The Spearfish Planning Commission met in regular session on Tuesday,
February 15, 2022 at 2:00 p.m. in the council chamber of city hall and via Zoom video conference. Vice
Chairman Byrum called the meeting to order at 2:00 p.m. Roll call was taken with the following members
present Meghan Byrum, Greg Kruskamp, Bob Meyer, Larry Vavruska, and Barbara Zwetzig. Absent:
Toby Bordewyk. Also present: City Planner Jayna Watson
APPROVAL OF MINUTES:
Vavruska moved, Kruskamp seconded and all voted to approve the minutes of the January 4, 2022
Planning Commission meeting.
DECLARATIONS OF CONFLICTS OF INTEREST:
Byrum called for any potential conflicts of interest to be identified. No conflicts were expressed.
1. Request: Approve an update to the Elkhorn Ridge DRD Concept plan and change zoning
from Ag (Agriculture) to DRD (Development Review District) on a 14 acre
parcel located approximately 1500 feet west of Colorado Loop

Chris Wehrle representing Elkhorn Ridge Development presented the request to update the
Concept Plan. Watson presented the staff report and provided an assessment of the DRD
approval criteria. Comments of the commission included tax increment district #1 boundaries
related to the 14 acre commercial parcel, and clarification on parcel land uses. Vavruska
moved, Zwetzig seconded and all voted to set a public hearing for March 1, 2022
2. Request: East Colorado Boulevard Corridor Study
Location: Maitland Road to Highway 85
Applicant: City of Spearfish
Action: Discuss and Provide Input
Watson provided an overview of the study background and contents. Commission comments
included verification of the weblink concerning dark sky regulation and provide context that city
owned lands near the airport are for airport related purposes. Watson noted that staff will check
for if this requires a public hearing and advertise if necessary. No action was taken.
3. Request: Elect 2022 Planning Commission Chair and Vice Chair
Vavruska nominated Meghan Byrum for Chair. Zwetzig concurred with
Vavruskas nomination and further nominated Toby Bordewyk for vice chair.
Nominations ceased. Zwetzig moved, Vavruska seconded and all voted to
elect Meghan Byrum to Chair and Toby Bordewyk to Vice Chair for 2022.
4. City Council Update – Watson noted the hiring of a new public works director, Kyle Hinton, who
will start work in March.
5. Public Comment – No comments were provided.
6. Adjournment - Byrum adjourned the meeting at 2:55 p.m.

The Spearfish Planning Commission met in regular session on Tuesday, January
4, 2022 at 3:00 p.m. in the council chamber of city hall and via Zoom video conference. Chairman
Bordewyk called the meeting to order at 3:05 p.m. Roll call was taken with the following members
present: Toby Bordewyk, Meghan Byrum, Greg Kruskamp, Bob Meyer, Larry Vavruska, and Barbara
Zwetzig. Also present: City Planner Jayna Watson and Interim City Administrator Ashley McDonald

Kruskamp moved, Zwetzig seconded and all voted to approve the minutes of the December 21,
2021 Planning Commission meeting.

1. Request: Approve a preliminary plat for a 54 lot subdivision
Location: East of Rainbow Road, North of I-90
Applicant: Interstate Engineering
Action: Hold a public hearing and make a recommendation to City Council
Rick Furnish representing the project ownership presented the request. Watson presented the
staff report and conditions associated with the staff recommendation as published in the report.
Bordewyk opened the public hearing. No testimony was provided. Bordewyk closed the public
hearing. Vavruska moved, Byrum seconded to recommend approval with the conditions
per the staff report. Meyer opened discussion with a prepared statement titled 4-Jan-22
Comments on Rainbow Road Preliminary Plat Request that was entered into the record along
with a suggested modification of the motion as indicated in Meyer’s document. Kyle Mathis,
City Engineer provided an overview of the next steps in the process to use the soils and
Geotech analysis to guide design of the septic/drain fields. Additional discussion included the
following topics: 1) developer and homebuilder’s responsibility for ensuring a licensed engineer
must design and provide final inspection of a new system, 2) coordination between State of
South Dakota DANR’s design requirements and other system requirements dictated by the
soils/geo-tech analysis, 3) assessment of the potential for system failures, 4) total impact of all
systems in the area, 5) failure detection through an inspection program. Staff indicated that they
would approach city council for if an ongoing septic system inspection program is desired. A
roll call vote was taken and the motion passed 4-1 as originally made by Vavruska and
second by Byrum with Meyer voting no.
2. Request: Approve a preliminary plat for Phases 5 and 6 of Elkhorn Ridge
Location: North of Duke Parkway, west of the south section of Brooks Loop
Applicant: Mike Stetson/KTM Design
Action: Hold a public hearing and make a recommendation to City Council
Brandon Foster representing the project ownership presented the request. Watson presented
the staff report and recommendation. Bordewyk opened the public hearing. No testimony was
provided. Bordewyk closed the public hearing. Vavruska moved, Byrum seconded and all
voted to recommend approval.

