SOUTH ST. PAUL CITY COUNCIL MINUTES OF AUGUST 16, 2021 1) Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on August 16, 2021. 2) ROLL CALL: Present: Mayor Francis Councilmembers Bakken, Dewey (Remotely), Hansen, Kaliszewski Absent: Councilmember Podgorski and Seaberg Staff Present: City Administrator, Joel Hanson Attorney, Peter Mikhail City Clerk, Christy Wilcox City Planner, Michael Healy City Engineer, Sue Polka 3) Christy Wilcox read the invocation. 4) Pledge of Allegiance 5) Presentations  Police Chief Bill Messerich introduced Police Officer Olga Voronchak. 6) Citizens’ Comments  Isaac Contreras, discussed the National Association of Hispanic Real Estate Professionals and the mission statement of the association. 7) Agenda Moved by Kaliszewski/Hansen MOVED: To approve the agenda. Motion carried 5 ayes /0 nays 8) Consent Agenda Moved by Kaliszewski/Bakken Resolved, that the South St. Paul City Council does hereby approve the following: City Council Minutes of August 16, 2021 1 A. City Council meeting minutes of August 2, 2021 B. Resolution No. 2021-130, approving accounts payable C. Accept the quote from Curbside Landscape & Turf Maintenance for turf maintenance services for 2022-2024 D. Resolution No. 2021-128, approving State of Minnesota Joint Powers Agreements with the City of South St. Paul on behalf of its City Attorney and Police Department E. Resolution No. 2021-129, relating to airport; approve the agreement with SEH for Administration Services for the Hangar 5 Door Project F. Amendment No. 2 to the Joint Powers Agreement (JPA) with Dakota County extending the effective date of the agreement through December 1, 2022 G. Retain the services of Wold Architects for the final design and construction documents for first-floor City Hall renovation H. Transfer of excess 2020 General Fund Unassigned Fund Balance to the Capital Programs Fund I. Business Licenses J. Resolution No. 2021-131, relating to Airport; approving the Right of First Refusal at Fleming Field with Hans Meyer K. Resolution No. 2021-132, relating to Airport; approve application for Federal Assistance between the FAA and the South St. Paul Airport L. Authorize the City Engineer and City Clerk to execute the Grant Agreement - Construction Grant for the City of South St. Paul Shade Tree Project under the MN Natural Resources Shade Tree Program Motion carried 5 ayes/0 nays 9A) Public Hearings – Liquor Violation Moved by Kaliszewski/Dewey MOVED: To adopt Resolution No. 2021-126, imposing sanction upon retail intoxicating liquor license holder – Croation Hall ($100.00 civil penalty is imposed, but $400.00 is suspended upon the condition that there is no same or similar offence within one year of April 1, 2021). Motion Fails 3 ayes (Dewey, Kaliszewski, Francis) 2 nays (Bakken, Hansen) City Council Minutes of August 16, 2021 2 Moved by Hansen/Kaliszewski MOVED: To adopt Resolution No. 2021-126, imposing sanction upon retail intoxicating liquor license holder – Croation Hall ($200.00 civil penalty is imposed, but $300.00 is suspended upon the condition that there is no same or similar offence within one year of April 1, 2021). Motion carried 4 ayes/1 nay (Bakken) Moved by Dewey/Kaliszewski MOVED: To adopt Resolution No. 2021-127, imposing sanctions upon retail intoxicating liquor license holder – Bugg’s Place ($200.00 civil penalty is imposed, but $300.00 is suspended upon the condition that there is no same or similar offence within one year of April 1, 2021). Motion carried 4 ayes/1 nay (Bakken) 9B) Public Hearing – Tobacco Violation Moved by Kaliszewski/Dewey MOVED: To adopt Resolution No. 2021-125, charging licensee an administrative penalty for a tobacco sale violation (Kaposia Convenience Center – 1214 Southview Boulevard) Motion carried 5 ayes/0 nays 10A) Fence Variance – 2009 Southview Boulevard Moved by Bakken/Kaliszewski MOVED: To adopt Resolution No. 2021-121, approving a fence height variance at 2009 Southview Boulevard. Motion carried 5 ayes/0 nays City Council Minutes of August 16, 2021 3 10B) Variances – 537 8th Avenue South Moved by Kaliszewski/Hansen MOVED: To approve the Variances conditioned on compliance with plan submittals, complying with building permit requirements and Section 302.1 of IRC, confirm property lines and the Variances terminate if the improvements are not initiated within a year of approval. Motion carried 5 ayes/0 nays 10C) “The Yards Phase II” Multi-Family Residential Project Development Application Moved by Hansen/Kaliszewski MOVED: To adopt Resolution No. 2021-123, approving a Conditional Use Permit for a Planned Unit Development Amendment and Site Plan for “The Yards” Phase II. Motion carried 5 ayes/0 nays 10D) Conditional Use Permit for Outdoor Dining at Black Sheep Coffee Moved by Kaliszewski/Bakken MOVED: To adopt Resolution No. 2021-124, approving a Conditional Use Permit and Site Plan for outdoor dining at Black Sheep Coffee Café. Motion carried 5 ayes/0 nays 10E) First Reading – Ordinance Amendment – Housing with Services Mayor Francis introduced the following ordinance for its first reading: AN ORDINANCE AMENDING IN PART AND REPEALING IN PART SECTIONS 118- 121, 118-123, 118-124, 118-125, 118-126, 118-127, 118-129, 118-134 City Council Minutes of August 16, 2021 4 10F) Grading and Fill Permit Application for Alter Logistics Moved by Bakken/Kaliszewski MOVED: To grant a grading and fill permit for construction of a new rail spur track into the Alter Logistics facility located at 801 Barge Channel Road in the City of St. Paul. Motion carried 5 ayes/0 nays 11) Mayor and Council Communication Closed Session Moved by Hansen/Kaliszewski MOVED: To close the meeting at 8:43 p.m. pursuant to Minnesota Statutes Section 13D.05, Subd. 3(b), for a confidential attorney-client discussion regarding pending litigation in the South St. Paul Airport Taxiway Project eminent domain case, City of South St. Paul v. F. James Hickey et al., Court File No. 19HA-CV-21-1566.
