Spearfish City Council Regular Session Minutes August 7, 2023 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Monday, August 7, 2023. Mayor Senden presided and called the meeting to order. Roll call was taken with the following members present: Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath. Absent: Clark. Also present: City Administrator McFarland, City Attorney McDonald, Finance Officer DeNeui, Public Safety Director Rotert, Parks and Recreation Director Ehnes, Planning Director Kapsa, City Engineer Mathis, Assistant Police Chief Dean, and Assistant Public Works Director McMahon. All stood and recited the pledge of allegiance. Klarenbeek moved, Jacobs seconded, and all voted to approve the agenda as presented. No potential conflicts of interest were noted. Public Comment – At 5:32 p.m. a time for public comment was opened and closed with no comments being received. Consent Agenda – Jacobs moved, Hodgs seconded, and all voted to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated July 17, 2023. B. Approve a special on-sale liquor license for Spearfish Public House for the Dakota 5-0 Pre- Party on September 1, 2023, from 5:00 p.m. to 9:00 p.m. at the Spearfish City Park Bandshell. C. Approve a special malt beverage license for Spearfish Creek Wine Bar for the Black Hills Beer Run on September 10, 2023, from 12:00 p.m. to 4:00 p.m. at the Spearfish City Park Pavilion. D. Approve a special on-sale liquor license for False Bottom Bar for the BHSU Scholarship Gala on August 19th from 3:00 p.m. to 11:00 p.m. at the Joy Center. E. Add Nancy Henderson and Susan Douglas to the 2023 library volunteer list and Heath Brown to the 2023 volunteer firefighter list. Proposal – Hodgs moved, Jacobs seconded and with Hodgs, Hourigan, Jacobs, Klarenbeek and Rath voting aye, motion passed to approve the cost proposal from Interstate Engineering for Professional Services for the McLaughlin Sawmill Property and the East-West Road Corridor Projects at a cost not to exceed $34,580. Resolution 2023-21 – Hodgs moved, Klarenbeek seconded, and all voted to approve Resolution 2023-21 as follows: RESOLUTION 2023-21 A RESOLUTION LEVYING AN ANNUAL SPECIAL MAINTENANCE FEE FOR STREET SURFACES WHEREAS, SDCL § 9-43-138 authorizes the City of Spearfish to levy, for the purpose of maintaining or repairing public improvements, an Annual Special Maintenance Fee upon the lots fronting and abutting any municipally-maintained public improvements within the City of Spearfish; and WHEREAS, well-maintained public streets are necessary for the health, safety, and welfare of the citizens of the City of Spearfish; and WHEREAS, the Common Council of the City of Spearfish has determined that it is in the best interests of the City of Spearfish and its citizens to regularly inspect, maintain, and resurface its public streets and not permit Spearfish’s infrastructure to deteriorate to the point of failure; and WHEREAS, the City of Spearfish determines it equitable and fair for all citizens to share in the cost of maintaining all public infrastructure; and NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, that all taxable real property parcels fronting and abutting a city street shall be assessed a special maintenance fee of one dollar ($1.00) per foot; and BE IT FURTHER RESOLVED that no taxable real property parcel fronting and abutting a city street shall be assessed more than one hundred dollars ($100.00), annually per platted lot; and BE IT FURTHER RESOLVED that the Finance Officer of the City of Spearfish, Lawrence County, South Dakota, is directed to implement a Special Street Maintenance Fee to the general assessment and regular assessment, and to certify that assessment to the Lawrence County Auditor to be collected as municipal taxes for purposes of repairing and maintaining public infrastructure. BE IT FURTHER RESOLVED that this Special Street Maintenance Fee is effective for 2024 taxes payable in 2025. Dated this 7th day of August, 2023. Memorandum of Understanding – Hodgs moved, Hourigan seconded, and all voted to approve a Memorandum of Understanding with Black Hills State University for the use of the soccer field at the Black Hills Energy Complex. Final Plat – A public hearing to consider a Final Plat for Tract A, Tract B, and Tract C of Backens Estates Subdivision was opened at 5:40 p.m. and closed with no oral or written comments being received. Jacobs moved, Klarenbeek seconded, and all voted to approve the Final Plat. Resolution 2023-22 – Hodgs moved, Jacobs seconded, and all voted to approve Resolution 2023- 22 as follows: RESOLUTION 2023-22 A RESOLUTION IN SUPPORT OF AN APPLICATION FOR FINANCIAL ASSISTANCE TO THE SOUTH DAKOTA HOUSING AND DEVELOPMENT AUTHORITY BY STENCIL GROUP, LLC, OR ITS AFFILIATES, AGENTS, OR ASSIGNS, FOR THE BENEFIT OF MULTIFAMILY DEVELOPMENT WHEREAS, Stencil Group, LLC (“Developer”) has proposed a project in which it will build multifamily housing units, some of which will be leased to tenants at 80% of the Area Median Income in the City of Spearfish (“Project”); and WHEREAS, the City of Spearfish Housing Study identified the need for additional multifamily housing in the moderate to market price range; and WHEREAS, this Project will help, but not resolve a housing shortage in the City; and WHEREAS, the City of Spearfish (“City”) and Stencil Group, LLC (“Developer”) have determined it is necessary to proceed with improvements to the City's infrastructure, thus enabling additional multifamily units to be constructed in the city limits of Spearfish; and WHEREAS, the Developer has determined financial assistance will be necessary to undertake the Project and an application for financial assistance to the South Dakota Housing and Development Authority will be prepared by Developer for the Project; and WHEREAS, the City will work with the Developer to ensure the preliminary project infrastructure plans meet the City's requirements for adequate drinking water, sewer conveyance, water treatment capacity and distribution, storm sewer, and all other necessary improvements as needed; and WHEREAS, the City has adequate treatment facilities and water supply to accommodate the Project; and WHEREAS, upon the City’s standards, specifications, conditions being met by Developer, the City is committed to the ownership and long-term maintenance of the infrastructure upon City’s acceptance in accordance with a Dedication Agreement; and NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, that the City hereby supports the submission of an Application for financial assistance by Stencil Group, LLC, to the South Dakota Housing and Development Authority and City officials of the City of Spearfish are hereby authorized to deliver such other documents as necessary, to assist with the Application. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, that the City hereby supports the submission of an Application for Financial Assistance by Tate Schipporeit, to the South Dakota Housing and Development Authority. WHEREAS, pursuant to SDCL 9-27-36 and 9-54-1, the City of Spearfish will convey 4 lots to the Spearfish Economic Development Corporation for affordable housing thus serving a public purpose and encouraging and assisting in the location of new business and industry and the expansion of existing business development. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, that the following described territory be conveyed to the Spearfish Economic Development Corporation: Lot 14-17 of Block 1 of Sky Ridge Subdivision, being a part of Tract V-1 of Sky Ridge Subdivision, which is a part of Tract V of Elkhorn Ridge Addition, City of Spearfish, Lawrence County, South Dakota. under the terms and conditions of the Development Agreement approved on February 18, 2020 and amendment thereto approved March 6, 2023. Information will be sent with the August monthly water bills and has been posted on the City social media and website.