3. City Council Update – Watson provided an update on the special maintenance fee and the hiring of
the new city administrator, Steve McFarland, to begin work on or sometime after February 1.
4. 2022 Meeting Calendar – For the dates when the Planning Commission meetings have the potential
to run into the public works committee start time, on those dates, the meetings will begin at 2pm.
5. Election of 2022 Planning Commission Chair, Vice Chair – Watson noted that all members are
eligible to serve as chair or vice chair but if anyone does not wish to serve in this capacity, to email or
let her know.

BACKGROUND AND HISTORY:
• Annexed and rezoned in the early 2000’s to Development Review District
• The original DRD concept plan was updated in 2007 which is attached to the staff report.
• Since the 2007 update, the following final plan approvals have been made:
o Golf course, clubhouse, maintenance building and the Miller Creek Pub
o Preliminary plats for residential north of I-90
o Travel center gas station, convenience market, and restaurant
o Elkhorn Ridge Development office building
o Peaceful Pines Senior Living facility and duplex residential
o Storage buildings west of Miller Creek
• Surrounding zoning and development patterns:
o Overall, the master plan is bounded on the North, East and South by County AG-
1 zoning, one lot per 40 acres.
o Southwest is the Sky Ridge affordable housing project also zoned DRD,
Development Review District
o West is the Centennial Mountain Estates property, undeveloped at present, but
proposed to be a mixed use multi-phase development.
• Site data:
o Original Elkhorn Ridge Master Plan – 910 +/- acres
o Parcel to be rezoned from Ag to DRD west of travel center: 14 +/- acres
o The 14 acre parcel will bring the total master plan acreage to 924 acres
o 10 percent open space requirement
▪ 92.4 acres required / provided open space is 362 acres.
REVIEW CRITERIA AND STAFF ANALYSIS:
The Elkhorn Ridge DRD approval is a two-step DRD plan, meaning, the land uses are identified
on the concept plan and a final plan approval is submitted for a later approval and shows
specific detail for site layout, building design, and landscape.
This DRD concept plan update captures the existing approvals noted above as well as the
following to these undeveloped parcels:
1) North end of the Exit 17 interchange - from Future Development to Single Family and Multi
Family residential, and Health Care.
2) Southwest corner of Interstate 90 and Highway 85 – from Retail to Commercial. The
allowed uses as commercial in the DRD are generally those from the C-2 zoning list except
for the list of land uses that are prohibited in the DRD.
3) West of St. Onge Road, and south of Acorn Ridge Road, from Mixed Use
Office/Retail/Residential to Single Family and a 5 acre portion along Acorn Ridge Road as
Multi Family.
4) Southwest corner of Highway 85/St. Onge Road from Office Park to Health Care (Monument
Health 70 acre parcel).
5) Rezones the 14 acre parcel west of the travel center from Agriculture to Commercial.
6) Sky Ridge is shown for context on the revised master plan attached to the staff report,
however it is governed by a separate approval made in 2020.

