SOUTH ST. PAUL CITY COUNCIL MINUTES OF AUGUST 7, 2023 1. Mayor Jimmy Francis called the regular meeting of the City Council to order at 7:00 PM on August 7, 2023. 2. ROLL CALL: Present: Council Members, Bakken, Hansen, Kaliszewski, Podgorski, Seaberg, Thompson, Mayor Francis Absent: None Staff Present: City Administrator, Ryan Garcia City Attorney, Amanda Johnson City Clerk, Deanna Werner City Engineer, Nick Guilliams City Planner, Michael Healy 3. Accounts Payable C. Accept the Year Ended December 31, 2022, Audited Financial Report D. Doug Woog Arena Ice Rental Agreement with South St. Paul Youth Hockey Association E. Doug Woog Arena Zamboni Wrap Advertising Agreement with Archer Exteriors F. Accept Letter of Resignation – Olga Voronchak G. Deleted H. Approving a Non-Exclusive Public Parking Easement I. Approve Contracts with Park Construction for the Taxiway A Reconstruction Project J. Approve Contracts with Danner Inc. for the Taxilane Charlie Reconstruction Project K. Approve Revised Non-DOT Drug and Alcohol Policy L. Business Licenses City Council Minutes of August 7, 2023 1 M. Approve Professional Services Agreement with 4 Seasons Property Care LLC for Abatement Services N. Vacating Public Easements Located within the City of South St. Paul Moved: Approval of Resolution 2023-114, vacating public easements located within the City of South St. Paul. Moved by: Seaberg/Podgorski Vote: 7 ayes / 0 nays, motion carried. B. Introducing for First Reading an Interim Ordinance Related to Cannabis Products and Businesses – Public Places First Reading of an ordinance related to Cannabis Products and Businesses – Public Places was introduced by Council Member Seaberg. C. City Council called for a Public Hearing to consider an application for a Temporary On-Sale Intoxicating Liquor License made by the Gay Softball World Series, 501(c)3, non-profit on Monday, August 21, 2023. 10. General Business: A. First Reading – Cannabis Use in Public (see 9-B) First Reading of an ordinance to address Cannabis Use in Public was introduced by Council Member Seaberg. B. Bryant’s Ridge Development Application Resubmittal Moved: Approval of Resolution 2023-118, authorizing a preliminary plat, conditional use permits for a planned unit development, conditional use permits, and site plans for Bryan’s Ridge with the addition of condition 40. Moved by: Seaberg/Podgorski Vote: 4 ayes / 3 nays, motion carried. C. First Reading - Ordinance Proactively Rezoning Properties to Align with 2040 Comprehensive Plan First Reading of an ordinance Proactively Rezoning Properties to Align with 2040 Comprehensive Plan was introduced by Council Member Podgorski. First Reading - Mississippi River Critical Corridor Area Ordinance Update First Reading of the Mississippi River Corridor Area Ordinance repeal and replace was introduced by Council Member Bakken. E. Second Reading – Ordinance # 1409, Amending City Code Related to Alcoholic Beverages in City Parks Moved: Approval of Ordinance #1409, amending the City Code related to alcoholic beverages in city parks. Moved by: Kaliszewski/Bakken Vote: 7 ayes / 0 nays, motion carried. F. Approval of Resolution 2023-115 Authorizing the City of South St. Paul to Apply to the Minnesota Public Facilities Authority for a Loan from the Clean Water Fund/Revolving Fund. Moved: Approve Resolution 2023-115, authorizing the City of South St. Paul to apply to the Minnesota Public Facilities Authority for a loan form the Clean Water Fund/Revolving Fund. Moved by: Seaberg/Hansen Vote: 7 ayes / 0 nays, motion carried. G. Approval of City Administrator Contract Moved: Approve the employment agreement 1st amendment. Moved by: Seaberg/Bakken Vote: 7 ayes / 0 nays, motion carried. Moved: Approve Resolution 2023-130 rescinding additional compensation for the Economic Development Director. Moved by: Thompson/Hansen Vote: 7 ayes / 0 nays, motion carried. 11. Mayor and Council Communication 12. Recess for EDA Meeting Moved by: Podgorski/Kaliszewski Moved: Recess the meeting to convene the EDA Meeting Vote: 7 ayes / 0 nays, motion carried. Meeting was recess at 9:25 PM Moved by: Kaliszewski/Seaberg Moved: Reopen recessed meeting. Vote: 7 ayes / 0 nays, motion carried. The meeting was reopened at 9:37 PM City Council Minutes of August 7, 2023 3 12. Closed Session: A. Closed session pursuant to Minnesota Statutes § 13D.05, Subd. 3(b), for a confidential attorney-client discussion regarding litigation for 404 Orchard Lane. Moved by: Seaberg/Podgorski Moved: Close the meeting. Vote: 7 ayes / 0 nays, motion carried. The meeting was closed at 9:38 PM Moved by: Bakken/Podgorski Moved: Re-open the meeting Vote: 7 ayes / 0 nays, motion carried. The meeting was re-opened at 10:07 PM 13.
