City of Spring Hill, Kansas Minutes of City Council Regular Session January 12, 2023 A Regular Session of the City Council was held in the Spring Hill Civic Center, 401 N. Madison, Council Chambers, Spring Hill, Kansas on January 12, 2023. The meeting convened at 7:00p.m. with Mayor Berkey presiding and Glenda Gerrity, City Clerk, recording. Councilmembers in attendance: Diana Roth Brian Peel Chad Young Wendy North Councilmembers absent: Chip VanHouden Staff in attendance: Lane Massey, City Administrator Patrick Burton, Community Development Director Rhonda Dunn, Finance Director Cindy Henson, Chief of Police Jackie Messer, Director of Public Works Monakisha Jones, Human Resources Director Consultants in attendance: Spencer Low, MVP Law INVOCATION The invocation was given by the mayor. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ROLL CALL The City Clerk called the roll of the City Council. With a quorum present, the meeting commenced. APPROVAL OF THE AGENDA The mayor requested to add an Executive Session for attorney-client privilege. Motion by Roth, seconded by North, to approve the agenda as amended. Spring Hill City Council Regular Session Minutes January 12, 2023 Page 1 of 3 DISCUSSION Enterprise Fleet Management Mr. Ken Olsen, Fleet Consultant, Enterprise Fleet Management, presented a fleet synopsis for the city. Enterprise Fleet Management is a privately held, full-service fleet management business for government agencies and other organizations operating medium-sized fleets of 20 or more vehicles. After discussion, it was the consensus of the City Council to proceed with generating a contract for this fleet management program; and, as an option, include the costs for a maintenance program. CITIZEN PARTICIPATION • Carol George, 22120 Dunn Drive, spoke about Item 3. Settlement and Release Agreement for Village on Victory and 20’ tree preservation. • Chad Johnson, 22164 Dunn Drive, spoke about the 20’ tree preservation. CONSENT AGENDA Motion by Roth, seconded by Peel, to approve the consent agenda. 1. Approval of Minutes: December 22, 2022, Regular Meeting 2. Consider Approval of the Engagement Letter with Gordon CPA for the 2022 Financial Audit 3. Consider Approval of Settlement and Release Agreement – Village on Victory Motion carried 4-0-0. FORMAL COUNCIL ACTION 4. Consider Approval of Appropriation Order 2023-01-12 Motion by Roth, seconded by North, to approve Appropriation Order 2023-01-12. Motion carried 4-0-0. 5. Consider Acceptance of RFP Insurance Broker Selection Motion by Roth, seconded by Young, to approve Elliott Group as the City’s Insurance Broker. Motion carried 4-0-0. EXECUTIVE SESSION No. 1 Motion by Roth , seconded by North, to recess into Executive Session for 5 minutes to receive advice of counsel regarding litigation pursuant to the attorney-client privilege exception of K.S.A. 75-4319 (b) (2) of the Kansas Open Meetings Act. The open meeting will resume in the City Council Chambers at 8:18p.m. No formal action is anticipated following the session. Persons to be in attendance are Spencer Low, MVP Law, Lane Massey, City Administrator and Monakisha Jones, Human Resources Director. Motion carried 4-0-0. The meeting recessed at 8:13p.m. The Mayor stated, let the record reflect that the Governing Body reconvened into the open meeting at 8:18p.m., with everyone present. No votes were taken, or decisions made during the executive session. The discussion was limited to the subjects stated. Spring Hill City Council Regular Session Minutes January 12, 2023 Page 2 of 3 EXECUTIVE SESSION No. 2 Motion by Roth , seconded by Peel, to recess into Executive Session for 5 minutes to receive advice of counsel regarding recent Supreme Court Decision pursuant to the attorney-client privilege exception of K.S.A. 75-4319 (b) (2) of the Kansas Open Meetings Act. The open meeting will resume in the City Council Chambers at 8:24p.m. No formal action is anticipated following the session. Persons to be in attendance are Spencer Low, MVP Law, and Lane Massey, City Administrator. Motion carried 4-0-0. The meeting recessed at 8:19p.m. The Mayor stated, let the record reflect that the Governing Body reconvened into the open meeting at 8:24p.m., with everyone present. No votes were taken, or decisions made during the executive session. The discussion was limited to the subjects stated. ADJOURN Motion by Roth, seconded by North, to adjourn.
