Amended 12/21/2023 Spearfish Planning Commission Regular Session Minutes December 5th, 2023 at 3:00 p.m. The Spearfish Planning Commission met in regular session on Tuesday, December 5th at 3:00 p.m. in the council chamber of city hall and via Zoom video conference. Greg Kruskamp chaired, and the meeting was called to order at 3:08 p.m. Roll call was taken with the following members present: Meghan Byrum, Greg Kruskamp, Larry Vavruska, Amy Davison, and Dylan Wilde. Also present: Marlo Kapsa, Planning Director, John Senden, Major, Jaymia Ecker, Assistant Planning Director, and Sierra Ferguson, Black Hills Pioneer Newspaper. APPROVAL OF MINUTES: Vavruska moved, Wilde seconded, and all voted to approve the minutes of the November 21st, 2023 Planning Commission meeting. APPROVAL OF AGENDA: Wilde moved, Vavruska seconded, and all voted to approve the agenda of the meeting as presented. DECLARATIONS OF CONFLICTS OF INTEREST: Kruskamp called for any potential conflicts of interest to be identified. None were identified. ITEMS FOR ACTION 1. Request: Approve a Preliminary Plat for Lots 4 thru 11 and Dedicated Right-of-way of Block 1 of False Bottom Addition Location: Approximately ½ mile east of the Colorado Boulevard/27th Street intersection Applicant: Thevery, LLC Action: Hold a public hearing and make a recommendation to City Council Kapsa provided details on the preliminary plat and confirmed that it complies with all city standards. Staff recommended approval with stipulations detailed in the staff report. Tysdal Kruskamp inquired about plans for future rec path expansion and bike lines which include rec path north of Colorado Blvd and on street bike lanes on future collector roads. Kruskamp opened the public hearing. No comments were made, and the hearing was closed. Wilde moved, Vavruska seconded and all voted to approve the preliminary plat. The plat will go before City Council for consideration and a public hearing at the December 18th meeting. 2. Request: Approve a Sketch Plat for Centennial Vista Lots 7A and 8A of Centennial Vista Location: Centennial Vista Subdivision South of Pendo Road Applicant: Tim Legel (owner) Action: Approve the Sketch Plat with Stipulations Kapsa provided details on the sketch plat involving a lot line revision between two property owners and confirmed that it complies with all city standards. Staff recommended approval. Vavruska moved, Davison seconded, and all voted to approve the sketch plat. ITEMS FOR DISCUSSION Comprehensive Plan Update The next advisory group meeting is scheduled on December 12th. The agenda will include reviewing the draft housing existing conditions memo and proposed content for the vision statement. Highway 85 Corridor Study Kapsa noted that the Study Advisory Team had met the prior week and that the next public engagement opportunity for this project had been scheduled for February 27, 2024. Short Term Rental The application for the short-term rental task force is now closed. Staff will review applications and aim to have the task force in place by January. CITY COUNCIL UPDATE Kapsa stated that the first reading of the ordinance revision for rezone of building at sawmill property was approved at the last council meeting. PUBLIC COMMENT Vavruska announced that he will fulfil his term for this year but does not intend to serve on the commission in 2024. He has served as a planning commission member for 32 years. ADJOURNMENT The meeting was adjourned at 3:26 PM.

