Replay Times – Friday following Meeting at 1:00 p.m. & 7:00 p.m. 651-451-7834 A CITY COUNCIL AGENDA REPORT DATE: November 19, 2018 8-E DEPARTMENT: Engineering ADMINISTRATOR: JRH AGENDA ITEM: MNDOT Agency Delegated Contracting Process Agreement ACTION TO BE CONSIDERED: Adopt Resolution 2018-200 APPROVING THE MAYOR AND CITY CLERK TO EXECUTE THE AGENCY DELEGATED CONTRACTING PROCESS AGREEMENT WITH MNDOT. OVERVIEW AND RECOMMENDATION: In or around 2013 the City executed an agreement with MnDOT to allow them to act as the City’s receiving agent for federal funds. The attached agreement incorporates new language that is now required by Federal law and this new agreement must be approved and executed by the City. The agreement is attached to this memo along with a draft resolution for documenting the approval and authorizing its execution by the Mayor and City Clerk. TIMELINE: We are recommending the City Council approve the attached resolution authorizing execution at the November 19th Council meeting. Doing so will ensure the agreement is in place for future projects utilizing federal funds. SOURCE OF FUNDS: No funds required.  City of South St. Paul Dakota County, Minnesota RESOLUTION NO. 2018-200 RESOLUTION APPROVING THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE THE AGENCY DELEGATED CONTRACTING PROCESS AGREEMENT WITH MNDOT WHEREAS, the City Council has reviewed and considered the Agency Agreement for Federal participation in Construction between the State of Minnesota and the City of South St. Paul appointing the Commissioner of Transportation (MnDOT) to serve as its agent NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South St. Paul, Minnesota, that pursuant to Minnesota Stat. Sec. 161.36, the Commissioner of Transportation be appointed as Agent of the City of South St. Paul to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of South St. Paul, Minnesota, that James P. Francis, Mayor and Christy M. Wilcox, City Clerk are hereby authorized and directed for and on behalf of the City of South St. Paul to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in “Minnesota Department of Transportation Agency Agreement No. 1032651”, a copy of which said agreement was before the South St. Paul City Council and which is made a part hereof by reference. Adopted this 19th day of November, 2018. ______________________________ City Clerk  City Council Agenda Report 9-B Date: November 19, 2018 Department: City Clerk Administrator: JRH Agenda Item: Call for Hearing – Application for an On Sale Intoxicating Liquor License Triple Shift Entertainment, LLC dba Concord Lanes Action to be considered: Motion to call for a Public Hearing to be held on December 3, 2018, to consider the application of an On Sale and Sunday Intoxicating Liquor License at 365 North Concord Street by Triple Shift Entertainment, LLC doing business as Concord Lanes. Overview: The City has received an application for an On-Sale and Sunday Intoxicating Liquor License by Triple Shift Entertainment, LLC dba Concord Lanes located at 365 North Concord Street. The current owner of Concord Lanes is selling all ten of their Minnesota bowling center locations to Triple Shift Entertainment, LLC. The sale is not expected to occur until sometime in mid to late December. They are requesting that the City consider approval of the liquor license now and make the license effective on the date of closing. Triple Shift Entertainment will provide the closing date to the City when available. The City Council must now call for a Public Hearing. Staff is recommending the hearing be scheduled for December 3, 2018. Source of Funds: n/a
