Spearfish City Council Board of Adjustment Date: April 17, 2017 Minutes Dana Boke called the meeting of the Spearfish Board of Adjustment to order at 7:38 PM on Monday, April 17, 2017 in the Council Chambers of the Municipal Services Centre with the following members present: Boke, Clark, Hodgs, Jacobs, Klarenbeek, Lee and Schmit. Also present were Finance Officer Dutton, City Planner Watson, City Attorney Davis and Administrative Assistant Weber. Order of Business – Schmit moved, Jacobs seconded and all voted to approve the order of business. There were no potential conflicts-of-interest declared. Variance – Planning Commission recommended approval to Board of Adjustment for a variance request at 235 Ohio Street - southwest corner of Canyon/Ohio. Request to the front setback along Ohio Street; Code requires 25 feet; applicant requests 15 feet in an R-2 Two Family Residential district. Details of the request as follows: • Applicant: Jerud Pummel on behalf of David and Kellie Pummel • Location: 235 W. Ohio; Lot 11 and 12 of the Ramsdell Addition to the City of Spearfish Zoning: R-2; One and Two Family Residential • Variance Request: Zoning Ordinance Article IV. Section 3. D.1 Area Regulations require a twenty five (25) foot front yard setback. Applicant proposes fifteen (15) feet. Owners immediately adjacent to this site were notified. No comments received. Boke opened the public hearing at 7:44 PM. David Pummel, applicant, spoke. There were no other written or oral comments and the public hearing was closed at 7:46 PM. Schmit moved, Lee seconded and all voted to approve the variance request for Mr. Pummel. There being no further business before the Board of Adjustment, Hodgs moved, Klarenbeek seconded and all voted to adjourn at 8:06 PM. Dated this 17th day of April 2017.
