City of Spearfish Combined Committee Minutes November 10, 2020 4:15 p.m. A combined committee met at 4:15 p.m. in the Council Chambers of City Hall on Tuesday, November 10, 2020 with the following members present: Clark, Herrmann, Hodgs, Klarenbeek and Jacobs. Absent: Eisenbraun. Also present were: City Administrator Harmon, Public Works Director Lee, Human Resource Director Mathis, City Planner Watson, Parks and Recreation Director Ehnes, Public Safety Director Rotert, Police Chief Jacobs, Fire Chief Ladson, Public Works Administrative Assistant Hoffman, City Attorney McDonald and Finance Officer DeNeui. City Administrator COVID-19 – City Administrator Harmon informed the committee members of a recent meeting between City Staff, Monument Health, and the Spearfish School District regarding COVID-19 cases. A result of that meeting is a promotional campaign entitled “Mask-up Spearfish” that will begin soon and include radio, printed mailings, posters and social media postings. Harmon recommended that community events and gatherings in city facilities should be limited to those that can comply with CDC recommendations going forward; any previously scheduled and approved events may continue to proceed with caution. Council member Hodgs agreed with the media campaign. Council member Herrmann noted the City should take a more aggressive position to help businesses enforce masks. Herrmann noted the impact to the Spearfish School District hasn’t just been with students but the ability to provide staffing and hospitals are at maximum capacity. He would consider cancelling the Holidazzle Light Parade and not allowing events to be held at the pavilion. Council member Clark noted that previously scheduled events should be allowed. Clark noted the Holidazzle Light Parade is an outdoor function but the gathering of people to decorate the floats could be a source of spreading the virus. Council member Klarenbeek noted the proposed community testing could bring light to actual case numbers in the area and recommended that decisions on holding events or not should be made after testing results are known. Harmon will have staff reach out to Spearfish Downtown Business Association regarding the Holidazzle Light Parade to invite them to the council meeting on Monday, November 16, 2020 to provide their input on the discussion of holding the event. Committee forwarded the item to full council, with no recommendation, for further discussion. City Attorney Resolution 2020-32 – Committee forwarded to full council, with no recommendation, to adopt Resolution 2020-32 – A Resolution Adopting a Discretionary Formula for Reduced Taxation. Klarenbeek requested staff to contact the Spearfish School District and Lawrence County to obtain their input on the proposed resolution. Finance Resolution 2020-34 – Committee forwarded to full council, with no recommendation, to adopt Resolution 2020-34 - A Resolution to Set Fees Charged by the City. The fee changes proposed would amend or add cemetery fees, solid waste fees, planning & zoning fees, nuisance abatement fees and water fees. Supplements – Committee forwarded to full council, with no recommendation, to approve the listing of supplements for grant proceeds and insurance recoveries. A final listing will be provided in the council packet. Human Resources Volunteer – Committee forwarded to full council, consent agenda with no recommendation, to add Frank Night Pipe to the library volunteer list. Move – Committee forwarded to full council, consent agenda with no recommendation, to move Kayla Chyba to recreation and campground coordinator, grade 14, step 5, $20.07 per hour, effective 11/15/2020. Promotion – Committee forwarded to full council, consent agenda with no recommendation, to promote Justin Woodroof to water/wastewater utility operator class III, grade 14, step 11, $22.61 per hour, effective 11/1/2020. Justin has successfully passed all state certifications required to be a class III operator. Parks and Recreation Final Project – Committee forwarded to full council, with no recommendation, to approve the final under/over Change Order 1 for the 2020 Weed Control Project with TruGreen Chemlawn for an increase of $45.10 (+.1%) bringing the total cost to $37,020.10; original contract was $36,975.00. Committee also forwarded the authorization for Mayor Boke to sign the Certificate of Final Completion with an acceptance date of November 16, 2020 to full council with no recommendation. Planning & Zoning Ordinance 1336 – Committee forwarded to full council, with no recommendation, to approve the second reading of Ordinance 1336 – An Ordinance Amending Appendix A. Zoning, Article V. Supplementary Regulations, Section 7. Nonconforming Uses. A public hearing will also be held on November 16, 2020 on this ordinance. Agreement – Committee forwarded to full council, with no recommendation, to approve an encroachment agreement with Nathan Hoogshagen for a sign on City owned property during the month of December. Public Works Surplus Bid – Committee forwarded, with no recommendation, to accept a sealed surplus bid for the Nautilus Smith Weight Machine. Resolution 2020-33 – Committee forwarded, with no recommendation to adopt Resolution 2020- 33 – A Resolution of Intent to Renew the Restricted Use Site Permit. Other Items – Committee forwarded the following additional items to council with no recommendation:  Renewal of the 2021 liquor and wine licenses in Spearfish.  Request to initiate an amendment to the zoning ordinance to enable photovoltaic (solar) energy production as a primary land use in Ag zoning.  Hire Interstate Engineering for CIPP design and bid process at a cost of $27,500, an unbudgeted item. Public Comment – Public comment section was opened at 4:40 p.m. and closed with no comments received. No additional discussions were held and the meeting was adjourned at 4:41 p.m.
