BOARD OF ADJUSTMENT AGENDA November 13, 2017 BOARD OF ADJUSTMENT: Edmund Johnson, Chair Don Garrison, Jr., Vice-Chair Nancy Corbin, Secretary Marita Malone Maureen Bouxsein Brian Andrzejewski, Alternate Richard Alferman, Alternate In accordance with Chapter 400 (Zoning Code) of the Code of Ordinances of the City of St. Charles, Missouri, notice is hereby given that the Board of Adjustment will conduct a public hearing on Monday, November 13, 2017, at 6:00 p.m. on the fourth floor of City Hall in the City Council Chambers, 200 North Second Street in St. Charles, Missouri for the purpose of giving interested parties and citizens an opportunity to be heard on the following matters: Call to Order and Call the Roll 1. Case No. BOA-2017-33. Address: 317 North Kingshighway. (Stephen Hollander – S.J. Hollander Architect) Two requests. 1st– Request to vary the side yard setback from seven (7) feet to zero (0) feet as required in §400.170(E)(5)(b) of the City of St. Charles Code of Ordinances. 2nd - Request to vary the maximum density permitted from 18 units per acre to 18.29 units per acre as required in §400.170(E)(7) of the City of St. Charles Code of Ordinances. The Property is zoned C-2 General Business District and within the EHP Extended Historic Preservation District (Ward 7). 2. Case No. BOA-2017-34. Address: 21 Faulkner Drive. (Joseph and Josephine M. Inhof) Request to decrease the rear yard setback for a deck from fourteen (14) feet to twelve (12) feet as required in §400.620(A)(4) of the City of St. Charles Code of Ordinances. The zoning for the subject property is PD-R Planned Development-Residential District (Ward 3). 3. Case No. BOA-2017-35. Address: 99 Brighton Park Drive. (Edson Montalvo and Jessyka Luna) Request to decrease the front yard setback for an existing single family residence within the Brighton Park Subdivision from 20 feet to 19.8 feet as regulated in Ordinance 07-296, and Board of Adjustment Agenda 1 as recorded in Plat Book 45, Page 167 at the St. Charles County Recorder of Deeds. The property is zoned PD-MU Planned Development-Mixed Use District (Ward 6). 4. Case No. BOA-2017-36. Address: 2144 First Capitol Drive. (BFA, Inc. – Mark Harriman) Two requests. 1st– Request to decrease the side yard setback from twenty five (25) feet to twenty one and a half (21.5) feet as required in §400.230(D)(5)(b) of the City of St. Charles Code of Ordinances. 2nd - Request to reduce the required width for a landscaped greenbelt from twenty five (25) feet to eleven (11) feet as required in §400.230(D)(9)(b) of the City of St. Charles Code of Ordinances. The Property is zoned C-3 Highway Business District (Ward 2). 5. Case No. BOA-2017-37. Address: 308 Barthel Avenue. (David Berthold) Request to approve the re-issuance of a nonconforming use permit for the continuation of motor vehicle service and motor vehicle storage uses on the subject property. A public hearing before the Board of Adjustment is required to consider the re-issuance of this nonconforming use permit per §400.790(B) because the Community Development Department is unable to determine from the documentation provided that the use is a valid non-conforming use. The zoning for the subject property is R-1E Single Family Residential District (Ward 1). 6. Case No. BOA-2017-38. Address: 205 South Duchesne Drive. (Laurie Smith – Agape Construction Company) Request to decrease the minimum rear yard setback for a single- family residence from twenty-five (25) feet to ten (10) feet as required in §400.150(E)(5)(c) of the City of St. Charles Code of Ordinances. The property is zoned R-1E Single Family Residential District (Ward 9). 7. Case No. BOA-2017-39. Address: 3701 Elm Street. (Core States Group) Request to decrease the minimum rear yard setback for an existing and future accessory structure from thirty (30) feet to one (1) feet as required in §400.240(D)(5)(d) of the City of St. Charles Code of Ordinances. The property is zoned I-1 Light Industrial District (Ward 8). 8. Administrative Item. Approval of the 2018 Meeting Dates and Deadlines. Adjournment The next meeting of the Board of Adjustment is scheduled for Monday, December 4, 2017 on the fourth floor of City Hall in the City Council Chambers, 200 N.
