Spearfish Planning Commission Regular Session Minutes October 15st, 2024 at 4:00 p.m. The Spearfish Planning Commission met in regular session on Tuesday, October 15st, 2024 in the Council Chamber of City Hall and via Zoom video conference. Meghan Byrum, vice chairperson, called the meeting to order at 4:02 p.m. Roll call was taken with the following members present: Rick Tysdal, Dylan Wilde, Toby Bordewyk, Amy Davison, and Meghan Byrum. Also present: Jaymia Ecker, Assistant Planning Director, Kevin Koelbel, Planning Director, David Knox, City Attorney, and John Senden, Mayor. APPROVAL OF AGENDA Davison moved to approve the agenda as presented, Tysdal seconded, and all voted in favor of the motion. APPROVAL OF MINUTES: Wilde moved to approve the minutes of the October 1st, 2024 Planning Commission meeting as presented, Davison seconded, and all voted in favor of the motion. DECLARATIONS OF CONFLICTS OF INTEREST: Byrum called for any potential conflicts of interest to be identified. No conflicts were identified. ITEMS FOR ACTION: 1. Request: Approve a sketch plat of Tract 13 of the Lookout Mountain Subdivision Location: Lookout Vista Road.; Within the Extraterritorial Jurisdiction Applicant: Harlan Schmidt Action: Approve the sketch plat Ecker summarized the staff report of the request recommending approval. Tysdal moved to approve the request, Davison seconded the motion, and all voted in favor of the motion. 2. Request: Approve a sketch plat of Tracts 1 and 2 of the Bender Subdivision Location: West of Lookout Mountain Road.; Within the Extraterritorial Jurisdiction Applicant: Marjorie Bender Action: Approve the Sketch Plat Ecker summarized the staff report noting that access was authorized by Lawrence County Commission at the October 8th County Commission Meeting. Generally, the plat meets applicable subdivision requirements and staff recommended approval. Davison moved to approve the request, Bordewyk seconded the motion, and all voted in favor of the motion. 4. Items for Discussion i. Koelbel stated that the short term rental survey results would be going before City Council at the October 16th meeting. ii. The Comprehensive Plan has not yet been finalized and any comments or suggested edits are welcomed. Commissioners shared their interest in further discussion around the Future Land Use Map. 5. Public Comment – no comments were made ADJOURNMENT: Meeting was adjourned at 4:23 p.m.

Spearfish Planning Commission Regular Session Minutes October 1st, 2024 at 4:00 p.m. The Spearfish Planning Commission met in regular session on Tuesday, October 1st, 2024 in the Council Chamber of City Hall and via Zoom video conference. Greg Kruskamp called the meeting to order at 4:03 p.m. Roll call was taken with the following members present: Greg Kruskamp, Rick Tysdal, Dylan Wilde, Toby Bordewyk, Amy Davison, and Meghan Byrum. Also present: Jaymia Ecker, Assistant Planning Director, and John Senden, Mayor. APPROVAL OF AGENDA The applicant of item number 2 on the agenda was corrected to “Marjorie Bender”. Tysdal moved, Davison seconded, and all voted to approve the agenda as amended. APPROVAL OF MINUTES: Wilde moved, Tysdal seconded, and all voted to approve the minutes of the September 17th, 2024, Planning Commission meeting. Request: Approve the Final Plan for Sundance Bank in The Village at Creekside Development Review District (DRD) Location: Lot 8 of Lot 1R of Blk 3 of Della Vecchia Addition to the City of Spearfish; otherwise known as The Village at Creekside Applicant: Williams & Associates on behalf of Sundance Bank Action: Hold a public hearing and approve the Final Plan Jason Roberdeau of Williams and Associates presented an overview of the development plans for Sundance Bank. Ecker followed up summarizing the staff report and recommending approval of the final plan. A public hearing was opened at 4:12 p.m. With no public comments, the hearing was promptly closed. Wilde moved to approve the request, Tysdal seconded the motion, and all voted in favor of the motion. 2. Request: Approve a sketch plat of Tracts 1 and 2 of the Bender Subdivision Location: West of Lookout Mountain Road.; Within the Extraterritorial Jurisdiction Applicant: Marjorie Bender Action: Approve the Sketch Plat Ecker summarized the staff report noting that access to the tracts will be reviewed by Lawrence County Commission at an upcoming meeting. Generally, the plat meets applicable subdivision requirements and staff recommended approval. Tysdal moved to approve the request, Bordewyk seconded the motion, and all voted in favor of the motion. 4. Public Comment a. Les Turgeon provided public comment on the court’s decision in a legal case related to Thoen Stone Road. 5. Items for Discussion a. Draft Comprehensive Plan will be reviewed at the October 2nd City Council Study Session meeting starting at 4:15 PM in the Council Chambers at City Hall. i. The property is currently developed with a single-family residence. Staff Review Zoning: The parcel is zoned RR – Rural Residential District (Lawrence County zoning designation). The minimum lot size for this district is 2 acres with a 5-acre average; The proposed plat meets the density/minimum lot size requirement. Utilities: The extraterritorial subdivision regulations allow private or shared water and sewer services for residential lots 2 acres and larger. The existing residence is served by a shared, private water system and septic. Access: The existing Lookout Vista Road provides access to the tracts and is build within a 66’ private road right of way previously dedicated in 2001. Lookout Vista Road is accessible by way of Lookout Mountain Road. Platting Process: Following sketch plat approval, the final plat may be submitted for review. The final plat will go before the Planning Commission for consideration and then to City Council for final approval with a public hearing. The sketch plat was approved at the October 1st Planning Commission Meeting. The final plat includes the dedication of public right-of-way adjacent to Lookout Mountain Road. Property is currently developed with a single-family residence, garage, and an outbuilding which will remain on Tract 1. The owner intends to build a single-family residence on Tract 2. Staff Review Zoning: The parcel is zoned RR – Rural Residential District (Lawrence County zoning designation). The minimum lot size for this district is 2 acres with a 5-acre average; The proposed plat meets the density/minimum lot size requirement. Utilities: The extraterritorial subdivision regulations allow private or shared water and sewer services for residential lots 2 acres and larger. The existing residence is served by a private well and septic. The subdivider is proposing the same for the new lot. Access: Lookout Mountain Road provides access to both tracts and is designated as a major arterial in the Master Transportation Plan. The required 50’ of right of way is dedicated as part of this subdivision. The Lawrence County Commission authorized the Highway Superintendent to sign the plat as presented with direct access to Tract 2 from Lookout Mountain Road at the October 8th County Commission meeting. Platting Process: If the final plat is approved by the Planning Commission, the plat will go before City Council for approval with a public hearing.