The change of zoning for the 14 acre parcel from Ag to DRD-Commercial is guided by the City
of Spearfish Revised Code of Ordinances, Article IV., Section 10. Development Review District
Section F.2 a-g. Staff’s analysis follows each statement in italic text.
Concept Plan Approval Criteria. In consideration of a request for Concept Plan approval, the
Planning Commission and City Council shall take into account factors including, but not limited
to:
a. Conformance with the goals and policies of the comprehensive plan; The change of
zoning for this parcel to DRD-Commercial is a logical extension of the existing
commercial zoning to the west and because the property fronts both Colorado Boulevard
and Interstate 90, it has prime exposure for additional sales tax generating land uses.
b. Compatibility with and relationship to existing and potential uses adjacent to the
proposed project; See above.
c. Public safety issues relating to projected traffic generated by the proposed uses and to
the existing or potential transportation system of adjoining properties; Colorado
Boulevard is slated to be widened in the next 5 years across this parcel frontage, which
will add left turn capacity for east bound drivers entering the site.
d. Community benefit of the proposed use(s); Sales tax generating land uses are
important to the overall economic health of the community and with the presence of the
Sky Ridge and Elkhorn Ridge neighborhoods nearby, a location for every-day goods and
services is available within walking distance.
e. Aesthetic considerations related to the scope and size of (the) proposed use(s); The
final plan submittal in the 2nd step of approval will address this issue.
f. Adequacy of public services for the proposed use(s); Within the next 2 years, the
upgrade to the Elkhorn Ridge sewer lift station should be complete and adequate
capacity will be available for this commercial development’s sewer flow.
g. Testimony received from the public at the public hearing. None received as of this
writing.
PUBLIC COMMENTS:
Notice of a public hearing will be published in the newspaper and sent to owners within 140 feet
of the property boundary. The Lawrence County Planning and Zoning director and County
Highway Superintendent will be notified of this request. Also, this request will be advertised in
STAFF RECOMMENDATION: Set a public hearing for March 1, 2022

This work has been guided by a committee who provided input and direction in three separate
work sessions culminating in the completed draft report, attached. Staff will be introducing this
document at the above meeting and its purpose is to serve as a decision making policy for
future requests for development approval in the east Colorado Boulevard corridor. The primary
topics covered in this study are recommendations for:
• Land use and preferred locations for more intense land development within the context
of a City Services Boundary, and what areas are likely to remain more rural
• Water/sewer infrastructure requirements based on recent city investment to upgrade the
Elkhorn Ridge lift station
• Colorado Boulevard upgrade to create a more efficient, safe roadway
No action is requested on February 15, however discussion and input is requested so that
action may be taken at the next meeting on March 1.
Early March – City and County Planning Commission review and recommendation
Mid-March – City and County governing body adoption of the study
Note that the terms used in this document are suggestions for what should happen in the future
growth of this area and are not mandates. Some of the recommendations of the plan require a
follow up effort to adopt a resolution or ordinance to fully implement the concept discussed in

Introduction and Purpose
Ongoing development at Elkhorn Ridge and the recent development of the Sky Ridge
neighborhood and sports complex have resulted in an increase in development interest for the
Colorado Boulevard corridor between Maitland Road and Highway 85. The purpose of this
document is to provide policy guidance as requests for changes in land use are made to either
the City of Spearfish or to Lawrence County.
This Study Will Make Recommendations For:
a) A mix of development types within the context of public utility service, present and future
street network, and trends in residential, commercial, and industrial land uses.
b) Preferred locations for urban/suburban and rural/low intensity land uses.
This Study Will Not:
a) Change the existing zoning or land use rights of any individual property.
b) Replace the traditional process whereby changes in zoning are requested or initiated.
Using historic growth and development trends, the following is a projection of the number of
dwellings and commercial square footage that could be expected within a ten-year planning
horizon within the study area. This timeline has been chosen because it represents the most
accurate forecasting based on recent growth and development trends. Estimates for
development past 2032 are difficult to quantify due to the number of economic variables
involved. For this reason, there must be realistic expectations so that resources can be directed
toward the critical infrastructure both within the Colorado Boulevard corridor as well as the
primary gravity sewer infrastructure west of the study area and the wastewater treatment plant.

The following are the ten-year growth assumptions for the study area, using a straight-line
projection based on Census data:
a. Spearfish growth rate = 16% (from 2010 to 2020)*
b. Current Spearfish population = 12,193*
c. New projected residents 2020-2030 = 1,950
d. People per household = 2.12*
e. New homes 2020-2030 = 300 (assumes 1/3 of all new homes built in the next ten years
will be in the study area)
f. New non-residential land use estimate: 72,000 square feet - retail, food service, light
industrial

Study Area
The study geography includes the area between Maitland Road and Highway 85 and 3/4 mile
north of Interstate 90 and south to Centennial Road as illustrated by the map below. Within this
overall boundary lie undeveloped and sparsely developed areas that are likely to change land
use in the future, depending primarily on the availability of water and sewer infrastructure and
land use compatibility. Areas within the study area where development has taken place (Sky
Ridge, Elkhorn Ridge) require no re-evaluation for future land use but are included in the area
study for context.

