Spearfish City Council Regular Session Minutes June 5, 2023 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Monday, June 5, 2023. Mayor Senden presided and called the meeting to order. Roll call was taken with the following members present: Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath. Absent: none. Also present: City Administrator McFarland, City Attorney McDonald, Finance Officer DeNeui, Public Safety Director Rotert, Public Works Director Broyles, City Planner Kapsa, Parks and Recreation Director Ehnes, and Assistant Public Works Director McMahon. All stood and recited the pledge of allegiance. Hourigan moved, Jacobs seconded, and all voted to approve the agenda as presented. No potential conflicts of interest were noted. Public Comment – At 5:32 p.m. a time for public comment was opened and comments regarding mining were received from residents Michelle Stampe, Duane Lafaye, Amy Williams, Patricia Partridge as well as non-resident Alexander Massa. Comments were also received from Jim Bohn on Spearfish in general. The time for public comment was closed at 5:43 p.m. Consent Agenda – Clark moved, Rath seconded, and all voted to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated May 15, 2023. B. Add Julie Moore-Peterson to the 2023 library volunteer list. C. Add Clayton Donovan and Connor Comer to the public works volunteer list. Resolution 2023-18 – Clark moved, Hodgs seconded, and all voted to approve Resolution 2023-18 as follows: RESOLUTION 2023-18 A RESOLUTION IN OPPOSITION TO THE GOLDEN CREST EXPLORATION DRILLING PROJECT BY SOLITARIO ZINC CORP. WITHOUT FURTHER STUDY AND CONCLUSIONS FROM AN ENVIRONMENTAL IMPACT STATEMENT WHEREAS, the U.S. Department of Agriculture, National Forest Service (“USFS”), Northern Hills District has released a draft Environmental Assessment of Solitario Zinc Corp.’s Golden Crest Exploration Drilling Project; and WHEREAS, Solitario’s project identified 25 drill sites distributed throughout an area at Big Hill and south along Tinton Road and near Timon and Savoy and each drill site will be a depth of up to 500 meters and will disturb approximately 1875 square feet of surface area, in addition to the associated impacts and disturbances in the surrounding areas; and WHEREAS, the drill sites are located in the Spearfish Creek watershed; and  WHEREAS, the draft Environmental Assessment identified potential impacts to the Madison aquifer, which could impact the Minnelusa aquifer through interaction between the two aquifers; and WHEREAS, the draft Environmental Assessment understated the importance of the Spearfish Creek Watershed to the City of Spearfish by stating it is only used to irrigate city parks when streamflow losses serve as an important recharge source for the Madison aquifer which supplies the City of Spearfish’s municipal water supply; and WHEREAS, the potential for adverse impacts to the sources of the City of Spearfish’s drinking water supply without further study and understanding is too great a risk for the population of Spearfish; and WHEREAS, the Spearfish Creek Watershed which includes Spearfish Creek, a perennial freshwater stream and fishery that sustains a healthy population of wild rainbow trout, which could potentially become impaired through drill site interactions with surface water and groundwater; and WHEREAS, the D.C. Booth Historic National Fish Hatchery and Archives, a popular tourist destination within the City of Spearfish that draws nearly 200,000 visitors each year, relies on uncontaminated water from Spearfish Creek for the ponds used for its hatchery activities; and WHEREAS, Spearfish’s proximity to recreational opportunities, particularly at Spearfish Creek, Big Hill, Iron Creek, and the surrounding areas (including, but not limited to, hunting, fishing, biking, snowmobiling, and hiking) provides significant revenue to Spearfish’s economy through tourism; and WHEREAS, the draft Environmental Assessment identified potential impacts to the recreation and industry users in the project area, but those impacts would not be fully understood without an environmental impact statement; and WHEREAS, the disturbances to recreation caused by this project could alter the promotion of the area for recreation with a potential long-term negative impact on the tourism industry in the area; and WHEREAS, the Spearfish City Council opposes exploration for future potential gold mining in the Spearfish Creek watershed as maintaining the quality and quantity of the water supply is of utmost importance to the City of Spearfish; and WHEREAS, the Spearfish City Council opposes exploration for future potential gold mining in the project area as it is a major recreation and tourism area, the disturbance of which will adversely impact the Spearfish economy and quality of life for Spearfish residents in a significant way; and WHEREAS, comments on the draft environmental assessment are due to the U.S. Forest Service, Northern Hills District, by June 8, 2023; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Spearfish that due to the potential risk of harm to the Spearfish Creek watershed, the water supplies of communities in the Northern Black Hills, fish and wildlife habitat in the Spearfish Creek watershed, as well as disturbances to recreational and industry activities, and the resulting negative impact on the local economy, the City of Spearfish opposes the Golden Crest Exploration Drilling Project without further study and conclusions as to the severity of impacts through the preparation of an environmental impact statement by the United States Department of Agriculture Forest Service. License – A public hearing was opened at 5:50 p.m. to consider an application from Daryll Propp with Elkhorn Ridge RV Park and Campground for a retail (on-off sale) wine and cider license located at 20189 US Hwy 85. No oral or written comments were received and the hearing was closed. Klarenbeek moved, Jacobs seconded, and all voted to approve the application. License – A public hearing was opened at 5:51 p.m. to consider an application from Allison McDaniel with Spearfish Creek Wine Bar for a special on-sale wine license for the Canyon Acoustic Series each Wednesday beginning June 14 through August 2, 2023, from 6:00 p.m. to 8:30 p.m. at the City Park Bandshell. No oral or written comments were received and the hearing was closed. Hodgs moved, Hourigan seconded, and all voted to approve the application. Ordinance 1378 – Klarenbeek moved, Rath seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the second reading of Ordinance 1378 – An Ordinance Granting a Cable TV Franchise. (Clarity Telecom, LLC) Ordinance 1379 – Hodgs moved, Jacobs seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the second reading of Ordinance 1379 – An Ordinance Granting a Cable TV Franchise. (Midcontinent Communications) Waive Fee – Klarenbeek moved, Hourigan seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to waive the $180 building permit fee for the construction of a new restroom facility at the Highway 14A Spearfish Rife & Trap Club Range. Easement – Hourigan moved, Klarenbeek seconded, and all voted to grant an easement in accordance with the Electric Easement Underground agreement to Black Hills Energy across a portion of City-owned property. Easement – Hourigan moved, Hodgs seconded, and all voted to grant an easement to Montana Dakota Utilities (MDU) in accordance with the Gas Main Easement agreement across a portion of City-owned property. Resolution 2023-17 – Clark moved, Hodgs seconded, and all voted to approve Resolution 2023-17 as follows: RESOLUTION 2023-17 A RESOLUTION TO TRANSFER REAL PROPERTY FROM THE CITY OF SPEARFISH TO SPEARFISH ECONOMIC DEVELOPMENT CORPORATION WHEREAS, the City of Spearfish has completed public infrastructure at the Sky Ridge affordable housing development and individual lots are ready for home construction. WHEREAS, pursuant to SDCL 9-27-36 and 9-54-1, the City of Spearfish will convey 4 lots to the Spearfish Economic Development Corporation for affordable housing thus serving a public purpose and encouraging and assisting in the location of new business and industry and the expansion of existing business development.
