MINUTES of the JOINT MEETING of the PLAN COMMISSION and TOWN BOARD Wednesday, July 3, 2024 St. Joseph Town Hall / Online CALL TO ORDER by Chair Anton Rang at 6:30 pm STATEMENT OF PUBLIC NOTICE read by Chair Rang ROLL CALL: Chair Anton Rang, Chris Matter, Carol Loncar, Erik Lorenz, Craig Sykora, Justin Kruse, Theresa Johnson. Online: PLEDGE OF ALLEGIANCE recited ADOPTION OF AGENDA: MOTION to adopt the agenda (Kruse/Lorenz). Motion carried. APPROVAL OF PRIOR MEETING MINUTES: MOTION to approve the meeting Minutes for June 2024 (Loncar/Matter). Motion carried. PUBLIC COMMENTS: ITEMS FOR DISCUSSION and/or ACTIONS BY COMMISSION 1. Final Plat — Artisan Farms — 603 County Road E, 030-1014-10-030: Doug Zahler discussed the Final Plat updates. MOTION to recommend to the Town Board to approve the Final Plat application for the subdivision at 603 County Road E, Parcel No. 030-1014-10-030 with the comment and recommendation that we will look into easement onto Outlot 2 for maintenance by the Homeowner’s Association and looking at that for potential coming in either through the easement to Lot 11 or Lot 7 (Matter/Lorenz). Motion carried. 2. Preliminary Plat — Oaks of St. Croix — 360 144th Avenue, 030-1040-80-200: Doug Zahler discussed the proposed Preliminary Plat with some minor updates. MOTION for the Town Board to approve the Preliminary Plat for the Oaks of St. Croix at 360 144th Avenue, primary Parcel No. 030- 1040-80-200 (Loncar/Matter). Requested all the staff report recommendations be followed. Motion carried. Rick Caruso abstained from the vote. 3. County Conditional Use Application (filling & grading) — St. Croix Yacht Club — Hi-Line Beach — 030-2023-20-000: Discussed the conditional use application for the St. Croix Yacht Club. MOTION to recommend to the Town Board to recommend to the County to approve the County Conditional Use Application for filling and grading for Parcel No. 030-2023-20-000 (Loncar/Lorenz). Motion carried. 4. Ordinance reviews in progress.  Chapter 68, assemblies: Carol Loncar discussed the proposed changes to this ordinance. Will remove the matrix and create as a second document. Discussed size of events, trash clean up, and first aid station.  Chapter 74, activities on town property: Rick Caruso discussed the proposed updates to this ordinance. Discussed alcohol or controlled substances on Town property. Discussed fines and penalties and enforcement, raising the penalty fine to $250 (will also include in the Citation ordinance). Will bring this to the next meeting.  Chapter 84, outdoor burning: Chris Matter discussed the proposed updates to this ordinance. Discussed changing the reference to “indoor” burning. Discussed changing the fine/penalty to a maximum of $5,000. Will bring this to the next meeting.  Chapter 98, public entertainment: Carol Loncar discussed the updates to this ordinance. Discussed adding “severability” to the ordinance.  Chapter 104, fireworks: Erik Lorenz discussed this ordinance. No purchasing of fireworks allowed. The fine amount was discussed.  Chapter 123, lakes & waterways: Chris Matter discussed this ordinance. Discussed adding language for jet skis to be included with motor boats. Discussed changing the fine amount and enforcement of penalties. The severability clause will be added to this ordinance. Will bring this to the next meeting.  Chapter 130, mobile homes & mobile home parks: Anton Rang discussed this ordinance. Discussed raising the fine/penalty. Will add the severability clause to this ordinance. Section 130-06 needs to be reviewed to confirmed which entity will review temporary permits.  Chapter 162, solid-fuel-fired heating devices: Craig Sykora discussed the proposed changes to this ordinance. Discussed raising the fine/penalty. MOTION to recommend this revised ordinance to the Board (Lorenz/Loncar). AMEND MOTION to modify it to increase the citation to $250 (Lorenz/Loncar). Motion carried.  Chapter 163, solid waste: Rick Caruso discussed the proposed changes to this ordinance. Discussed increasing the fine/penalty to align it with the burning ordinance to include a daily penalty. Will add the severability clause. Will bring this to the next meeting. 5. Ordinance reviews on hold.  Chapter 149, roads, driveways, etc. — waiting on public works & Stantec for recommendations: The Public Works Committee will be discussing the “bump out” for the cluster mailboxes at their August meeting.  Chapter A200, cable television franchise — waiting on attorney.  Chapter A202, gas franchise — waiting on attorney. 6. Standing items. 6a. Review of budget; updates from county; update on complaints: Discussed the manufacturing of vape products in the Town, the State is looking into complaints. Discussed the increasing dogs at large complaints. Discussed the burning complaints. Discussed the junkyard complaint. Discussed the Cajun Club incident and upcoming Court date. 7. Date of next meeting: August 7, 2024 RECOMMENDATIONS TO TOWN BOARD: Artisan Farms-Final Plat, Oaks at St. Croix-Preliminary Plat, County application, Chapter 162.
