The regular meeting of the St. Charles Planning and Zoning Commission was held on Monday, June 27th, 2022 at
6:30 p.m. on the fourth floor of City Hall in the Council Chambers.

The meeting was called to order by chairperson, Lindsey Devereux at 6:30 p.m. Those in attendance are noted
above.
2. The Pledge of Allegiance.
3. Approve the minutes of the May 23rd, 2022 Planning and Zoning Commission regular meeting.
Steve Hollander made a motion to approve the minutes. Missy Palitzsch seconded the motion. All were in favor.
The minutes were approved as submitted.
PUBLIC HEARING: Text Amendment
4. Case No. TA-2022-03. (City of St. Charles) An application to amend Chapter 400 of the Code of
Ordinances specifically updates to multiple Definitions and Zoning Districts to address compliance with
the City’s Liquor Ordinance as well as updates to allow outdoor and indoor music within the HDD,
Historic Downtown District (Section 400.350).

seconded the motion. Upon a roll call vote, all were in favor aside from Lindsey Devereux who was opposed. The
Text Amendment will forwarded, with a favorable recommendation, to the City Council at the July 5th, 2022 meeting.
PUBLIC HEARING: Rezoning
5. Case No. Z-2022-06. (TAS LLC – Tony Ingrassia) An application to rezone nine (9) tracts of land located
on Boones Lick Road (1504, 1508, 1509, 1511, 1512, 1521, 1529 and 1537 Boones Lick Road) and 901
Gustane Drive, from C-2 General Business District or O-I Office Institution District to R-1E Single-
Family Residential District. The subject properties are located in Ward 2.

6. Case No. Z-2022-14. (Douglas E. Meyer & Bradley J. Meyer) An application to rezone three (3) tracts of

Ward 2.
The applicants, Doug Meyer and Tony Ingrassia, addressed the Commission. The public hearing opened with
Patrick Tobin addressing the Commission. Steve Hollander made a motion to close the public hearing. Missy
Palitzsch seconded the motion. All were in favor. The public hearing was closed. Steve Hollander made a motion
to approve Z 2022-06, as submitted. Missy Palitzsch seconded the motion. Upon a roll call vote, all were in favor.
Steve Hollander then made a motion to approve Z 2022-14. Missy Palitzsch seconded the motion. Upon a roll call
vote, all were in favor. The Rezoning applications will be forwarded, with a favorable recommendation, to the City
Council at the July 5th, 2022 meeting.

7. Case No. Z-2022-08. (Senior Transitional Living, LLC – Greg Gettman) An application to rezone an
approximately 5,600 square foot piece of land known as 2023 North 3rd Street from C-3 Highway
Business District to R-1E Single-Family Residential District for the purposes of a single-family residence.
The subject property is located in Ward 1.
The applicant, Greg Gettman, addressed the Commission. The public hearing opened without anyone coming
forward to address the Commission. Steve Hollander made a motion to close the public hearing. Missy Palitzsch
seconded the motion. All were in favor. The public hearing was closed. Steve Hollander made a motion to

Parking Permit District, specifically the Elmwood RPPD approved via City Ord #05-081. The subject
location is located on both sides of Elmwood Drive between Elm Street on the west and the properties
located at 404 and 405 Elmwood Drive on the east (including those properties). The subject properties
are located in Ward 7.
The public hearing opened without anyone coming forward to speak. Steve Hollander made a motion to close the
public hearing. Missy Palitzsch seconded the motion. All were in favor. The public hearing was closed. Steve
Hollander made a motion to approve the Rezoning. Julie Bartch seconded the motion. Upon a roll call vote, all
were in favor. The Rezoning will be forwarded, with a favorable recommendation, to the City Council at the July

9. Case No. Z-2022-10. (SKDM Holdings, LLC) An application to rezone an approximately 8,500 square
foot piece of land known as 1156 South 6th Street from R-1E Single-Family Residential District to R-2
Two-Family Residential District for the purpose of permitting a duplex. The subject property is located in
Ward 2.
Steve Hollander recused himself from discussion. A representative for the applicant, Mike Klinghammer,
addressed the Commission. The public hearing opened without anyone coming forward to speak. Missy Palitzsch
made a motion to close the public hearing. Julie Bartch seconded the motion. All were in favor. The public
hearing was closed. Missy Palitzsch made a motion to approve the Rezoning, as submitted. Julie Bartch seconded
the motion. Upon a roll call vote, Mayor Dan abstained, Steve Hollander was recused (marked as abstained), and
all others were in favor. The Rezoning will be forwarded, with a favorable recommendation, to the City Council
at the July 5th, 2022 meeting.

