SOUTH ST. PAUL CITY COUNCIL MINUTES OF JULY 18, 2017 Mayor James Francis called the regular meeting of the City Council to order at 7:15 p.m. on Tuesday, July 18, 2017. ROLL CALL: Present: Mayor Francis Councilmembers Flatley, Forester, Podgorski, Rothecker Absent: Councilmember Hansen and Seaberg Also Present: City Administrator, Stephen King Attorney, Bridgette Nason City Engineer, Chris Hartzell City Planner, Peter Hellegers City Clerk, Christy Wilcox 5) Presentations Presentation: Antonio Bringgold – Eagle Scout Presentation Presentation: Deb Griffith – Art Around Town 6) Citizens’ Comments Bernie Beerman, 206 Spruce Street East, discussed future improvements to the Library. Jodelle Ista, 1413 9th Avenue South, invited all to attend the Swing Dance and Give Event to be held on Thursday, July 20th at Historic Concord Exchange. 7) Agenda Moved by Forester/Rothecker MOVED: To approve the agenda with the removal of item #8H – Approve bids for Police Storage Facility and addition of item #10-H – Emergency Repair/Replacement of 18th Avenue between Southview Boulevard and Marie Avenue. Motion carried 5 ayes/ 0 nays 8) Consent Agenda Moved by Flatley/Forester Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council Meeting Minutes of June 19, 2017 B. Resolution No. 2017-130, accounts payable C. Policy establishing an Employee Service Recognition Program D. Business licenses City Council Minutes of July 18, 2017 1 E. Hiring of Tyler Strong as Staff Engineer for the City of South St. Paul, contingent upon successful completion of a background check and pre-employment work physical F. Grading and fill permit for Twin City Hide Realty at 501 Malden Street G. Resolution No. 2017-131, approving the property split/combination at 1710 Pleasant Avenue H. Approve T-hangar lease with Ed Kranz for 1691 Ercoupe Lane I. Approve network upgrade project J. Replacement of security cameras for City Hall Motion carried 5 ayes/ 0 nays 9a) Public Hearing – Liquor Violation at El Nuevo 7 Mares Moved by Rothecker/Podgorski MOVED: To open the public hearing on a liquor violation at El Neuvo 7 Mares located at 600 North Concord Street. Motion carried 5 ayes/0 nays Rosa Castaneda Valdovinos, Owner, spoke on behalf of El Nuevo 7 Mares. Moved by Flatley/Forester MOVED: To close the public hearing Moved by Flatley/Podgorski MOVED: To adopt Resolution No. 2017-122, imposing sanctions upon retail intoxicating liquor license holder – El Neuvo 7 Mares located at 600 North Concord Street. Motion carried 5 ayes / 0 nays 9b) Call for Hearing – On Sale Wine License at 229 13th Avenue South by Wishfull, LLC Moved by Podgorski/Rothecker MOVED: To call for a public hearing to be held on Monday, July 31, 2017, to consider the application of an On Sale and Sunday Wine License at 229 13th Avenue South by Steven Raab and Ann Vaughan doing business as Wishfull, LLC. Motion carried 5 ayes/0 nays City Council Minutes of July 18, 2017 2 10a) Special Animal Permit Request by Cheng Xiong at 761 15th Avenue North Councilmember Podgorski made a motion to approve the Special Animal Permit to allow for 60 pigeons. Motion failed for a lack of a second. Moved by Podgorski/Rothecker MOVED: To approve the Special Animal Permit to allow fifty (50) pigeons by Cheng Xiong at 761 15th Avenue North subject to the following conditions:  Remove existing pigeon lofts and construct new loft in accordance with City Code  Exterior must have a sided exterior consistent with zoning and building regulations  The pigeon loft (structure) must be attached to the ground by either posts or connected to a slab  The pigeon loft (structure) must meet setback regulations which include a side setback of 3 feet (rear 1/3 of the loft) and 3 foot rear setback  If the pigeon loft is no longer being used, the applicant shall surrender the permit and remove the structure or convert to a shed  All exterior storage of materials, equipment and personal belongings in the yard must be stored within an enclosed building as required by City Code, Section 118-240(a)  All conditions of the Special Animal Permit must be completed by November 14, 2017. Motion carried 4 ayes /1 nay (Francis) 10b) Wishfull, LLC – Beer/Wine Conditional Use Permit Request Moved by Rothecker/Podgorski MOVED: To adopt Resolution No. 2017-125, approving a Conditional Use Permit for Beer/Wine sales for the restaurant Wishfull Eats at 229 13th Avenue South. Motion carried 5 ayes / 0 nays 10c) Conditional Use Permit Request at 332 Concord Exchange South by Certified Auto Moved by Flatley/Podgorski MOVED: To adopt Resolution No. 2017-126, approving a Conditional Use Permit for two box style logo signs for 332 Concord Exchange South. Motion carried 5 ayes / 0 nays City Council Minutes of July 18, 2017 3 10d) Variance Request at 645 9th Avenue North Moved by Podgorski/Forester MOVED: To adopt Resolution No. 2017-127, approving a 6-foot front setback Variance for a garage addition on the property located at 645 9th Avenue North. Motion carried 5 ayes/0 nays 10e) Fence Variance at 2301 Hansen Lane Moved by Podgorski/Forester MOVED: To adopt Resolution No. 2017-128, approving a 2.5 foot fence height Variance on the property located at 2301 Hansen Lane. Motion carried 5 ayes / 0 nays 10f) Site Plan Review at 491-501 Malden for Twin City Hide Moved by Forester/Flatley MOVED: To adopt Resolution No. 2017-129, approving a site plan for a 27,000 square foot stand-alone warehousing building and site work at 491-501 Malden Street. Motion carried 5 ayes/0 nays 10g) First Reading – Water/Utility Billing Ordinance Amendment Councilmember Rothecker introduced the following proposed ordinance for its first reading: An ordinance amending City Code Section 62.56 regarding adjustments to utility bills 10-h) Proclamation Declaring Local Emergency for a Severe Water Main Break on 18th Ave. So. Moved by Rothecker/Forester MOVED: To adopt Resolution No. 2017-132, Mayor and City Council’s proclamation declaring a local emergency for a severe water main break on 18th Avenue South from Southview Boulevard to Marie Avenue.
