
The regular meeting of the City Council was called to order by Mayor Beth Baumann at 7:15 P.M. on
Monday, November 2, 2015.
ROLL CALL:

Councilmembers Flatley, Hansen, Niederkorn,
Rothecker, Seaberg
Absent, Councilmember Podgorski

5) Presentations
Councilmember Rothecker presented certificates to participants of the South St. Paul
Beyond the Yellow Ribbon for their efforts in making this program so successful.
Mayor Baumann and staff of the Police Department and South Metro Fire Department
participated in the coin toss to determine the winner of the 2015 South St. Paul Chili Cook-
Off. The South Metro Fire Department won the coin toss and was presented the trophy.
6) Citizens’ Comments
Walt Books appeared. No formal action was taken.
Ms. Schlemmer appeared before the Council to request consideration in amending the City
Code which would allow more than four chickens being allowed on a property based upon
size of lot. The item was referred to staff.

8) Consent Agenda

Resolved, that the South St. Paul City Council does hereby approve the following:
1. City Council meeting minutes of October 19, 2015
2. Resolution No. 2015-169, approving accounts payable
3. Approve 2016 pay ranges for seasonal/variable positions

4. Approve Change Order No. 2 for Kaposia Landing Phase 1 construction contract with
Rachel Contracting in the amount of $13,167.25 for a new contract price of
$5,102,553.99.
5. Resolution No. 2015-171, accepting grants and gifts for the Great Halloween Get
Together
6. Business Licenses

9a) Certify Unpaid Charges to the County auditor
Moved by Hansen/Seaberg
MOVED: To adopt Resolution No. 2015-168, as amended by removing the
assessment to Parcel #36-34900-01-040 (Beermann) and certifying delinquent charges to
the Dakota County Auditor for collection with the property taxes payable in 2016.
Motion failed 2 ayes (Hansen, Baumann)
4 nays (Flatley, Niederkorn, Rothecker, Seaberg)

MOVED: To adopt Resolution No. 2015-168, certifying delinquent charges to the
Dakota County Auditor for collection with the property taxes payable in 2015.

9b) Special Animal Permit Request by Cheng Thao at 249 1st Avenue South
Moved by Hansen/Niederkorn
MOVED: To approve a Special Animal Permit by Cheng Thao at 249 1st Avenue South for
20 pigeons subject to the following conditions:
Exterior must have a sided exterior consistent with zoning and building regulations
The shingled roof needs to meet building code regulations relative to roof pitch
Exterior wood must be painted, stained or sealed
The pigeon loft (structure) must be attached to the ground by either posts or connected to a
slab
The pigeon loft (structure) must meet setback regulations which include a side setback of 3
feet (rear 1/3 of the loft) and 3 foot rear setback
If the pigeon loft is no longer being used, the applicant shall surrender the permit and
remove the structure or convert to a shed
All exterior storage of materials, equipment and personal belongings in the yard must be
stored within an enclosed building as required by City Code, Section 118-240(a)

10a) Professional Services with WSB & Associates, Inc. for McMorrow Field
Moved by Flatley/Seaberg
MOVED: To approve the professional services with WSB & Associates, Inc. for a
basemap survey of McMorrow Field for a price not-to-exceed $4,800.00 in preparation of site
redesign as part of the Park Referendum.
Motion carried 6 ayes/0 nays
