SOUTH ST. PAUL CITY COUNCIL MINUTES OF DECEMBER 7, 2020 Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on Monday, December 7, 2020. ROLL CALL: Present: Mayor Francis Councilmembers Dewey, Flatley, Forester, Hansen, Kaliszewski and Seaberg Absent: None Staff Present: City Administrator, Joel Hanson Attorney, Kori Land City Clerk, Christy Wilcox EDA Manager, Ryan Garcia City Planner, Michael Healy 5) Presentations  There were no presentations. 6) Citizens’ Comments  There were no citizen comments 7) Agenda Moved by Seaberg/Flatley MOVED: To approve the agenda. Motion carried 7 ayes /0 nays 8) Consent Agenda Moved by Forester/Kaliszewski Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council meeting minutes of November 16, 2020 B. Resolution No. 2020-177, approving accounts payable C. Approve the South St. Paul City Council & EDA meeting schedule for the 2021 calendar year D. Social Media Policy E. 2021 Pay Range for Seasonal/Variable Positions City Council Minutes of December 7, 2020 1 F. City Council meeting minutes of November 12, 2020 G. Business Licenses H. Accept letter of resignation from Cindy Bonawitz, Parks and Recreation Support Specialist with the City of South St. Paul effective December 5, 2020 I. Resolution No 2020-181, accepting the conveyance of easements from the South St. Paul Economic Development Authority J. Resolution No. 2020-175, approving a Joint Powers Agreement - Dakota County Department of Transportation Maintenance Agreement between the County of Dakota and the City of South St. Paul K. Resolution No. 2020-182, accepting the conveyance of easements from the Housing and Redevelopment Authority of the City of South St. Paul L. Enter into a Professional Services Agreement with BRKW for special benefits appraisal services for the Concord Street project in the amount of $16,000.00 M. Resolution No. 2020-180, accepting quotes and awarding 2019-011 Mississippi Riverbank Erosion Repair N. Resolution No. 2020-178, establishing Concord Street as a Municipal State Aid Street O. Resolution No. 2020-179, providing Municipal Concurrence for Dakota County to designate Concord Street as a County State Highway (CSAH 56) Motion carried 7 ayes/0 nays 9A) Certifying Unpaid Charges to the County Auditor The Mayor opened the public hearing on the certification of unpaid charges to the County Auditor for the property located at 548 6th Avenue South. Kevin Oesterreich, 548 6th Avenue South requested that the City void the charges against his property that were imposed relative to code enforcement citations and fees. Moved by Dewey/Seconded by Kaliszewski to close the public hearing. Motion carried 7 ayes/0 nays Moved by Seaberg/Francis MOVED: To adopt Resolution No. 2020-166, certify unpaid charges to the Dakota County Auditor for Parcel No. 36-75100-03-190 (548 6th Avenue South). Motion carried 7 ayes/0 nays 9B) Public Hearing – 2021 Budgets, Tax Levies, Fee Schedule, and CIP Mayor Francis opened the public hearing. Finance Director Clara Hilger and City Administrator Joel Hansen provided information and analysis on the 2021 proposed budget and tax levies. The public hearing was then closed. Motion carried 6 ayes/1 nay (Flatley) Moved by Kaliszewski/Forester MOVED: To adopt Resolution No. 2020-169, approve 2021 Economic Development Authority Property Tax Levy. Motion carried 6 ayes/1 nay (Flatley) Moved by Kaliszewski/Hansen MOVED: To adopt Resolution No. 2020-170, approve 2021 Housing and Redevelopment Authority Property Tax Levy. Motion carried 6 ayes/1 nay (Flatley) Moved by Hansen/Forester MOVED: To adopt Resolution No. 2020-171, approve the 2020 Operating Budgets. Motion carried 6 ayes/1 nay (Flatley) Moved by Seaberg/Kaliszewski MOVED: To adopt Resolution No. 2020-172, approve the 2021 Fee Schedule. Motion carried 7 ayes/0 nays Moved by Dewey/Hansen MOVED: To adopt Resolution No. 2020-173, adoption of the 2021-2025 Capital Improvement Plan. Motion carried 6 ayes/1 nay (Flatley) City Council Minutes of December 7, 2020 3 10A) 2020 Liquor License Renewals Moved by Flatley/Foresters MOVED: To adopt Resolution No. 2020-165, approving 2021 Liquor Licenses. Motion carried 7 ayes/0 nays 10B) On-Sale Liquor License Renewal for Las Islas Mexican Restaurant – 600 Concord Street North Moved by Kaliszewski/Flatley MOVED: To adopt Resolution No. 2020-167, denying On-Sale Liquor License at 600 Concord Street North – Las Islas Gemelas, LLC. Motion carried 6 ayes/1 nay (Dewey) 10C) Second Reading – Solid Waste Abatement Ordinance Moved by Seaberg/Hansen MOVED: To adopt Ordinance No. 1369, amending South St. Paul City Code Chapter 46 regarding solid waste. Motion carried 7 ayes/0 nays 10D) Second Reading – Monument Signs and Electronic Changeable Copy Signs Moved by Hansen/Flatley MOVED: To adopt Ordinance No. 1368, modifying the rules for monument signs and allowing institutional uses to have changeable copy electronic signs in residential zoning districts. Motion carried 7 ayes/0 nays City Council Minutes of December 7, 2020 4 10E) First Reading – Vacating a Portion of the Pitt Street Right-of-Way Mayor Francis introduced the following proposed ordinance for its first reading: AN ORDINANCE VACATING A PORTION OF FORMER PITT STREET LOCATED WITHIN THE CITY OF SOUTH ST PAUL, MINNESOTA 10F) Snow and Ice Management Policy Updates and Ordinance Amendment Councilmember Hansen introduced the following proposed ordinance for its first reading: An ordinance amending Sections 54-5 and 58-101 regarding snow removal on city sidewalks and snow emergencies 10G) Critical Water Usage Ordinance Councilmember Seaberg introduced the following ordinance for its first reading: An ordinance regulating nonessential water usage upon critical water deficiency as authorized by Minnesota Statutes 103G.291 10H) Declaration and Resolution Extending Local Emergency Moved by Seaberg/Hansen MOVED: To adopt Resolution No. 2020-176, declaration and resolution extending declaration of emergency.