6.88 acre tract of land located at 93 Kunze Drive from St. Charles County R1E Single-Family Residential

Ward 3 upon annexation.
The applicant, Eldwanda Kramer, addressed the Commission. The public hearing opened without anyone coming
forward to speak. Steve Hollander made a motion to close the public hearing. Julie Bartch seconded the motion.

Residential District within the Wellhead Protection District. The subject property is located in Ward 8.

forward to speak. Steve Hollander made a motion to close the public hearing. Julie Bartch seconded the motion.
All were in favor, the public hearing was closed. Julie Bartch made a motion to approve the Z 2022-12, as submitted.
Steve Hollander seconded the motion. Upon a roll call vote, Tyson King abstained but all others were in favor.
Julie Bartch made a motion to approve the Z 2022-13, with the following condition:
1. The Preliminary Development Plan shall comply with all Fire Department requirements, regarding fire
hydrant placement, prior to the issuance of any building permits.
Missy Palitzsch seconded the motion. Upon a roll call vote, Tyson King abstained but all others were in favor The
Rezoning applications will be forwarded, with a favorable recommendation, to the City Council at the July 5th, 2022
meeting.

13. Case No. CU-2022-09. (Lage Real Estate) An application for a Conditional Use Permit from
§400.220(C)(1)(a) for a Guest House use within the C-2 General Business District located at 405, 407,

Steve Hollander made a motion to table the item, as requested by the applicant. Julie Bartch seconded the motion.
All were in favor. The Conditional Use was tabled until the July 25th, 2022 meeting.

§400.230(C)(1)(a) for a motor vehicle sales use within the C-3 Highway Business District located at 2269

15. Case No. CU-2022-12. (Fairall Business Group dba Just Right Motors – Steve Fairall) An application for
a Conditional Use Permit from §400.220(C)(1)(c) for a motor vehicle sales use within the C-2/EHP
General Business District within the Extended Historic Preservation District located at 2239 N 3rd Street.
The subject property is located in Ward 1.
The applicant, Steve Fairall, addressed the Commission. The public hearing opened without anyone coming
forward to speak. Steve Hollander made a motion to close the public hearing. Julie Bartch seconded the motion.
All were in favor. The public hearing was closed. Missy Palitzsch made a motion to approve the Conditional Use,
with the following conditions:
1. This conditional use permit for a Motor Vehicle Sales use is issued to the applicant (Steve Fairall) only for the
property at 2239 N 3rd Street and is not transferable to another tenant or location.
2. Parking for both customers and the business (including inventory/display vehicles) shall be located within a
paved and striped parking space as designated on the submitted parking exhibit. Parking outside of the striped
spaces is prohibited.
3. There shall not be more than five (5) inventory vehicles on this property at any one time which shall be
located in the spaces designated on the submitted parking exhibit.
4. Parking shall be prohibited in the public right-of-way (including sidewalks).
5. All vehicles on site within the designated parking spaces must be in operable condition. Parking of derelict
vehicles is prohibited unless within the screened storage area and not to exceed thirty (30) days.
6. No balloons, pennants, streamers, flags, inflatable figures, or banners may be used on the property unless
specifically permitted by the City’s Sign Code.
7. Non-compliance with any building codes, property maintenance codes, fire codes or conditions of this
approval is grounds for revocation of the conditional use approval.
Julie Bartch seconded the motion. Upon a roll call vote, all were in favor. The Conditional Use will be forwarded,
with a favorable recommendation, to the City Council at the July 5th, 2022 meeting.

18. Case No. SP-2022-17. (EPC, Inc.) A site plan application for a secured parking area for company owned
vehicles located at 3941 Harry S Truman Boulevard and within the C-3 Highway Business District. The
subject property is located in Ward 6.
The applicant, Joe Pranger and Pat Laughlin, addressed the Commission. Steve Hollander made a motion to
approve the Site Plan, with the following conditions:
1. All equipment shall be maintained in good condition. Storage of damaged, derelict or inoperable equipment is
prohibited.
2. The applicant shall provide twelve (12) 2.5” - 3” caliper evergreen and deciduous trees along its frontage.
This shall be verified prior to the approval of a building permit.
Missy Palitzsch seconded the motion. Upon a roll call vote, all were in favor. The Site Plan was approved.