Most of the study area is rolling terrain with slopes generally 2% to 10% with locally steeper
areas in drainageways and at the hillside landform north of Exit 17. Floodplain is limited to
Miller Creek toward the east edge of the study area. The primary vegetative cover is prairie
grass with stands of trees along drainageways and shelter belts.
Maitland Road is the highest point at the west edge of the study area and all drainage at this
point flows west toward Spearfish. Two localized drainage low points exist: Miller Creek and at
Rainbow Road extending east and west for ¼ and ½ mile respectively. This topography plays a
major role in how the area is provided with gravity sewer.
Existing Conditions
Land Use and Zoning
Beginning at the intersection of Maitland Road and Colorado and moving eastward, the
following are existing land uses and zoning districts. Except for the Maitland Road Area, the
corridor is mostly undeveloped, open land until the west boundary of the Sky Ridge subdivision.
City Limits - C-2 Highway Service Commercial for ¼ mile east of Maitland Road; storage
buildings, retail and repair businesses, equipment, and automotive dealerships.
Unincorporated County – HSC Highway Service Commercial and Ag-1; office, residences,
barns.
City and County Ag zoning – homes and barns in the Rainbow Road vicinity and east to the
west edge of the Sky Ridge neighborhood.
City Ag zoning north of Interstate 90 and east of Rainbow Road – Ag zoning with recent
preliminary plat approval for a new 54 lot subdivision consisting of one acre lots known as
Centennial Mountain Estates.
City Development Review District Zoning – Sky Ridge single family residential neighborhood
soccer and softball sports complex, storage buildings, and Elkhorn Ridge travel center
(convenience market and gas station).
An avigation easement related to the Spearfish Airport exists in the Colorado Boulevard and
Rainbow Road vicinity. This easement limits building heights based on the applicable conical
surface of the easement and the specific ground elevation for where a building is to be
constructed. Determination of allowable building height requires an assessment performed by a
registered land surveyor.

Public Utilities
In 2003, the City of Spearfish partnered with the developer of Elkhorn Ridge to pay for the
extension of water and sewer infrastructure to serve the needs of that mixed use residential,
commercial, and healthcare development.
A 12 inch water main exists on the south side of Colorado Boulevard and provides adequate
pressure and flow to support the ongoing growth of the area. The source of the water is the

Green Acres tank, owned and operated by the City of Spearfish, and located approximately two
miles southwest of Maitland Road. All of Elkhorn Ridge and Sky Ridge sewer flow is conveyed
by gravity sewer to a city owned and operated lift station just west of Miller Creek. From here,
the flow is pumped uphill in two six-inch force mains west to Maitland Road where it then returns
to a gravity flow condition. Electric, natural gas, and communications serve the area.
Colorado Boulevard
Serving as a major east/west arterial street parallel to I-90, this is a two lane highway with
minimal roadside shoulders. The posted speed limit is 55 mph but changes to 45 mph west of
Maitland Road. With the Sky Ridge development, a traffic study was completed and it
recommended the widening of the highway along the project frontage to construct left-turn lanes
into Sky Ridge. Due to the future westbound volumes modeled in the study, a left turn lane at
Rainbow Road to facilitate access to northbound Rainbow Road was also recommended. The
turning lanes for Sky Ridge are slated for construction within the next 5 years by the City of
Spearfish. It is undetermined when the left turn lane at Rainbow Road will be constructed. No
on-street bicycle lanes exist on Colorado and the city’s trail and path network has yet to reach
this area of the community.
Land Use Recommendations
The primary consideration for if land in the Colorado corridor is developed as low intensity rural
uses or city residential and commercial uses depends on the availability of water and sewer
infrastructure. The City of Spearfish has designated the areas immediately south of Colorado
Boulevard as the preferred location for where annexation and intensification of land use should
occur because of the public services available. In late 2021, the City of Spearfish committed to
add capacity to the Elkhorn Ridge lift station upgrade, thus securing future sewer services for
the growth of this area.
The land use recommendations are divided into what is a preferred scenario for property
annexed to the city for more intense land use, and property that will remain more rural in
character according to county zoning. The division between these city/county land uses is the
City Services Boundary (see map on page 9 for location). Areas north of the boundary
represents the best opportunity for cohesive and well-connected land use and infrastructure.
Unless it is part of a plan of development within the boundary, property outside of the boundary
should be reviewed for if it: 1) can be reasonably and feasibly served by all city services, 2)
initiates a pattern of development in a direction inconsistent with the vision of infill growth of this
area.
Land Use– Annexations to City of Spearfish and Changes of Zoning
The following are key strategies for areas within the City Services Boundary where annexation
and change of zoning is requested. The overall goal for this land area is to maximize the
development opportunities versus the preservation of rural/ag lands.
1. A mix of land uses are envisioned to include a range of residential densities,
commercial, and light industrial uses.
2. Residential densities and lot sizes that support affordable housing and are encouraged.

