Spearfish City Council Regular Session Minutes February 20, 2024 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Tuesday, February 20, 2024. Mayor Senden was present and called the meeting to order. Roll call was taken with the following members present: Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath. Absent: None. Also present: City Attorney McDonald, Finance Officer DeNeui, Public Safety Director Rotert, Public Works Director McMahon, Planning Director Kapsa, Project Engineer Walters, Interim Parks and Recreation Director Rauterkus, City Engineer Mathis, Fire Chief Deaver, and Deputy Fire Chief Ziegler. All stood and recited the pledge of allegiance. Clark moved, Hodgs seconded, to amend the agenda to add item prior to #8 as approve the revised Declaration of Land Use Restrictive Covenants for Sky Ridge Housing. Clark moved, Jacobs seconded, and all approved the amended agenda. No potential conflicts of interest were noted. Public Comment – At 5:31 p.m. a time for public comment was opened and closed with no comments being received. Consent Agenda – Klarenbeek moved, Hourigan seconded, and all voted to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated February 5, 2024. B. Approve the Treasurer’s Report dated January 31, 2024. C. Approve application from the Spearfish Chamber of Commerce for a special malt beverage and on-sale wine license for Taste of Spearfish on April 29, 2024, from 5:00-8:00 p.m. at Tretheway Pavilion. D. Approve an application for Luke Donovan of Spearfish Downtown Business Association for a special on-sale liquor license for Downtown Friday Nights each Friday beginning June 7 through August 2, 2024, and August 23, 2024, from 4:00-11:00 p.m., on Main Street from Jackson Blvd. to Grant Street. E. Approve an application from Tytus Spivey of False Bottom for a special on-sale liquor license for the False Bottom 10 Year Anniversary Party on May 31, 2024, from 4:30-9:30 p.m. on Illinois Street from Main Street to 5th Street. Other Items Land Use Covenants – Clark moved, Hodgs seconded, and all voted to approve the revised Declaration of Land Use Restrictive Covenants for Sky Ridge housing. Staff Engineer – Hodgs moved, Jacobs seconded, and all voted to replace Floodplain Administrator position with Staff Engineer position. Agreement – Klarenbeek moved, Hourigan seconded, and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the agreement with Ketel Thorstenson, LLP for 2023 audit services at an estimated cost of $42,400.
