SOUTH ST. PAUL CITY COUNCIL MINUTES OF SEPTEMBER 18, 2017 Mayor James Francis called the regular meeting of the City Council to order at 7:15 p.m. on Monday, September 18, 2017. ROLL CALL: Present: Mayor James Francis Councilmembers Flatley, Forester, Hansen, Podgorski, Rothecker, and Seaberg Absent: None Also Present: City Administrator, Stephen King Attorney, Kori Land City Engineer, Chris Hartzell City Planner, Peter Hellegers Finance Director, Michelle Pietrick Deputy City Clerk, Shirley Buecksler 5) Presentations There were no presentations. 6) Citizens’ Comments Bernie Beerman, 206 Spruce Street East, stated that some bridges in the metro area have had a nine-foot high fence added to the sides of them. He would prefer not to see fencing of this height installed on the Wakota Bridge and is looking for the City’s support against the installation of this type of fence, should it be proposed in the future. 7) Agenda Moved by Seaberg/Flatley MOVED: To approve the agenda, as presented. Motion carried 7 ayes/ 0 nays 8) Consent Agenda Moved by Hansen/Rothecker Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council Meeting Minutes of September 5, 2017 B. Resolution Number 2017-169 Approving Accounts Payable C. Business Licenses, as Presented D. Final Compensating Change Order No. 4 for an Increase of $56,500 to the Original Contract Amount of $608,700 with Lametti & Sons, Inc., for Flood Control System Improvements (Project No. 2012-008C) Project, Resulting in a Final Contract Amount of $665,200 City Council Minutes of September 18, 2017 1 E. Resolution Number 2017-158 Requesting Municipal State Aid System Construction Funds for Other Local Use F. Resolution Number 2017-159 Concurring with the Issuance of a Lawful Gambling Exemption for Church of St. John Vianney G. City Council Special Meeting Minutes of September 11, 2017 H. Resolution Number 2017-164 Approving a Forgivable Loan Agreement with Bridgepoint Business Center IV, LLC I. Resolution Number 2017-163 Accepting the Transfer of Real Property from the Housing & Redevelopment Authority of the City of South St. Paul J. Resolution Number 2017-168 Relating to Airport: Approving Agreements for Airport Lighting Project with Premier Lighting, Inc. Motion carried 7 ayes/ 0 nays 9) Public Hearings A. 1. Presentation, Discussion and Public Hearing on the Preliminary 2018 Tax Support City Funds, Budgets and Recommended Levies Mayor Francis opened the Public Hearing at 7:59 p.m. Hearing no comments from the audience, Mayor Francis closed the Public Hearing. A. 2. Certification of the 2018 Preliminary Budget and Property Tax Levy Moved by Seaberg/Rothecker MOVED: To adopt Resolution No. 2017-160, Certifying the Preliminary 2018 Property Tax Levy to Dakota County and Setting a Date for a Public Hearing on the 2018 Tax Supported Budgets and Property Tax Levy, and schedule the Public Hearing for December 4, 2017, with a continuation hearing scheduled for December 18, 2017, if necessary. Motion carried 7 ayes / 0 nays A. 3. Approve Certifying the Preliminary 2018 Economic Development Authority (EDA) Tax Levy and Budget Moved by Forester/Hansen MOVED: To adopt Resolution Number 2017-165 Approving a 2018 Budget and Certifying the Preliminary 2018 Property Tax Levy Adopted by the South St. Paul Economic Development Authority (EDA). Motion carried 7 ayes / 0 nays City Council Minutes of September 18, 2017 2 A. 4. Consent for 2018 Housing and Redevelopment Levy Submitted by the Economic Development Authority (EDA) Moved by Seaberg/Flatley MOVED: To adopt Resolution Number 2017-166 Consenting to the Preliminary 2018 Housing & Redevelopment Authority (HRA) Special Property Tax Levy Adopted by the South St. Paul Economic Development Authority (EDA). Motion carried 7 ayes / 0 nays A. 5. Cancel Tax Levy for General Obligation Bonds Series 2017A Debt Service Moved by Forester/Podgorski MOVED: To adopt Resolution Number 2017-167 to Cancel Debt Service Tax Levy for General Obligation Airport Bonds Series 2017A. Motion carried 7 ayes / 0 nays 9B. Declare Costs and Call for Public Hearing on Assessments – 2017-005 and 2017-007 Street Improvement Projects Moved by Podgorski/Rothecker MOVED: To adopt Resolution Number 2017-161 Declaring Costs to be Assessed and Calling for Hearing on Project 2017-005 Mill and Overlay and 2017- 007 Bituminous Removal and Replacement Projects, and schedule the Public Hearing for October 16, 2017. Motion carried 7 ayes / 0 nays 9C. Second Reading of Ordinance Amendments for Small Cell Wireless Facilities Mayor Francis opened the Public Hearing at 8:21 p.m. Hearing no comments from the audience, Mayor Francis closed the Public Hearing. Moved by Hansen/Seaberg MOVED: To approve Ordinance Number 1321 Amending South St. Paul City Code Section 118-8 and 118-121 – 118-130 Regarding Small Wireless Facilities in all Zoning Districts, and to approve Ordinance Number 1320 Amending Article VI of the South St. Paul City Code Regarding Right-of-Way Management to Incorporate Small Wireless Facilities. Motion carried 7 ayes / 0 nays City Council Minutes of September 18, 2017 3 10A. Second Reading of Ordinance Amendments for Small Wireless Facilities The Council approved Item 10A in one motion with Item 9C. 10B. First Reading of an Ordinance Amending South St. Paul City Code Sections 114-1 and 114-64 Regarding Subdivision Regulations Councilmember Hansen introduced the following proposed ordinance for its first reading: An Ordinance Amending South St. Paul City Code Sections 114-1 and 114-64 Regarding Subdivision Regulations. 10C. Conditional Use Permit for 311 12th Avenue North Moved by Hansen/Rothecker MOVED: To adopt Resolution Number 2017-162 Approving a Conditional Use Permit for a Second Garage on the Property at 311 12th Avenue North. Motion carried 7 ayes / 0 nays 10D. First Reading of an Ordinance Amending South St. Paul City Code Sections 118-39, 118-40, 118-41 and 118-42 Regarding Certain Planning Applications Councilmember Seaberg introduced the following proposed ordinance for its first reading: An Ordinance Amending South St. Paul City Code Sections 118-39, 118-40, 118-41 and 118-42 Regarding Certain Planning Applications. 10E. First Reading of an Ordinance Amending South St. Paul City Code Sections 188-8 and 118- 21 Regarding Home Occupations and Residential Business Offices Councilmember Flatley introduced the following proposed ordinance for its first reading: An Ordinance Amending South St. Paul City Code Sections 118-8 and 118-21 Regarding Home Occupations and Residential Business Offices. 10F.