REQUEST
The City has received an application to rezone 109 Kunze Drive (Parcel ID# 3-0117-4105-00-
0010.0000000) upon annexation from St. Charles County R1E Single-Family Residential District
to City of St. Charles R-1E Single-Family Residential District. The subject property is
approximately 0.46-acre in area and is located on Kunze Drive approximately 760 feet east of
Hemsath Road. The City of St. Charles municipal boundary borders the subject property along
the north, south, and west sides, all of which is zoned R-1E Single-Family Residential District.
The property was developed as a single-family residence in 1955 according to the County’s
records, and the owner wishes to annex to the City in order to tie into the City’s utilities. If the

requested rezoning is approved, the property would operate in compliance with the zoning
regulations of the R-1E Single-Family Residential District. Annexation of this property would
remove a remaining pocket of property within Unincorporated St. Charles County.
While this application to establish zoning will run concurrently with the petition to annex the
same property into the City at City Council, this application before the Planning and Zoning
Commission is solely to evaluate and provide a recommendation on the proposed zoning district
should the property be annexed.
COMPLIANCE WITH THE COMPREHENSIVE PLAN
The St. Charles Comprehensive Plan adopted in 2002 and updated in 2012 recommends that land
use decisions be based on a project’s location and compatibility with surrounding development.
This revision to the Comprehensive Plan was approved by the City Council, and was written
under the direction of residents, elected officials, and City staff. The Comprehensive Plan
identifies 15 activity centers in the city, locations characterized by elevated levels of
development, density and activity. The activity centers are the most prominent, visible and
intensely developed locations in the city, and the activity centers should be surrounded by land
uses that gradually decrease in levels of activity, traffic and density. Proposed new development
should be judged based upon its distance from the nearest activity center, its compatibility with
what surrounds it, and whether the level of development it will generate contributes to a gradual
decline in density or acts counter to that goal.
The subject property is located between Activity Center #10 (Page Avenue/Highway 94) and
Activity Center #11 (Page Avenue/Arena Parkway). The zoning of properties adjacent to the
subject site within the City limits are single-family residential and all are also developed for this
use. The Department of Community Development considers this rezoning request to be in
general conformance with the Updated 2012 Comprehensive Plan and consistent with existing
area land uses around the subject property.
STAFF RECOMMENDATION
After review of the rezoning request, the City’s Zoning Ordinance, Comprehensive Plan and area
development patterns, staff believes the requested rezoning is appropriate and is compatible with
the zoning of the surrounding area. The Department of Community Development recommends
that the rezoning request be forwarded to the City Council with a favorable recommendation.
Recommended Motion:
Motion to forward a recommendation of approval to the City Council for the request to rezone
upon annexation an approximately 0.46-acre tract of land known as 109 Kunze Drive from
County R1E Single-Family Residential District to City R-1E Single-Family Residential District.

SUMMARY/ANALYSIS
This request is for an E-bike Rental Use associated with a permitted retail use located at 603 S 5th
Street. The property is located within the C-2/FSC/HD/EHPD General Business District within
the Fifth Street Corridor/Hospital District and within Extended Historic Preservation District
overlays at the southwest corner of intersection of S 5th Street and Pike Street. The Fifth
Street/Hospital District requires approval of a Conditional Use Permit for Vehicle
Rental/Leasing/Sales establishments. Although the e-bike is not considered a vehicle in a
traditional sense, the listed use was added as a Conditional Use in December of 2021 in order to
allow for proposed golf cart rentals. Neither the Zoning Code nor the Fifth Street/Hospital District
Smart Code specifically list Bike Rental or E-bike Rental as an available use. When a use is not
specifically listed, it is prohibited; however, the code does allow for staff to make a reasonable
interpretation of the code if there is a “best fit”. Staff interprets that the “Vehicle
Rental/Leasing/Sales” (vehicle/equipment-type product rental) use listed in the Fifth Street
Corridor/Hospital District Smart Code best fits the rental aspect of this business.
Pedego is a retail store specializing in e-bike and accessory sales. Earlier this month, the business
was issued a Certificate of Occupancy and business license. They are in the process of completing

