Spearfish City Council Regular Session Minutes October 2, 2023 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Monday, October 2, 2023. Mayor Senden presided and called the meeting to order. Roll call was taken with the following members present: Clark, Hodgs, Hourigan, Klarenbeek, and Rath. Absent: Jacobs. Also present: City Administrator McFarland, City Attorney McDonald, Public Safety Director Rotert, Finance Officer DeNeui, Public Works Director Broyles, Parks and Recreation Director Ehnes, Planning Director Kapsa, Human Resource Director Mathis, Assistant Finance Officer Tyler, and Assistant Public Works Director McMahon. All stood and recited the pledge of allegiance. Klarenbeek moved, Hourigan seconded, and all voted to amend the agenda to add a cost of $93,790.10 to item 13C. Hodgs moved, Hourigan seconded, and all voted to approve the agenda as amended. No potential conflicts of interest were noted. Public Comment – At 5:32 p.m. a time for public comment was opened. John Dale, resident, spoke on progress with his personal endeavors. Tracee Wagenman, resident, spoke on the Hill Street annexation and use of Tax Increment Financing for the project and also expressed concerns with traffic and evacuation of areas further up Tinton Road if there were a wildland fire. Greg Moselle, resident, spoke on email communications with elected officials. Mark Weber, resident, also spoke on the Hill Street annexation and asked if the traffic would be studied prior to development. City Planner Marlo noted it would. The time for public comment was closed at 5:41 p.m. Consent Agenda – Clark moved, Rath seconded, and all voted to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated September 18, 2023. Proclamation – Mayor Senden proclaimed October 2, 2023 as World Habitat Day and presented the proclamation to a representative from the Spearfish ReStore. Ordinance 1384 – Clark moved, Hodgs seconded, and all voted to approve the first reading of Ordinance 1384 – An Ordinance Adopting the Revisions to the City of Spearfish Personnel Policy Manual. Resolution 2023-29 – Clark moved, Klarenbeek seconded, and all voted to approve Resolution 2023-29 as follows: RESOLUTION NO. 2023-29 A RESOLUTION OF SPEARFISH CITY COUNCIL, SPEARFISH, SOUTH DAKOTA, DESIGNATING SPEARFISH AS A BEE CITY USA® AFFILIATE. WHEREAS, the mission of BEE CITY USA is to galvanize communities to sustain pollinators, responsible for the reproduction of almost 90% of the world's flowering plant species, by providing them with healthy habitat, rich in a variety of native plants and free to nearly free of pesticides; and WHEREAS, thanks to the more than 3,600 species of native bees in the United States, along with introduced honey bees, we have very diverse dietary choices rich in fruits, nuts, and vegetables; and WHEREAS, bees and other pollinators have experienced population declines due to a combination of habitat loss, poor nutrition, pesticides (including insecticides, fungicides, and herbicides), parasites, diseases, and climate change; and WHEREAS, pollinator-friendly communities can benefit local and regional economies through healthier ecosystems, increased vegetable and fruit crop yields, and increased demand for pollinator- friendly plant materials from local growers; and WHEREAS, ideal pollinator-friendly habitat (A) Is comprised of mostly native wildflowers, grasses, vines, shrubs, and trees blooming in succession throughout the growing season to provide diverse and abundant nectar and pollen, since many wild pollinators prefer or depend on the native plants with which they co-adapted; (B) is free to nearly free of pesticides, as many pesticides can harm pollinators and/or their habitat; (C) comprises undisturbed spaces (leaf and brush piles, unmown fields or field margins, fallen trees and other dead wood) for nesting and overwintering; and (D) provides connectivity between habitat areas to support pollinator movement and resilience; and WHEREAS, Integrated Pest Management (IPM) is a long-term approach to maintaining healthy landscapes and facilities that minimizes risks to people and the environment by: identifying and removing the causes of pest problems rather than only attacking the symptoms (the pests); employing pests' natural enemies along with