3. The timing of annexation/rezoning requests should be when the owner has a specific
plan of development that will enable the city to understand the benefits of the project as
well as the impacts of the project on city infrastructure.
4. Where more intense land uses are abutting/adjoining land uses of lesser intensity, an
appropriate transition to achieve land use compatibility should be provided. Examples:
a. Larger lot sizes at the perimeter of an area unlikely to be developed at an
urban/suburban density.
b. Increased setbacks above ordinance requirements, vegetational buffers, fences,
berms.
c. Commercial development along Colorado Boulevard should occur in clusters where
there is the ability to share access and for efficient traffic control.
Visual quality is an important factor in growth management. The following are strategies to
guide and direct this aspect of community development, and it is primarily related to multi-family
and commercial/industrial structures:
1. Architectural creativity in non-residential structures should include variations in overall
design style, roof forms, exterior finishes, and building color.
2. To create a unified and finished look, site frontages should be landscaped and include a
variety of trees and shrubs with an overall preference for drought resistant types.
3. The outdoor display of equipment and vehicles should be provided within a setting that
incorporates plant material, changes in landform, boulders, decorative walls/fences, and
similar landscape architectural features that complement the display.
4. All outdoor lighting and illuminated signage should meet the criteria as established by
the International Dark Sky Association, www.ida.org
Land Use – Development under Lawrence County zoning authority
1. For areas outside of the City Services Boundary, Rural Residential, Park Forest and A-2
Residential Agriculture zoning districts should serve as a land use buffer between the
more urban forms of development within city limits and the lower density A-1 General
Agriculture district.
2. City of Spearfish will review and provide comment on conditional use permit requests
within the study boundary.
3. Requests for development approval involving mixed land uses and/or development
intensity greater than what the Rural Residential zoning allows are encouraged to be
submitted as Planned Unit Development.
Spearfish Airport Land Use Compatibility
The approach to the Spearfish Airport is immediately northwest of the Rainbow Road and
Interstate 90. Land uses in this vicinity should be evaluated for future compatibility with air
traffic with commercial land uses being preferred over residential land uses.

Water / Sewer Infrastructure Recommendations
Water
The present water delivery system can support growth and development for the next several
years and a new well and water storage reservoir is included in the City’s capital improvement
program to be designed within the next two years. This will be the primary water supply to the
area with additional support from the system feeding from the Green Acres tank. The following
are key criteria to guide decisions involving water services in addition to standard city
ordinances.
1. Where technically necessary, new water mains should be looped to connect to existing
water mains to increase pressure and flow. If no point of connection exists, mains
should be stubbed out for future connection.
2. Requests to provide water service outside of city limits should consider the number of
users served, the potential for expansion of the system beyond the property requesting
service, and the cost/benefit of the service.
3. The city may elect to pay for the upsizing of water mains to serve future development.
Sewer
A key consideration for future growth is the capacity of the Elkhorn Ridge sewer lift station and
force main system. An upgrade to this system will take place during 2022-2023 to add more
sewer capacity to the area since the current system is nearing capacity now. The city’s costs
for this added capacity will enable up to 854 gallons per minute (GPM) of sewer flow from the
presently undeveloped area within the City Services Boundary. Of this total, 419 GPM is
allocated to the areas south of Colorado Boulevard and the remainder is allocated to the
Centennial Mountain Estates development. The following are the key considerations to guide
the development of the gravity sewer infrastructure expansion that will link to the newly
upgraded lift station:
1. The costs of gravity sewer infrastructure connecting to the Elkhorn Ridge lift station are
the responsibility of the property developer and should be constructed at the time the
property is developed with structures or other infrastructure that will be municipally
owned.
2. A one-time charge based on sewer flows directed to the lift station should be
implemented at the time of annexation and simultaneous change of zoning to reimburse
the city investment for the lift station upgrade.
3. Once allocated and paid for, sewer capacity should be permitted to be traded or sold
between private parties, and the city should develop a method to track these exchanges.
4. A special tap fee should be considered by City Council for users connecting to the
Elkhorn Ridge lift station. This special rate is justified by the additional resources and
costs required in lift station operation that gravity sewer does not require.
5. Gravity flow is possible for the following locations and could support land use patterns
that are more urban/suburban in character:
a. East side of, and immediately adjacent to Maitland Road, and south of Colorado
Boulevard.
b. ¼ mile east of Rainbow Road to the west boundary of the Sky Ridge neighborhood.
c. Portions of the Centennial Mountain Estates property north of I-90 and east of
Rainbow Road.

