Minutes of the Town Board Meeting
St. Joseph Town Hall
January 9, 2025
Call to Order by Chair Theresa Johnson at 6:00 pm
Statement of Public Notice read by Clerk
Roll Call: Chair Theresa Johnson, Justin Kruse, Matt Moore, Dan Gavin, Chris Marshall, Engineer Lee
Mann, Attorney Nick Vivian
Adoption of Agenda: MOTION to adopt the agenda as presented (Marshall/Kruse). Motion carried.
Pledge of Allegiance recited
Public Comment: Chris DeWuske discussed his driveway and it not being repaired in over
three years and his concerns about his milkweed field. Will be on February agenda. Mike
Michaud, 1245 Rolling Hills Trail, stated he had emailed President Trump and he responded
he would like to see the new building.
Business discussion and possible action on:
1. Lot line adjustment-Michael Razor – 460 149th Ave., Somerset, WI PID#030-2153-28-100 & 030-
2153-27-000: Michael Erickson was present to discuss the lot line adjustment. MOTION for a lot
line adjustment for Michal Razor, 460 149th Ave, Somerset, PID#s 030-2153-28-100 and 030-
2153-27-000 (Marshall/Moore). Motion carried.
2. Presentation from Xcel Energy regarding solar farm in St Croix County and infrastructure. – 15
minutes allocated for questions. Representatives from Xcel Energy presented information on the
Ten Mile Creek Solar Project and King Transmission Connection. Project Phone Number: 1-800-
957-9921 available for answers. Clerk will place information on the website. Residents: Richard
Hailey; Dawn Kameo; Elaine Duncan; Tom Weggel; Chris DeWuske were present to ask
questions. Town Chair asked the Xcel representatives to schedule a meeting so we can set up a
Town Hall meeting for the residents. MOTION to take a 5-minute break (Gavin/Marshall). Motion
carried.
Meeting resumed at 7:01 pm
3. CSM- Mary Brakke, Michael Brakke Trust 738 West Shore Dr., Somerset PID# 030-1058-01-000:
Michael Erickson was present to discuss the CSM. MOTION to approve the CSM for Mary Brakke,
Michael Brakke Trust, at 738 West Shore Drive, PID: 030-1058-01-000 (Marshall/Kruse). Motion
carried.
4. Conditional Use Permit – second dwelling – Alex Rome – 804 140 th Ave, New Richmond, PID#030-
1051-20-130: Alex Rome was present to discuss the CUP for a secondary dwelling. The primary
residence is expected to be completed in 2026. MOTION to approve the Conditional Use Permit
for secondary dwelling for Alex Rome, 804 140th Ave, PID# 030-1051-20-130 (Marshall/Kruse).
AMEND MOTION the main house will be completed by 2027 and there will be no options for a
rental unit on the property (Marshall/Kruse). Motion carried.
5. Preliminary Plat for St Croix Crossing near Hwy 35 -Jim Furseth- PID030-2064-70-101, 030-2064-
60-101, 030-2064-50-000: Louis Filkins was present to discuss the 11-lot preliminary plat.
MOTION giving approval on this Preliminary Plat conditional upon the Developer’s Agreement
being signed, the Homeowner’s Association Agreement taking care of the last of the stormwater
issues with the engineer, and also to formalize the turn lane and bypass lane on Highway 35
(Johnson/Moore). Motion carried.
6. Town Hall Building update
a. Pay Request #7 for building-$251,771.85: MOTION to approve Pay Request No. 7 for
Berghammer Builders in the amount of $251,771.85 (Marshall/Gavin). Motion carried.
b. Update on furnishings for Town hall and Fire Hall: The tabletops for the Board tables have
been chosen. No other updates at this time.
c. Paint choices for hall: Discussed the paint choices for the new building. MOTION to approve
the paint choices for the new Town Hall (Marshall/Kruse). Motion carried. Epoxy floors will
be in the exterior restrooms. Will paint those in white.
d. St Croix Electric rebates: No new information from Dairyland. The equipment has been
ordered, but not paid for yet.
e. Reconsideration of motion regarding sprinkler system for attic space
1. Additional information regarding sprinkler system for attic space: MOTION to reconsider
the motion on the sprinkler system for the attic space based on new information
(Johnson/Marshall). Motion carried. Bruce Paulson was present to discuss the three
options for the sprinkler system which includes additional information not provided earlier.
