City of Spring Hill, Kansas Minutes of City Council Regular Session December 14, 2023 A Regular Session of the City Council was held in the Spring Hill Civic Center, 401 N. Madison, Council Chambers, Spring Hill, Kansas on December 14, 2023. The meeting convened at 7:00p.m. with Mayor Berkey presiding and Glenda Gerrity, City Clerk, recording. Councilmembers in attendance: Diana Roth Brian Peel Chad Young Wendy North Chip VanHouden Staff in attendance: Lane Massey, City Administrator Rhonda Dunn, Finance Director Cindy Henson, Chief of Police Jacob Speer, Public Works Director Monakisha Jones, Human Resources Director Consultants in attendance: Spencer Low, City Attorney Tyler Ellsworth, Bond Counsel INVOCATION The invocation was given by the mayor. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ROLL CALL The City Clerk called the roll of the City Council. With a quorum present, the meeting commenced. APPROVAL OF THE AGENDA Motion by Roth, seconded by North, to approved the agenda as presented. Motion carried 5-0-0. There were no public comments. The mayor closed the public hearing. FORMAL ACTION 1. Consider Approval of Resolution No. 2023-R-28: Petition Johnson County Board of County Commissioners to Join Johnson County First District No. 2 Motion by Peel, seconded by VanHouden, to approve Resolution No. 2023-R-28 to petition the Johnson County Board of County Commissioners (for the City) to join Johnson County Fire District No. 2. Lincoln Street pursuant to Article 11, Section 13, of the Constitution of the State of Kansas and K.S.A. 79- 251 The mayor opened the public hearing and asked for public comments. Public Comments: - Tyler Ellsworth, Kutak Rock, gave a background and overview of the five-year extension to an existing exemption from ad valorem taxes on property located at 701 N. Lincoln Street. The mayor closed the public hearing. Public Comments: - Tyler Ellsworth, Kutak Rock, gave a background and overview of the five-year extension to an existing exemption from ad valorem taxes on property located at 20241 W. 207th Street. - Tim Stevens, General Manager with SEATS, Inc., spoke about employments numbers in reference to the exemption. Consider Approval of Ordinance No. 2023-25: An Ordinance extending an existing exemption from ad valorem taxes on property located at 701 N. Lincoln Street pursuant to Article 11, Section 13, of the Constitution of the State of Kansas and K.S.A. 79-251 Motion by Roth, seconded by Young, to approve Ordinance No. 2023-25, extending an existing exemption from ad valorem taxes for a facility used to manufacture articles of commerce located in the City of Spring Hill, Kansas, and acquired, improved, equipped, and furnished by Nordic Equity, LLC and Seats, Incorporated, all-in accordance with Article 11, Section 13, of the Kansas Constitution, 701 N. Consider Acceptance of Bid for Annual Auditing Services to Gordon CPA and Authorize the Mayor to Sign the Engagement Letter or Contract for Services Motion by Roth, seconded by North, to award the bid for audit services to Gordon CPA and authorize the Mayor to sign the engagement letter or contract for services. Motion carried 5-0-0. 18. Consider Approval to Pay Off Bond 2016A in the amount of $122,064.00, and Authorize the City Clerk to Sign the Letter to the State Motion by Roth, seconded Peel, to approve proceeding with the payoff of bond series 2016A and direct the City Clerk to sign the letter to the Kansas State Treasurer. Motion carried 5-0-0. ANNOUNCEMENTS AND REPORTS The Governing Body and staff gave reports. RESIGNATION of COUNCILMEMBER WENDY NORTH Councilmember North announced that she will be moving away from Spring Hill and will no longer be able to serve as a member of the City Council. EXECUTIVE SESSION NO. 1 Motion by Roth, seconded by Peel, to recess into Executive Session for 15 minutes, with a 5-minute break prior to, to receive advice of counsel to discuss an existing economic development project to the attorney- client privilege exception of K.S.A. 75-4319 (b) (2) of the Kansas Open Meetings Act. The open meeting will resume in the City Council Chambers at 8:10p.m. No formal action is anticipated following the session. Persons to be in attendance are Lane Massey, Rhonda Dunn, Dan Miller, Spencer Low and Tyler Ellsworth. Motion carried 5-0-0. The Mayor stated to let the record reflect that the Governing Body reconvened into the open meeting at 8:10p.m., with everyone present. No votes were taken, or decisions made during the executive session. The discussion was limited to the subjects stated.