6. Areas where gravity flow is not possible is from a point roughly 600 feet east of Maitland
Road to ¼ mile east of Rainbow Road and roughly ¼ mile north of I-90 east of Rainbow
road. These areas are more likely to be more rural in character for the near term unless
alternate methods for wastewater treatment are provided.
7. Requests to provide sewer service outside of city limits should consider the number of
users served, the potential for expansion of the system beyond the property requesting
service, and the cost/benefit of the service.
8. The city may elect to pay for the upsizing of sewer mains to serve future development.

Colorado Boulevard Recommendations
Colorado Boulevard will require upgrading from its present condition to a configuration as
recommended by traffic analysis and final engineering design as guided by the Spearfish Area
Master Transportation Plan (MTP). For property fronting Colorado Boulevard, the following
should be evaluated at the time of a request for annexation/change of zoning to City of
Spearfish, or at the time of a request for preliminary plat approval for parcels that are not
annexed but within the 3-mile extra territory for subdivision approval.
1. A traffic study should be provided according to the criteria of the MTP VI.B of the plan,
and for projects generating 100 trips at the morning or evening peak hour. The purpose
of the traffic study is to determine:
a. Levels of service for new streets connecting into Colorado Boulevard, and the
appropriate traffic control methods.
b. Spacing of intersections and driveway access points.
c. Need for dedicated left and right turning lanes.
d. Potential for widening of Colorado Boulevard.
2. Right-of-way for Colorado Boulevard should be dedicated at the time of final plat
approval.
3. Collector level streets shown on the Major Streets Plan of the MTP should be
incorporated into property development plans
The City of Spearfish has tentative plans to widen Colorado Boulevard within the next 5 years
along the Sky Ridge frontage. Although design has not started, a possible cross section for a
two lane arterial per the MTP in Section VI.C, Figure 16 of the plan, is shown below.
In addition to city funding sources and grants, property owners should also participate in costs
of the upgrade if their development approval results in new traffic added to the roadway. The
following are potential options to be explored:

a. Cost sharing agreements created at the time of development approval, based on a
proportional amount of new traffic generated by the individual development
compared to the overall volume on Colorado Boulevard.
b. Recovery of costs through special assessments and based on a proportional amount
of new traffic generated by the individual development compared to the overall
volume on Colorado Boulevard.
Paths/Trails
The MTP Illustrates a multi-use path along the Colorado Boulevard corridor and along Maitland
Road, as shown on the next page. This path will provide an important link for pedestrians and
recreational bike travel from the study area to the remaining portions of the Spearfish
recreational path system. The City of Spearfish should conduct a feasibility analysis to
determine the best location for the path prior to incorporating recommendations for specific
development proposals.

Conclusion and Summary
The area within the study area is envisioned to develop with a mix of land uses where public
infrastructure is available to serve it. Where public infrastructure is not available, options for
rural development and agricultural preservation remain. Orderly growth and development
depend upon clear criteria to guide and direct this growth. The recommendations of this plan
serve as a guide so that decision making is based on an informed set of parameters, rather than
on an ad-hoc basis and without an overall vision.