cultural, mechanical, and physical controls when prevention is not enough; and using pesticides only when no other method is feasible or effective; and WHEREAS, supporting pollinators fosters broad-based community engagement in environmental awareness and sustainability; and NOW, THEREFORE, in order to enhance understanding among local government staff and the public about the vital role that pollinators play and what each of us can do to sustain them, Spearfish chooses to support and encourage healthy pollinator habitat creation and enhancement, resolving as follows: 1. The City of Spearfish Parks and Rec Department is hereby designated as the BEE CITY USA sponsor. 2. The Parks and Forestry Superintendent of the Parks and Rec Department is designated as the BEE CITY USA Liaison. 3. Facilitation of Spearfish’s BEE CITY USA program is assigned to the Bee City Committee. 4. The Bee City Committee is authorized to and shall: a. Celebration: Host at least one educational event or pollinator habitat planting or restoration each year to showcase Spearfish’s commitment to raising awareness of pollinator conservation and expanding pollinator health and habitat.  b. Publicity & Information: Install and maintain at least one authorized BEE CITY USA street sign in a prominent location, and create and maintain a webpage on the City of Spearfish website which includes, at minimum a copy of this resolution and links to the national BEE CITY USA website; contact information for your BEE CITY USA Liaison and Committee; reports of the pollinator-friendly activities the community has accomplished the previous year(s); and your recommended native plant species list and integrated pest management plan (explained below). c. Habitat: Develop and implement a program to create or expand pollinator-friendly habitat on public and private land, which includes, but is not limited to, Identifying and inventorying Spearfish’s real property that can be enhanced with pollinator- friendly plantings; creating a recommended locally native plant list to include wildflowers, grasses, vines, shrubs, and trees and a list of local suppliers for those species; and, tracking (by square footage and/or acreage) annual area of pollinator habitat created or enhanced. d. Pollinator-Friendly Pest Management: Create and adopt an integrated pest management (IPM) plan designed to prevent pest problems, reduce pesticide use, and expand the use of non-chemical pest management methods. e. Policy & Plans: Establish, through the City of Spearfish, a policy in the Pollinator Preservation Plan of Spearfish’s Comprehensive Plan to acknowledge and commit to the BEE CITY USA designation and review the Pollinator Preservation Plan and other relevant documents to consider improvements to pest management policies and practices as they relate to pollinator conservation, identify appropriate locations for pollinator-friendly plantings, and consider other appropriate measures. f. Renewal: After completing the first calendar year as a BEE CITY USA affiliate, each February, apply for renewal of Spearfish’s BEE CITY USA designation following the format provided by BEE CITY USA, including a report of the previous year’s BEE CITY USA activities, and paying the renewal fee based on Spearfish’s population. DRD Concept and Final Plan – A public hearing was opened at 5:49 p.m. to consider the DRD Concept and Final Plan to allow construction of two new mixed-use structures in a DRD zoning district. No oral or written comments were received, and the hearing was closed. Resolution 2023-31 – Klarenbeek moved, Clark seconded, and all voted to approve Resolution 2023-31 as follows: RESOLUTION NO. 2023-31 A RESOLUTION OF ANNEXATION TO EXTEND THE BOUNDARIES OF THE CITY OF SPEARFISH, SOUTH DAKOTA, BY ANNEXING LANDS MORE SPECIFICALLY DESCRIBED HEREIN: WHEREAS, The City of Spearfish has conducted an analysis of the territory where a petition for voluntary annexation has been submitted, and has determined the resources necessary to serve the annexed territory; and, WHEREAS, the territory described herein adjoins and is contiguous to the existing boundaries of the City of Spearfish and is not separated from the existing City by any significant physical barriers, and annexation is natural and reasonable and the municipal body hereby