PUBLIC SAFETY COMMITTEE
MINUTES March 14, 2018
The Legal, Finance and Public Safety Committee met in the Council Chambers of the
Municipal Services Centre at 4:15 PM on Wednesday February 28, 2018 with the
following committee members present: J acobs an d Lee. Kl arenb eek was absent.
Also present were: City Administrato r Harmon, Finance Officer Dutton, City Planner
Watson, City Attorney Davis, Assistant Police Chief Jacobs, Fire Chief Sachara, Police
Lieutenant Dean, Water/Wastewater Utilities Superintendent Glenn, Assistant City Planner
Mayo and Fire Code Official Deaver.
Items from Visitors
Citizen Discussion - Gary Marousek addressed committee regarding several personal concerns
and suggestions.
Proclamation FYI - On Monday, Mayor Boke will proclaim the Month of March as Intellectual
and Developmental Disabilities Awareness Month.
Presentation FYI – The 2017 Spearfish Leadership Class will present their team project to
Council on Monday.
BOE FYI – Spearfish Board of Equalization will meet Monday in the Council Chambers prior to
City Council Regular Session.
Fire
Grants – Committee recommended approval to Full Council to authorize the Fire Department to
apply for the following grants:
• Staffing for Adequate Fire and Emergency Response (SAFER) Grant - for recruitment and
retention of volunteers. Chief Sachara stated this one has no City match requirement and
anticipates up to $35,000.
• Volunteer Fire Assistance (VFA) Program - grant for hand held radios - $7,854.24 total
request to State Forestry, the City match will be up to $3,927.12.
Finance
Grant Request – Committee recommended approval to Full Council to approve request from
Special Olympics South Dakota for $1,000.00 Grant to support the State Summer Games in
Spearfish May 17-19, 2018. The event was initially to be held in Brookings, however it has been
relocated to Spearfish. To be funded from Hospitality Tax Fund.
Raffle – Committee recommended approval to Full Council, Consent Agenda for a raffle.
Spearfish Area Chamber of Commerce plans to raffle a total of $12,500 in cash prizes ($10,000,
$1,500, $1,000 – first, second and third prize). Tickets are $50 each with ticket sales from May 1-
drawing on September 27, 2018. Proceeds to benefit Spearfish Area Chamber of Commerce.
Raffle – Committee recommended approval to Full Council, Consent Agenda for a raffle.
Spearfish Cooperative Preschool plans to raffle a variety of baskets (garden, outdoor grilling,
book, etc…). Tickets are $2 each with ticket sales from March 28-April 13, 2018. This is an
annual raffle with proceeds to benefit Spearfish Cooperative Preschool for supplies and
scholarships.

Spearfish Area Chamber plans to hold 50/50 drawings at after hours Mixers in 2018. Tickets are
$1 each or 6 for $5 with ticket sales only at the event. Dates for 2018 mixers can be found in
meeting packet or on the Chamber website.
Added - Raffle – Committee recommended approval to Full Council, Consent Agenda for a
raffle. South Dakota Backcountry Hunters and Anglers plan to raffle 2 Yeti VIP Packages
(tickets) to Total Archery Challenge June 22-24 at Terry Peak. Tickets are $10 each or three for
$20 with drawing on 5-15-2018.
License Transfer - There will be a public hearing to consider an application from Jenni Tucker
with Level Wine Bar for the transfer for an on-off sale malt beverage and on-off sale wine license
from Bryan Johnson with Level, LLC located at 604 N. Main St. Committee recommended
approval.
License - There will be a public hearing to consider an application from Gregory Stroud with
Apple FSH for the transfer of a retail on-sale liquor license from Todd Schriever with Applebees
located at 301 N. 27th St. Committee recommended approval.
Public Works
Proposal – Committee recommended to Full Council to accept lowest responsive proposal from
A&L Contractors for the hauling of sawdust from McLaughlin Saw Mill to City Rubble Site –
unit price of $4.10/CY for estimated 12,000CY – total estimated proposal including mobilization -
$49,325.00. Four proposals were received.
Airport
Resolution 2018-16 – Committee recommended approval to Full Council to adopt Resolution
2018-06 – Surplus. Airport wishes to surplus obsolete and unused equipment in order to transfer
to another airport.
Planning and Zoning
Ordinance 1273 – Committee recommended approval to Full Council for Second reading of
Ordinance 1273 - an Ordinance amending Chapter 7, Article I, Section 7-3 of The Revised
Ordinances of the City of Spearfish - Sale or discharge of fireworks. There are no changes from
first reading.
Ordinance 1274 – There will be a Public Hearing to consider second reading for Ordinance 1274
– Apply Agriculture Zoning District to 20-acre parcel recently annexed west of Falcon Crest.
There are no changes from First Reading and committee recommends approval.
Conditional Use Permit Ordinances – Committee recommended approval to Full Council for
First Reading and to set public hearing for April 2, 2018 for the following:
• Ordinance 1275 – An amendment to Appendix A Zoning Article II Definitions for Home
Occupation and Office land uses
• Ordinance 1276 – An amendment to Appendix A Zoning Article IV District Regulations
Sections 1a-4 concerning primary permitted uses and conditional use permit uses
• Ordinance 1275 – An amendment to Appendix A Zoning Article VI Administration and
Enforcement Section 3. concerning administration of conditional use permits.
Villages at Creekside – Committee recommended approval to Full Council for final plan and
prelim plat approval is for Lot 2 of Lot 1R Block 3 Della Vecchia Addition at the Villages at
Creekside. City Planner Watson stated this is the first commercial development at the Villages at
Creekside.
There being no further discussion before the committee, the meeting was adjourned at 4:51 PM.