the final touches to open the store for business and anticipate a grand opening on July 23, 2022.
They occupy the northern corner tenant space of the multi-tenant building. While the main focus
of the business is retail, an accessory aspect of their business plan includes the rental of the e-
bikes. This Conditional Use request is specific to the bike rental only and is not applicable to the
other uses permitted by right.
Unlike other nationwide businesses that are focused on e-bike or e-scooter rentals, Pedego requires
their customers to come into their store locations in order to start the rental process. Once the
customer/renter is in the store they will fill out a release form, present a photo ID and a credit card
to keep on file. They will be fitted with a bike, given verbal instructions on how to operate the
bike and then the renter will be required to demonstrate their comprehension of those instructions.
Once the renter completes this initial process, they will sign the release form and permitted to ride.
All bikes must be returned to the store at the end of the rental period. If they should not be
returned, the credit card will be charged for the bike and any after-market accessories added to the
bike. Should a biker become stranded, Pedego has a vehicle to pick up the renter or swap out the
bike. The business also plans to put trackers on the designated rental bikes, in case they do not
return.
During the regular business hours, the bikes will be stored on the side of the building that faces
Pike Street, within bike racks. All bikes will have bike locks to deter theft while sitting outside
during this time. After business hours, the bikes will be stored inside the store.
Currently, there is only one other bike rental use business within the City. This business pre-dates
the requirement for a Conditional Use and staff is unaware of any current issues regarding the bike
rental process.
Consistency with Fifth Street Corridor/Hospital District Smart Code
1.1.3 For the purpose of promoting health, safety, morals, and the general welfare of the
community, the City Council of Saint Charles hereby places regulations and restrictions
upon the height, number of stories, and size of buildings and other structures, the
percentage of lot that may be occupied, the size of yards, courts and other open spaces,
the density of population, the preservation of features of historical significance, and the
location and use of buildings, structures, and land for trade, industry, residence, or other
purposes.
1.2.4 Improve the perimeter condition and circulation around the Saint Joseph Health
Center (SJHC) property to establish a true health campus district that encourages quality
development nearby and provides an attractive environment for SJHC employees and
customers.
Consistency with Comprehensive Plan
The St. Charles Comprehensive Plan adopted in 2002, and updated in 2012, recommends that land
use decisions be based on a project’s location and compatibility with surrounding development.
The Comprehensive Plan identifies 15 activity centers in the city, locations characterized by
elevated levels of development, density and activity. The activity centers are the most prominent,
visible and intensely developed locations in the city. The plan recommends that development

should gradually decrease in density as distance from an activity center increases. The activity
centers should be surrounded by land uses that gradually decrease in levels of activity, traffic and
density. Proposed new uses should be judged based upon its distance from the nearest activity
center, its compatibility with what surrounds it, and whether the level of development it will
generate contributes to a gradual decline in density or acts counter to that goal. This property is
located nearest to Activity Center #6 (Historic Downtown). The proposed e-bike rental at this
location associated with a permitted retail use can be compatible with its other commercial/retail
surroundings along 5th Street, First Capitol Drive and Main Street.
Consistency with Conditional Use standards
Section 400.980 of the City Code outlines standards of review for the conditional use application.
The standards are as follows:
a) How the proposed conditional use (the use in general) is in harmony with the purposes,
goals, objectives, policies and standards of the Comprehensive Plan, and any other plan,
program, or ordinance adopted, or under consideration pursuant to official notice by the
city.
b) Whether the proposed conditional use (in its proposed location) is in harmony with the
purposes, goals, objectives, policies and standards of the Comprehensive Plan, and any
other plan, program, or ordinance adopted, or under consideration pursuant to official
notice by the city.
c) Whether the proposed conditional use, in its proposed location and as depicted on the
required site plan, results in a substantial or undue adverse impact on the adjacent property,
the character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare, either as they now exist or as they may in the future be
developed as a result of the implementation of the provisions and policies of the Zoning
Ordinance, Comprehensive Plan, or any other plan, program, or ordinance adopted or under
consideration pursuant to official notice by the city.
d) Whether the proposed conditional use maintains the desired consistency of land uses, land
use intensities, and land use impacts as related to the environs of the subject property as
directed by the Comprehensive Plan.
e) Whether the proposed conditional use is located in an area that will be adequately served
by, and will not impose an undue burden on, any of the improvements, facilities, utilities
or services provided by public agencies serving the subject property.
f) Whether the public benefits of the proposed conditional use outweigh the potential adverse
impacts of the proposed conditional use as identified above, after taking into consideration
any proposal by the petitioner and any requirements recommended by the petitioner and/or
City Staff to ameliorate such impacts.
Furthermore, the City Code allows the Planning and Zoning Commission to recommend conditions
of approval to protect surrounding properties, as well as to give consideration with respect to
location in the recommendations. The proposed use complies with the above standards.

