SOUTH ST. PAUL CITY COUNCIL MINUTES OF NOVEMBER 16, 2020 Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on Monday, November 16, 2020. ROLL CALL: Present: Mayor Francis Councilmembers Dewey, Flatley, Forester, Hansen, Kaliszewski and Seaberg Absent: None Staff Present: City Administrator, Joel Hanson Attorney, Kori Land City Clerk, Christy Wilcox EDA Manager, Ryan Garcia City Planner, Michael Healy EDA/Planning Assistant, Monica Mann 5) Presentations  There were no presentations. 6) Citizens’ Comments  There were no citizen comments 7) Agenda Moved by Seaberg/Forester MOVED: To approve the agenda. Motion carried 7 ayes /0 nays 8) Consent Agenda Moved by Kalisewski/Dewey Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council meeting minutes of November 2, 2020 B. Resolution No. 2020-157, approving accounts payable C. Resolution No. 2020-158, certifying unpaid utility charges to the County Auditor City Council Minutes of November 16, 2020 1 D. Appoint Olga Voronchak as a probationary entry level police officer effective on, or about December 14, 2020, at a starting salary as outlined in the current LELS contract contingent upon P.O.S.T. license eligibility, successful completion of a background investigation, physical examination and psychological evaluation E. Approve the City of West St. Paul to act as fiscal agent for the cities of South St. Paul, Mendota Heights, Sunfish Lake and Lilydale for recycling grant dollars provided by Dakota County F. Resolution No. 2020-159, declaring certain property surplus and authorize the sale of such property G. Resolution No. 2020-163, approving a Pipeline Crossing Agreement between the City of South St. Paul and Union Pacific Railroad Company for Concord Street Improvements H. Business Licenses I. Hiring of DNS Plumbing & Heating to furnish and install Plasma Air Model 602 Plasma Air Ionizer Units into 14 HVAC units at Doug Woog Arena Motion carried 7 ayes/0 nays 9A) Certifying Unpaid Charges to the County Auditor Kevin Oesterreich, 548 6th Avenue South requested that the City void the charges against his property that were imposed relative to code enforcement citations and fees. Moved by Seaberg/Forester MOVED: To adopt Resolution No. 2020-156, as amended, certifying delinquent charges to the Dakota County Auditor for collection with the property taxes payable in 2021. Motion carried 7 ayes/0 nays (The amendment included the removal of charges at 548 6th Avenue South. The proposed charges will be considered at a future City Council meeting) 10A) Setback Variance for a Proposed Driveway at 228 4th Avenue North Moved by Hansen/Flatley MOVED: To adopt Resolution No. 2020-162, approving a Variance to allow a driveway to be constructed with zero (0) feet from the south side property line at 228 4th Avenue North. Motion carried 7 ayes/0 nays City Council Minutes of November 16, 2020 2 10B) Second Reading – Ordinance Amending to Number of Chicken Licenses Moved by Seaberg/Forester MOVED: To adopt Resolution No. 2020-160, approving the Final Plat of Harlow Addition. Motion carried 7 ayes/0 nays Moved by Seaberg/Forester MOVED: To approve the draft development agreement and stormwater maintenance agreement as part of the Final Plat of Harlow Addition and authorize the City Engineer to finalize the agreements prior to signature. Motion carried 7 ayes/0 nays 10C) First Reading – Ordinance Amendment Regarding Monument and Electronic Signs Councilmember Kaliszewski introduced the following proposed ordinance, as amended, for its first reading: AN ORDINANCE ALLOWING INSTITUTIONAL USES TO HAVE CHANGEABLE COPY ELECTRONIC SIGNS WHEN LOCATED IN RESIDENTIAL NEIGHBORHOODS The amendment included that signs shall be turned off between 10:00 PM and 7:00 AM and that no part of the display shall change more than once every 15 seconds 10D) Solid Waste Abatement Ordinance Councilmember Francis introduced the following proposed ordinance for its first reading: AN ORDINANCE AMENDING SOUTH ST. PAUL CITY CODE AMENDING CITY CODE CHAPTER 46 REGARDING SOLID WASTE 10E) Appoint Replacement Board Member to South Metro Fire Department Board of Directors Moved by Francis/Hansen MOVED: To appoint Councilmember Seaberg to fill the remainder of Councilmember Flatley’s term on the South Metro Fire Board (term expires 12/31/20). Motion carried 7 ayes/0 nays City Council Minutes of November 16, 2020 3 11) Mayor and City Council Communications 12) Closed Session Moved by Forester/Flatley MOVED: To move into closed session pursuant to Minnesota Statutes 13D.05, Subd. 3(c) to develop or consider offers for the purchase of real property located on Concord Street North and Hardman Avenue North. Motion carried 7 ayes/0 nays Moved by Forester/Kaliszewski MOVED: To reopen the regular meeting of the City Council.
