SOUTH ST. PAUL CITY COUNCIL MINUTES OF MARCH 16, 2020 Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on Monday, March 16, 2020. ROLL CALL: Present: Mayor Francis Councilmembers Dewey, Flatley, Forester, Hansen, Kaliszewski and Seaberg Absent: None Also Present: City Administrator, Joel Hanson Attorney, Peter Mikhail Deputy City Clerk, Renee Schmitt City Planner, Michael Healy 5) Presentations  The Mayor gave an update on the Coronavirus and the steps the City is taking regarding this issue. 6) Citizens’ Comments  There were no citizens comments. 7) Agenda Moved by Seaberg/Forester MOVED: To approve the agenda, as amended. Motion carried 7 ayes /0 nays 8) Consent Agenda Moved by Kaliszewski/Dewey Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council Meeting Minutes of March 2, 2020 B. Resolution No. 2020-45, approving accounts payable C. Authorize hiring of Bradley Patet as General Facility Maintenance (PT) at the Doug Woog Ice Arena D. Business Licenses City Council Minutes of March 16, 2020 1 E. Resolution No. 2020-38, declaring certain property surplus and authorize the sale of such property F. Resolution No. 2020-39, related to the South St. Paul Emergency Operations Plan – 2020 G. Resolution No. 2020-40, accept donation from Waterous Company H. Resolution No. 2020-41, related to the State of Minnesota Human Trafficking Investigators Task Force Joint Powers Agreement I. Resolution No. 2020-42, accept donation from the Christine Vujovich Charitable Trust J. Resolution No. 2020-43, declaring certain property surplus and authorize the sale of such property (John Deere Vehicle) K. Resolution No. 2020-44, declaring certain City property surplus and approving sale (abandoned bicycles) L. Resolution No. 2020-46, approving the plans and specifications for 2018-15, Seidl’s Lake Lift Station Improvements and ordering advertisement for bids M. Resolution No. 2020-47, approving the plans and specifications for 2018-15, 4th Street South Improvements and ordering advertisement for bids N. Resolution No. 2020-48, approving an Engineering Services Agreement with WSB for MS4 Support Services O. Approve the hiring of Sue Polka as City Engineer for the City of South St. Paul P. Authorize the purchase of new Police Department Portable (hand-held) and Mobile (vehicle-mounted) 800 MHz Radios at a cost of $66,145.00 Q. Authorize the Mayor and City Clerk to execute a preliminary development agreement by and between the City of South St. Paul, the South St. Paul EDA, and Beard Group, Inc. for the proposed “Grand Avenue Gateway” residential project Motion carried 7 ayes/0 nays 9A) Public Hearing – Project 2016-11 Concord Street from I-494 to Annapolis The Mayor opened the hearing for public comments. Moved by Kaliszewski/Forester MOVED: To adopt Resolution No. 2020-37, ordering improvement and preparation of final plans and specifications for 2016-11 Concord Street from I-494 to Annapolis. Motion carried 6 ayes/1 nay (Flatley) 5B) 2020 State of the City (Item moved on agenda with prior action) The Mayor and City Council presented the 2020 State of the City City Council Minutes of March 16, 2020 2 9B) Call for Hearing – Rental License Revocation for 1009 Concord Street North Moved by Seaberg/Forester MOVED: To call for a Rental License Revocation Hearing for 1009 Concord Street North to be held on April 6, 2020. Motion carried 7 ayes/0 nays 10A) Tindell Lot Size, Lot Width and Off-Street Parking Space Variances – 140 2nd A.S. Moved Seaberg/Hansen MOVED: To deny the request for a 2,500 square foot lot size Variance and a 20- foot lot width Variance at 140 2nd Avenue South due to spot zoning to a specific parcel that is not consistent with current zoning regulations, not allowing a duplex on a 40-foot lot, a hardship has not been justified and is not in the best interest or the health and safety of that portion of that community to have such type of variance. Motion carried 6 ayes/1 nay (Kaliszewski) Moved by Seaberg/Hansen MOVED: To adopt Resolution No. 2020-34(A), denying an off-street parking space Variance at 140 2nd Avenue South. Motion carried 7 ayes/0 nays 10B) Twin Cities Hide and Tanning Site Plan Review and PUD Amendment Moved by Kaliszewski/Forester MOVED: To approve Resolution No. 2020-35, approving an amendment to the Conditional Use Permit/Planned Unit Development for Twin Cities Hide and Twin Cities Tanning and approving a Site Plan for the new processing facility at Twin Cities Hide. Motion carried 7 ayes/0 nays City Council Minutes of March 16, 2020 3 10C) Interim Use Permit for a Seasonal Farmers’ Market – 1151 Southview Blvd. Moved by Hansen/Flatley MOVED: To adopt Resolution No. 2020-36, approving a 5-year Interim Use Permit for a Seasonal Farmers’ Market at 1151 Southview Boulevard. Motion carried 7 ayes/0 nays 10D) Ordinance Amending Fire Code Regarding Electronic Submission of Inspection Records – First Reading Councilmember Flatley introduced the following proposed ordinance for its first reading: AN ORDINANCE ENACTING SECTION 30-54 OF THE SOUTH ST. PAUL CITY CODE REGARDING ELECTRONIC SUBMISSION OF INSPECTION RECORDS 10E) Ordinance Regarding Carnivals and Circuses – First Reading Councilmember Forester introduced the following proposed ordinance for its first reading: AN ORDINANCE AMENDING CHAPTER 10, SECTION 10-5, REGARDING CARINVALS AND CIRCUSES 10F) Ordinance Regarding Tobacco Sales to Persons Under Age 21 – First Reading Councilmember Seaberg introduced the following proposed ordinance for its first reading: AN ORDINANCE AMENDING ARTICLE XXI REGARDING TOBACCO SALES TO PERSONS UNDER AGE 21 The proposed ordinance was referred to a City Worksession meeting for further discussion 10G) Declaration of Emergency Declaration Moved by Seaberg/Flatley MOVED: To adopt Resolution No. 2020-49, City of South St. Paul Declaration of Emergency.
