SOUTH ST. PAUL CITY COUNCIL MINUTES OF OCTOBER 15, 2018 Mayor James Francis called the regular meeting of the City Council to order at 7:30 p.m. on Monday, October 15, 2018. ROLL CALL: Present: Mayor Francis Councilmembers Flatley, Forester, Hansen, Podgorski, Rothecker and Seaberg Absent: None Also Present: City Administrator, Joel Hanson City Attorney, Kori Land City Clerk, Christy Wilcox City Engineer, Chris Hartzell City Planner, Peter Hellegers 5) Presentations  There were no presentations. 6) Citizens’ Comments  Mr. and Mrs. Campbell discussed an issue with a call made to the South St. Paul Police Department. This item was referred to Staff 7) Agenda Moved by Seaberg/Flatley MOVED: To approve the agenda as presented. Motion carried 7 ayes / 0 nays 8) Consent Agenda Moved by Hansen/Rothecker Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council meeting minutes of October 1, 2018 B. Resolution No. 2018-183, approving accounts payable C. Resolution No., 2018-170, accepting Grants and Gifts from the Vietnam Veterans of America for funding the Pumpkin Patch Event City Council Minutes of October 15, 2018 1 D. Resolution No. 2018-177, approving Charitable Gambling Premise Permit request by South St. Paul Youth Hockey Association E. Resolution No. 2018-176, accepting bids and awarding 2018 Stockpile Removal and MCES Property Grading to Fitzgerald Excavating F. Business licenses G. Resolution No. 2018-178, approving the lot split/combination of the property for 663-651 Stewart Avenue H. Resolution No. 2018-1798, approving an extension for a Conditional Use Permit for a sausage manufacturing operation on the property at 1443 Concord Street South I. Resolution No. 2018-180, authorizing execution of Temporary Easement Agreement for Union Pacific Railroad Sanitary Sewer Realignment Project J. Resolution No. 2018-181, approving a Cooperative Agreement for Engineering, Construction, and Long Term Maintenance of the Seidl’s Lake Lift Station between the cities of South St. Paul, Inver Grove Heights, and West St. Paul K. Resolution No. 2018-182, approving Joint Powers Agreement Amendment with Dakota County for Southview Boulevard & 3rd Avenue Improvements L. Resolution No. 2018-184, approving Joint Powers Agreement with Dakota County for 3rd Avenue North and Grand Avenue sidewalk improvements M. Resolution No., 2018-185, authorizing execution of an Agreement between the City and Union Pacific Railroad for abandonment of Sanitary Sewer N. Accept proposal from Elfering & Associates for Interim City Engineering Services Motion carried 7 ayes/0 nays 9A) Assessment Hearing - Southview Boulevard & 3rd Avenue South Improvements Mayor Francis opened up the assessment hearing and the following residents spoke: 1. Ted Thompson, 109 3rd Avenue South, was concerned about paying for the road before it has been completed, traffic speed and the placement of dirt during the construction period 2. Mr. Sadlovsky, owner of 1520 and 1516 Southview Boulevard asked why he was being assessed for two properties when he was told that he would only be assessed for one. Also concerned about having to pay for the assessment before the project is completed. Moved by Flatley/Forester MOVED: To adopt Resolution No. 2018-175, adopting the assessment roll for 2014-011, Southview Boulevard & 3rd Avenue South Improvements. Motion carried 7 ayes/0 nays City Council Minutes of October 15, 2018 2 10A) Fence Variance – 2242 Jewell Lane Moved by Hansen/Rothecker MOVED: To adopt Resolution No. 208-171, approving a 2.5 foot fence height Variances on the property at 2242 Jewell Lane. Motion carried 7 ayes/0 nays 10B) Conditional Use Permit – 2232 Caroline Lane Moved by Rothecker/Podgorski MOVED: To adopt Resolution No. 2018-172, approving a Conditional Use Permit for a second garage on the property at 2232 Caroline Lane. Motion carried 7 ayes/0 nays 10C) C-1 Zoning District Amendment Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2018-173, resolution denying a proposed zoning code amendment to allow “Doggie Daycare” uses in the C-1: Retail Business Zoning District. Motion carried 7 ayes/0 nays 10D) Wakota North Preliminary Plat Moved by Forester/Seaberg MOVED: To adopt Resolution No. 2018-174, related to zoning; approving the Wakota North Preliminary Plat. Motion carried 7 ayes/0 nays City Council Minutes of October 15, 2018 3 10E) MOU – Concord Street Improvements Moved by Hansen/Seaberg MOVED: To adopt Resolution No. 2018-186, approving a Memorandum of Understanding between the City of South St. Paul, Minnesota Department of Transportation, and Dakota County for Concord Street Improvements.
