SOUTH ST. PAUL CITY COUNCIL MINUTES OF OCTOBER 2, 2017 Mayor James Francis called the regular meeting of the City Council to order at 7:15 p.m. on Monday, October 2, 2017. ROLL CALL: Present: Mayor James Francis Councilmembers Flatley, Forester, Hansen, Podgorski, Rothecker, and Seaberg Absent: None Also Present: City Administrator, Stephen King Attorney, Kori Land City Engineer, Chris Hartzell City Clerk, Christy Wilcox 5) Presentations There were no presentations. 6) Citizens’ Comments Bernie Beerman, 206 Spruce Street East, discussed the possibility of how citizens should approach city employees during work hours and suggested an article in the City newsletter would be helpful. Steve Mankowski invited the Mayor and City Council to participate as booya judges as part of the On the Road Again celebration to be held on Saturday, October 7th. 7) Agenda Moved by Seaberg/Flatley MOVED: To approve the agenda, as presented. Motion carried 7 ayes/ 0 nays 8) Consent Agenda Moved by Hansen/Forester Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council Meeting Minutes of September 18, 2017 B. Resolution No. 2017-173, approving accounts payable C. Authorize staff to conduct a Request for Proposal (RFP) for a Communications and Strategy Audit D. Resolution No. 2017-171, declaring certain property surplus and authorize the sale of such property E. Settlement agreement with Tom & Elaine Lehmann for their property at 256 19th Avenue South regarding curb stop installation City Council Minutes of October 2, 2017 1 F. Final Compensating Change Order No. 3 for a decrease of $16,810.10 to the original contract amount of $16,810.10 with Visu-Sewer for Sanitary Sewer Lining (Project No. 2016-010) project, resulting in a final contract amount of $179,123.25 G. Engineering services agreement with Short Elliot Hendrickson for preliminary and final design consulting engineering services for the 5th Avenue South Project H. Business licenses I. Resolution No. 2017-174, concurring with the issuance of a Lawful Gambling Exemption to Conduct Off-Site Gambling by the South St. Paul Lions Club Motion carried 7 ayes / 0 nays 8G. Support for South St. Paul Public Schools Referendum Election Moved by Hansen/Podgorski Moved: To adopt Resolution No. 2017-172, expressing support for a South St. Paul Public School District #6 Referendum seeking renewal of a technology levy and adoption of an increased operating levy. Motion carried 7 ayes/0 nays 10A. First Reading – Ordinance Regarding Abatement Notice Councilmember Podgorski introduced the following proposed ordinance for its first reading: An Ordinance amending Section 34-21 regarding regular abatement notice 10B. First Reading – Ordinance Relating to Residential Rental Inspections Councilmember Hansen introduced the following proposed ordinance for its first reading: An Ordinance amending Section 106-232 regarding residential rental housing license requirements 10C. License Hearing for 961/963 Warner Avenue Kori Land, City Attorney presented testimony and evidence as part of the license hearing of 961/963 Warner Avenue. Mark Grondahl, property owner of 961/963 Warner Avenue presented testimony regarding hearing. The following persons spoke in favor of revocation of the license:  Ellen Geier, 916 Warner Avenue  Stephanie Willmarth, 900 Holland Avenue  Andrew Johnson, 919 Warner Avenue  Ann Ness, 956 15th Avenue North  Susan Pugh, 980 Terrance Lane City Council Minutes of October 2, 2017 2 Moved by Seaberg/Forester MOVED: To adopt Resolution Number 2017-170, revoking the rental license at 961/963 Warner Avenue, South St. Paul. Motion carried 7 ayes / 0 nays 10D. Final Reading – Ordinance Regarding Subdivision Regulations Moved by Hansen/Forester MOVED: To adopt Ordinance No. 1322, an ordinance amending South St. Paul City Code Sections 114-1 and 114-64 regarding subdivision regulations and authorize its publication.