created constitutes a homogenous and unified entity; and, WHEREAS, the City of Spearfish has held public hearings and considered all testimony regarding said annexation; and, WHEREAS, the City of Spearfish has fully complied with all statutory requirements of SDCL Chapter 9-4 required and precedent to this Resolution. Police Officer Wages – Following discussions, Klarenbeek moved, Rath seconded, and all voted to postpone the decision to the October 16, 2023, City Council meeting on the following requests: 1. Approve moving currently employed sworn police officer positions to a minimum of a step 8, crediting past service up to the maximum step within their current grade, and discontinue the current $2.00/hour rotating shift stipend for all sworn police officer positions, effective October 1, 2023. 2. Approve moving the starting wage for sworn police officer positions currently graded at a 17, 18, and 20, from a step 1 to step 8, effective October 1, 2023. Hiring Incentive – Klarenbeek moved, Hourigan seconded, and with Clark, Hodgs, Hourigan, Klarenbeek, and Rath voting aye, motion passed to increase the hiring incentive for police officer positions from $4,000 to $6,000, effective October 1, 2023. Retention Incentive – Hodgs moved, Hourigan seconded, and with Hodgs and Hourigan voting aye and Clark, Klarenbeek, and Rath voting nay, motion failed for a retention incentive of $4,000 for the following communications officers: Dylan Ash, Dawn Lolley, Brian Vinton, Brian Vosburg, and Alexandra Xu, payable on October 6, 2023. FYI – Mayor Senden noted that staff will research and explore an educational assistance program to begin January 1, 2024, with a policy to be reviewed at a later council meeting. Agreement – Clark moved, Hodgs seconded, and all voted to approve the Frawley Pond Settlement Agreement between the City of Spearfish and the Department of Agriculture and Natural Resources. Reject Bid – Clark moved, Rath seconded, and all voted to reject the bid from Dredging America for Frawley Pond Dredging Project. The project will be re-bid with a new completion date. Proposal – Clark moved, Hourigan seconded, and with Clark, Hodgs, Hourigan, Klarenbeek, and Rath voting aye, motion passed to accept the proposal from Meredith Construction for the Hillcrest Drive Culvert Replacement Project at a cost of $93,790.10. Proposal – Rath moved, Hourigan seconded, and with Clark, Hodgs, Hourigan, Klarenbeek, and Rath voting aye, motion passed to accept the proposal from HDR Engineering for engineering services for the design of the Colorado Boulevard Sanitary Sewer Upsize Phase 2 & 3 Projects at a cost of $310,430. Change Order – Hodgs moved, Rath seconded, and with Clark, Hodgs, Hourigan, Klarenbeek, and Rath voting aye, motion passed to approve Change Order 2 for the Sky Ridge Sports Complex Irrigation Well project for an increase of $149,336.30 (25.11%). Resolution 2023-32 – Hourigan moved, Rath seconded and all voted to approve Resolution 2023- 32 as follows: RESOLUTION 2023-32 BIPARTISAN INFRASTRUCTURE LAW (BIL) AIRPORT TERMINAL PROGRAM (ATP) FISCAL YEAR 2024 DISCRETIONARY GRANT OPPORTUNITY RESOLUTION AUTHORIZING SUBMISSION OF APPLICATION PURSUANT TO NOTICE OF FUNDING OPPORTUNITY WHEREAS, the City of Spearfish wishes to submit an application for consideration of award for Fiscal Year 2024, Department of Transportation (DOT), Federal Aviation Administration (FAA), Bipartisan Infrastructure Law (BIL), Airport Terminal Program (ATP) discretionary annual grant opportunity; and WHEREAS, the Black Hills-Clyde Ice Field (SPF) is an eligible airport with aging infrastructure; and WHEREAS, the grant program will provide approximately $1 billion in funding annually for five years (Fiscal Years 2022-2026) to upgrade, modernize, and rebuild our nation’s airport terminals; and WHEREAS, the grant is a 95%/5% cost share with the FAA funding 95 percent and the City of Spearfish being responsible for 5 percent; WHEREAS, the entirety of the terminal will not qualify for funding under this grant because certain aspects of a terminal are excluded; and WHEREAS, the full project estimate is $8 million and the City of Spearfish’s anticipated share will be approximately $1 million; and WHEREAS, the application deadline is 5:00 p.m. Eastern time, October 16, 2023.
