2. Text Amendment # TA-22-001 (Initiated by Town of Spencer)
TEXT AMENDMENT:
TA-22-001 (Temporary Signage)
Petitioner: Town of Spencer Planning, Zoning, & Subdivision Administrator
PROPOSED AMENDMENT: WHEREAS, Pursuant to Article 5 of the Spencer
Development Ordinance (SDO), the Town of Spencer Planning, Zoning, & Subdivision
Administrator has initiated the process to amend the Spencer Development Ordinance
(SDO) – Article 17 (Sign Regulations) – Sub-Section 17.6(P) for the purpose of revising
the Town’s regulation of exempt temporary signage. Specifically, adoption of TA-22-001
would establish that any exempt temporary sign in Spencer cannot exceed a maximum size
of four (4) square feet in residential districts or six (6) square feet in all other zoning
districts. Additionally, such exempt temporary signs could only be placed for a period not
to exceed sixty (60) days prior to, and including, any federal, state, or local Election Day,
except as otherwise provided.
3. Text Amendment # TA-22-002 (Initiated by Town of Spencer)
TEXT AMENDMENT:
TA-22-002 (Decriminalization of Violations)
Petitioner: Town of Spencer Planning, Zoning, & Subdivision Administrator
PROPOSED AMENDMENT: WHEREAS, Pursuant to Article 5 of the Spencer
Development Ordinance (SDO), the Town of Spencer Planning, Zoning, & Subdivision
Administrator has initiated the process to amend the Spencer Development Ordinance
(SDO) to be in compliance with N.C. Session Law 2021-138. Specifically, on September
2, 2021, the Governor and General Assembly of the State of North Carolina set into law
S.L. 2021-138, amending G.S. 160D to decriminalize violations except in certain instances.
The law effectively removes criminal penalties form numerous provisions of local
authority. No ordinance adopted under G.S. 160D, which includes all local planning and
development regulation in the State of North Carolina, may impose a criminal penalty. The
proposed Text Amendment # TA-22-002 is therefore necessary to bring the Town of
Spencer into compliance with state law.
4. Election of Officers