STAFF RECOMMENDATION
This conditional use can operate in conformance with City requirements, is compatible with
surrounding land uses and complies with the Comprehensive Plan of the City of St. Charles. Staff
recommends approval of the proposed conditional use for e-bike rental associated with a permitted
use subject to the following conditions:
1. This conditional use permit for e-bike rental associated with a retail use is issued to the
applicant (Pedego St. Charles – David Horst) only for the property located at 603 S 5th Street
and is not transferable to another location and/or tenant/business.
2. All inventory/equipment shall be stored inside the building during non-business hours.
3. All inventory shall be stored in the approved location (bike racks). Any expansion of the
outdoor storage area may require additional City approval.
4. If the City receives complaints of Pedego e-bikes found abandoned, bikes shall be picked up
by Pedego within four (4) hours of notification by city staff.
5. Non-compliance with any building codes, property maintenance codes, fire codes or conditions
of this approval is grounds for revocation of the conditional use approval.
Recommended Motion:
Motion to forward the Conditional Use Permit application for E-bike Rental associated with a
permitted use at 603 S 5th Street to the City Council with a favorable recommendation, subject to
the conditions recommended by staff.

SUMMARY/ANALYSIS
This request is for a liquor sales specifically associated with a permitted restaurant use located at
1500 Elm Street. The property is located within the C-2/EHPD General Business District within
the Extended Historic Preservation District overlay on the northwest corner of intersection of Elm
Street and N Kingshighway Street. The C-2 District requires approval of a Conditional Use Permit
for establishments that apply for a Liquor License. The Sushi Boat restaurant will occupy the
eastern corner tenant space of the multi-tenant building, including areas for outdoor seating at the
side of the building (facing N Kingshighway Street). Earlier this month, the restaurant was issued
a Certificate of Occupancy and Business License. This Conditional Use request is specific to the
liquor sales only and is not applicable to the other uses permitted by right. The applicant has
provided a brief narrative regarding the request and interior tenant space layout. In the narrative,
the applicant explains they will be serving Japanese cuisine (sushi) and would like the opportunity
to serve beer, wine, Japanese Sake and other alcoholic beverages to their customers.
Currently there is only one other business within the multi-tenant plaza where the subject business
is located, St. Charles Barber College. There are at least two other vacant tenant spaces within the
building. Other liquor sales or restaurant businesses within the immediate vicinity include a Mobil,

1. This conditional use permit for a liquor sales associated with a restaurant use is issued to the
applicant (Sushi Boat restaurant - Yachao Fan) only for the property located at 1500 Elm Street
and is not transferable to another location and/or tenant/business.
2. Approval of this Conditional Use is not approval of a liquor license. A liquor license shall be
approved by the City Council prior to any liquor sales.
3. Liquor sales shall not occur independent of the primary business use and shall only be
accessory to the operation of the restaurant.
4. Non-compliance with any building codes, property maintenance codes, fire codes or conditions
of this approval is grounds for revocation of the conditional use approval.
Recommended Motion:
Motion to forward the Conditional Use Permit application for a Liquor Sales associated with a
permitted use at 1500 Elm Street to the City Council with a favorable recommendation, subject to
the conditions recommended by staff.

I talked with Andrew yesterday, and asked me to send you an email to provide a brief write up of our business
and why we apply for a liquor license. Here it is!
Our restaurant, named Sushi Boat, is a mainly serving Japanese Food (Sushi) . It is a dinning-in restaurant, and
we are planning on taking go-to order and delivering.
And we would like to serve our customers beer, wine, Japanese Sake, and/or hard liquor after their hardworking
days. We will watch closely to our customers while they consume the alcohol at our place!
We are new to this community, and we are looking forward to serve the community.

application is Case No. CU-2022-16 for a Conditional Use Permit from §400.220(C)(1)(i)
for Liquor Sales associated with a permitted restaurant use within the C-2 General Business
District and within the EHP Extended Historic Preservation District located at 1500 Elm
Street. The subject property is located in Ward 7.
The St. Charles Planning and Zoning Commission will hold a public hearing on this
application on Monday, July 25, 2022 at 6:30 p.m. on the fourth floor of City Hall, 200
North Second Street, St. Charles. You may attend the public hearing and make comments
concerning the proposal, or you may forward written comments to the Planning and Zoning
Commission through the Department of Community Development, 200 North Second Street,
Room 303, St. Charles, MO 63301. Following the public hearing, the Commission is
expected to forward a recommendation on this application to the City Council. A public
hearing on this application before the City Council is scheduled for Tuesday, August 2, 2022
at 7:00 p.m. on the fourth floor of City Hall. You will have an opportunity to make
comments at that hearing as well. The final decision on these applications will be made by
the City Council.