Greg Kruskamp chaired, and the meeting was called to order at 3:00 p.m. Roll call was taken with the following members present: Rick Tysdal, Meghan Byrum, Greg Kruskamp, Larry Vavruska, and Dylan Wilde. Also present: Marlo Kapsa, Planning Director, Ashley McDonald, City Attorney, Jaymia Ecker, Assistant Planning Director. APPROVAL OF MINUTES: Wilde moved, Tysdal seconded, and all voted to approve the minutes of the November 7th, 2023 Planning Commission meeting. APPROVAL OF AGENDA: Item number 2 was removed from the agenda at the request of the applicant. Tysdal moved, Byrum seconded, and all voted to approve the agenda of the meeting as amended. Request: Approve a Final Plat for the combination of Lots 8 & 9 of The Meadows of Higgins Gulch Subdivision Location: Southwest of the intersection of Hillsview Road and Higgins Gulch Road; Within 3-Mile Extraterritorial Jurisdiction Area Applicant: Jared Lukens Black Action: Recommendation to City Council The applicant was present and stated their intention to combine the two lots. Kapsa provided details on the request and confirmed that it complies with all county and city standards concluding that staff recommended approval. Tysdal moved, Byrum seconded and all voted to approve. The Final Plat will go before City Council for consideration and a public hearing at the December 5th meeting. PUBLIC COMMENT Community members Wayne Miller and Isaiah Miller shared their concerns over the request to rezone the property at 211 N Main St from C3 to C2. Page 1 Spearfish Planning Commission Staff Report Meeting Date: December 5, 2023 at 3:00 p.m. General Comments: The proposed preliminary plat is a major subdivision within Spearfish City Limits.This plat would subdivide the existing 10.039-acre property into eight lots to be known as Lots 4 thru 11 of Block 1 of False Bottom Addition. The proposed lots range in size from 0.47 to 3.9 acres each. Construction of new street sections would be required for proposed Nedifi Court and Aspen Drive. The proposed plat meets all minimum zoning and subdivision regulations with the noted stipulations at the end of the report. Staff Review: Zoning: The property is currently zoned C2 Highway Service Commercial. All of the proposed lots meet the minimum criteria of lot size and density requirements set forth within the C2 Highway Service Commercial District regulations. There on no existing structures on the property. Utilities: A 5’ wide utility easement will be dedicated along the interior of all the proposed lot lines of the plat. Existing easements include Northwestern Bell Telephone Company, Black Hills Power and Light Company, WBI Energy. Access: Primary access to the existing property is provided via Colorado Boulevard, which is classified as an arterial in the City’s Master Transportation Plan. The minimum 100-foot right-of- way has been dedication adjacent to the subject property. Access to lots 4-7 and 9-11 will be provided via Nedifi Court which will need to be constructed to minimum City Standards as a requirement of this plat. In addition, the plat includes a new east/west road, proposed to be known as Aspen Drive, a future collector street which requires a minimum 66-foot wide right-of-way. Aspen Drive will serve as the primary access to Lot 8. Floodplain: The property is not subject to any special flood zone hazard areas. Platting Process: Following approval, the preliminary plat by the Planning Commission, the plat will go before the City Council for a public hearing and approval. All infrastructure must be constructed and all noted stipulations must be addressed prior to application for final platting. Summary: The proposed plat generally complies with all applicable Zoning and Subdivision Regulations. Staff would recommend approval with the following stipulations: 1. Prior to submittal of the Final Plat, the existing waterline easement water line easement shall be vacated and a new 20-foot-wide waterline easement (10 feet on either side of the waterline) that encompasses the existing waterline. 2. Prior to submittal of the Final Plat, the proposed road names shall be approved by the Lawrence County 911 Coordinator. 3. Prior to submittal of the Final Plat, mailbox location shall be approved by the USPS. If a cluster mailbox is required, the plat document shall be revised to include an easement for the cluster mailbox. Proposal Summary: The sketch plat involves a lot line revision between two parcels developed with single family residential homes in the Centennial Vista subdivision. The resulting parcels will be approximately the same area as they exist today at 3.77 and 3.36 acres to be known as lot 8A and lot 7A respectively. Page 1 Spearfish Planning Commission Staff Report Meeting Date: December 5, 2023 at 3:00 p.m. General Comments: The proposed plat is a minor plat is outside of city limits within the 3-mile platting jurisdiction. The two subject parcels are currently developed with single family residential homes. The proposed plat adjusts the shared boundary between the two lots in line with the topography of the area. Staff recommend approval of the preliminary plat. Staff Review: Zoning: The subject properties are zoned Park Forest District (Lawrence County zoning). The proposed lots meet all minimum zoning district requirements. Utilities: The existing septic system components meet minimum DANR setback requirements from the revised lot lines. Access: The subject properties are in the Centennial Vista subdivision with access off Welcome Way and Fern View Road. The lot line adjustment will not change access to either property. Required right-of-way has already been dedicated for both roads. Platting Process: Following approval of the Sketch Plat by Planning Commission, the applicant may submit a Final Plat for review by the Planning Commission and for final approval with a Public Hearing by City Council. Summary: The proposed sketch plat generally complies with all applicable Zoning and Subdivision Regulations. As such, staff would recommend approval of the proposed Sketch Plat with the following stipulation. 1. Prior to submittal of the Final Plat, the plat document shall be revised to include an additional signature block for the owners of proposed Lot 8A.
