SOUTH ST. PAUL CITY COUNCIL MINUTES OF SEPTEMBER 21, 2020 Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on Monday, September 21, 2020. ROLL CALL: Present: Mayor Francis Councilmembers Dewey, Flatley, Forester, Hansen, Kaliszewski and Seaberg Absent: None Staff Present: City Administrator, Joel Hanson Attorney, Peter Mikhail City Clerk, Christy Wilcox Director of EDA, Ryan Garcia City Planner, Michael Healy 5) Presentations  Christy Wilcox, City Clerk presented information on the process for voting by absentee ballot. 6) Citizens’ Comments  There were no citizen comments. 7) Agenda Moved by Seaberg/Dewey MOVED: To approve the agenda as amended with the addition of item #10-H, Lay-off of Parks and Recreation Director. Resolution No. 2020-127, approving accounts payable B. Accept the 2020 2nd Quarter Financial Report C. Resolution No. 2020-134, authorizing 2020 Budget Amendments City Council Minutes of September 21, 2020 1 D. Resolution No. 2020-133, appointing Clara Hilger as Finance Director and Treasurer for the City of South St. Paul and authorize recruitment for Assistance Finance Director E. Approve final payment to McNamara Contracting, Inc. in the amount of $11,985.08 for the Wentworth Avenue (CR8) Sidewalk Improvements F. Resolution No. 2020-131, approving the agreement for revocation of a portion of County Road 6 in South St. Paul L. Business Licenses M. Resolution No. 2020-132, approving a Joint Powers Agreement for Engineering and Construction of Concord Street between the County of Dakota and the City of South St. Paul for County Project No. 56-012 and City Project No. 2016-011 Motion carried 7 ayes/0 nays 10A) Final Reading – Comcast Cable Television Franchise Ordinance Moved by Dewey/Hansen MOVED: To adopt Ordinance No. 1364, An Ordinance granting a cable television franchise to Comcast of St. Paul. Motion carried 7 yeas/0 nays Moved by Kaliszewski/Dewey MOVED: To adopt Resolution No. 2020-130, approving the publication of a summary of Ordinance No. 1364 renewing the cable television franchise with Comcast of St. Paul, Inc. Motion carried 7 ayes/0 nays City Council Minutes of September 21, 2020 2 Moved by Dewey/Hansen MOVED: To authorize the Cable Commission to execute the mutually agreed upon side letter with Comcast. Motion carried 7 ayes/0 nays 10B) 2021 Preliminary Property Tax Levies & Budget Considerations Moved by Kaliszewski/Forester MOVED: To adopt Resolution No. 2020-123, certifying the Preliminary 2021 Property Tax Levy to Dakota County and Setting a Date for a Public Hearing on the 2021 Tax Supported Budgets and Property Tax Levy. Motion carried 7 ayes/0 nays 10D) Conditional Use Permit/Variances for St. John Vianney Church Moved by Forester/Dewey MOVED: To adopt Resolution No. 2020-117, approving two Conditional Use Permits and a size Variance for a monument sign at the Church of St. John Vianney at 840 19th Avenue North. Motion carried 7 ayes/ 0 nays Moved by Forester/Flatley MOVED: To adopt Resolution No. 2020-118, denying a Variance to allow a dynamic display electronic changeable copy sign at the Church of St. John Vianney at 840 19th Avenue North. Motion carried 6 ayes/1 nay (Kaliszewski) 10E) Conditional Use Permit for Planned Unit Development at 1020 5th Avenue South Moved by Hansen/Dewey MOVED: To adopt Resolution No. 2020-119, denying a Conditional Use Permit for a Planned Unit Development for a twin home project at 1020 5th Avenue South. Motion carried 7 ayes/nays 10F) Interim Use Permit Amendment – Commemorative Air Force Hangar Moved by Hansen/Seaberg MOVED: To adopt Resolution No. 2020-115, approving an amendment to an existing Interim Use Permit for a temporary convention/banquet hall at 310 Airport Road (Hangar #3) to allow the Commemorative Air Force to host additional fundraising events in 2021. Motion carried 6 ayes/1 abstain (Kaliszewski) 10G) Final Reading – Ordinance Establishing Zoning Standards for Child/Adult Day Care Moved by Kaliszewski/Forester MOVED: To adopt Ordinance No. 1365, amending South St. Paul City Code to establish zoning regulations for child day care facilities and adult day care facilities.
