City of Spring Hill, Kansas Minutes of City Council Regular Session April 14, 2022 A Regular Session of the City Council was held in the Spring Hill Civic Center, 401 N. Madison, Council Chambers, Spring Hill, Kansas on April 14, 2022. The meeting convened at 7:00 p.m. with Mayor Berkey presiding and Ashley Wood, Deputy City Clerk, recording. Councilmembers in attendance: Brian Peel Chad Young Wendy North Chip VanHouden Councilmembers absent: Diana Roth Staff in attendance: Patrick Burton, Interim City Administrator Lou Ann Armstrong, Finance Director Cindy Henson, Chief of Police Jackie Messer, Director of Public Works Monakisha Jones, Human Resources Director Consultants in attendance: F. Charles Dunlay, City Attorney Dan Miller, City Engineer INVOCATION The invocation was given by Councilman VanHouden. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ROLL CALL The Deputy City Clerk called the roll of the City Council. With a quorum present, the meeting commenced. APPROVAL OF THE AGENDA The Mayor requested to remove items 10 and 11 from the formal agenda and addition of an executive session. Motion by Peel, seconded by Young, to approve the agenda as amended. Motion carried 4-0-0. PRESENTATION Larry Sumner and Christine Hecke presented the Cemetery Board Report. Spring Hill City Council Regular Session Minutes April 14, 2022 Page 1 of 3 CITIZEN PARTICIPATION Katie Madl, 20260 W. Sycamore Dr., spoke about the allowance of chickens in Spring Hill, a petition signed for allowance of chickens and provided (for council review) Overland Park’s Resolution for Keeping of Chickens. Brett Holle, 21093 Millridge St., spoke about Spring Hill’s tow ordinance and his request for a tow dispute. Lori McLauglin with Towner Communications, 5154 Roundtree St., Shawnee, KS, spoke regarding the City’s phone system, Towner Communications previous RFP and provided an updated quote for services to the City. CONSENT AGENDA 1. Approval of Minutes: March 26, 2022, Regular Meeting 2. Consider Approval of Agreement: Swim Lessons, YMCA 3. Consider Approval of Massage Establishment License: Soul Serenity Therapy, 516 N. Webster St., Spring Hill, KS 4. Consider Approval of Easements Dedications: Permanent Drainage Easements (2), Permanent Sanitary Sewer Easement (1), Permanent Sidewalk Easement (1), Boulder Springs, 3rd Plat, Phases IV and V 5. Consider Approval of Improvement Agreement: Cummins Property, Fifth Plat, 185th Ter and Webster St., Store What?, LLC 6. Consider Approval of Final Plat (PLAT-000002-2022): Cummins Property, Fifth Plat, 185th Ter and Webster St., Store What?, LLC 7. Consider Approval of Site Plan (SP-000003-2022): 185th Terr and Webster St., Mitchell RV Storage East Motion by Young, seconded by North, to approve the consent agenda. Motion carried 4-0-0. FORMAL COUNCIL ACTION 8. Consider Approval of Appropriation Order No. 2022-04-14 Motion by Young, seconded by Peel, to approve Appropriation Order No. 2022-04-14. Motion carried by 4-0-0. 9. Consider Approval of Vacation and Release of Easement: Vacation Easement, Oak Woods, Second Plat, Lot 1 Motion by VanHouden, seconded by Young, to approve the partial vacation, authorize Mayor Joe Berkey and Glenda Gerrity, City Clerk to execute the Vacation and Release of Easement, and direct staff to file same with the Miami County Register of Deeds. Motion carried by 4-0-0. 10. Consider Acceptance of Annexation Petition (A-000004-2022): Andrew DeBoef (20200 Woodland Rd. REMOVED FROM AGENDA 11. Consider Approval of Annexation (A-000004-2022) Ordinance No. 2022-XX: Andrew DeBoef (20200 Woodland Rd.) REMOVED FROM AGENDA Spring Hill City Council Regular Session Minutes April 14, 2022 Page 2 of 3 ANNOUNCEMENTS and REPORTS Announcements and reports were given by the City Council staff and city attorney. EXECUTIVE SESSION – ATTORNEY CLIENT EXECEPTION Motion by Peel, seconded by Young, to recess into Executive Session for 25 minutes to receive advice of counsel regarding ongoing litigation pursuant to the attorney-client privilege exception of K.S.A. 75- 4319(b)(2) of the Kansas Open Meetings Act. The open meeting will resume in the City Council Chambers at 8:10 p.m. Persons to be in attendance are the following: F. Charles Dunlay, City Attorney, Patrick Burton, Interim City Administrator and Patrick D. Murphy, Rasmussen Dickey Moore, Assigned Counsel. Motion carried 4-0-0. The meeting recessed at 7:45 p.m. The meeting reconvened at 8:10 p.m. with everyone present. Mayor Berkey announced that no votes were taken, or decisions made during the executive session. The discussion was limited to the subject stated. EXECUTIVE SESSION – ATTORNEY CLIENT EXECEPTION Mayor Berkey announced there was no need for the additional executive session. ADJOURN Motion by Peel, seconded by Young, to adjourn. Motion carried 4-0-0.