The Board stated their disappointment with the errors and mistakes which were made
regarding this issue. The Attorney provided his opinion on the issue. Dan Gavin stated: as
to the Motion that is being reconsidered now regarding the fire suppression system at the
new Town Hall, with the information being presented today, make a motion as follows:
MOTION that the Town, as stated earlier, move forward with Option 3 that was presented
by Stantec as the solution for the fire suppression system in the new Town Hall
(Gavin/Marshall). Discussion followed. Motion carried. Request Stantec to respond to
this motion within two weeks.
2. Agreement with Stantec for change in costs for sprinkler system: This item is included with
the request to Stantec to respond within two weeks.
f. Possible Change order #5 and #6: MOTION to approve Change Order #5 for the change in the
electrical receptacle on the north wall to be a quad and the change order cost is $96.00
(Johnson/Marshall). Motion carried.
g. Projected expenditures and available funds and timeline for construction: The financial
spreadsheet has been reviewed and the project timeline discussed. This will be updated.
h. Pay request and update from Sanitary System installation: No new updates at this time.
7. Build out in Fire Hall – update: This project will begin soon.
8. Public Works
a. Update on no parking signs on Nelson Farm Rd Ln and Perch Lake Road: There is no new
update at this time.
b. 2025 Road Project – Crack Sealing/Seal Coating: Lee Mann discussed this project moving
forward. Discussed going to bid for this project. MOTION to approve the 2025 Road Project
Crack Sealing and Seal Coating list that Stantec provided (Marshall/Kruse). Motion carried.
9. Plan Commission
a. Junkyards and other chronic nuisances and enforcement issues: No new updates at this time.
b. Update to ordinances
1. Ordinance 2025-01 – Citations: Discussed the updates to the Citations Ordinance.
Attorney Nick Vivian stated we should change every second offense to each subsequent
offense. MOTION to approve Ordinance 2025-01 Chapter 6 Citations with the correction
that we change “every second offense” to “each subsequent offense” (Kruse/Marshall).
Roll Call: Matt Moore-Aye, Justin Kruse-Aye, Dan Gavin-Aye, Chris Marshall-Aye, Theresa
Johnson-Aye. Motion carried.
2. Ordinance 2025-02 - Temporary Structures: No new updates at this time.
10. Public Records Requests – progress and costs: The clerk discussed the recently received records
requests.
11. Approval of Town Board minutes – December 12 and January 2: MOTION to approve the Town
Board Minutes for December 12, 2024 (Marshall/Kruse). Motion carried. MOTION to approve the
Town Board Minutes for January 2, 2025 (Marshall/Gavin). Matt Moore and Justin Kruse
abstained. Motion carried.
12. Budget, Invoices, checks and bank balances: MOTION to approve all expenditures from
December 13, 2024 through January 9, 2025 including all fund transfers and online payments
(Johnson/Kruse). Motion carried. Clerk will pay the Visa bill online.
13. Resolution 2025-01 – Line-Item transfers for 2024 budget: Discussed the changes to the budget
and line-item transfers. MOTION to approve Resolution 2025-01 Line-Item Adjustments for 2024
Budget (Johnson/Marshall). Roll Call: Dan Gavin-Aye, Theresa Johnson-Aye, Matt Moore-Aye,
Justin Kruse-Aye, Chris Marshall-Aye. Motion carried.
14. Change meeting date for reviews of employees and contractors: Discussed new potential dates of
January 21st or January 30th for the contractor/employee reviews: MOTION to change the review
date to Monday, January 27th (Johnson /Marshall). Motion carried.
15. MOTION to go into Closed Session per Wis Stats 19.85(g) and (c) (Marshall/Kruse). Roll Call:
Justin Kruse-Aye, Dan Gavin-Aye, Chris Marshall-Aye, Theresa Johnson-Aye, Matt Moore-Aye.
Motion carried. Closed Session: Wis Stats 19.85(g)— Conferring with legal counsel who is
rendering oral or written advice concerning strategy to be adopted by the body with respect to
litigation in which it is or is likely to become involved – trash burning, animal control issues, Cajun
Club, illegal campground, failure to secure CUP for existing business.
16. Closed session: Wis Stats 19.85(1)(c) for considering employment promotion, compensation or
performance—Zoning administrator annual review and compensation review
17. MOTION to go into Open session (Marshall/Kruse). Roll Call: Theresa Johnson-Aye, Matt Moore-
Aye, Chris Marshall-Aye, Dan Gavin-Aye, Justin Kruse-Aye. Motion carried. Open session to
discuss or act upon matters considered in Closed Session
a. Action on any items in closed session: MOTION to add $300/month to the Zoning
Administrator salary (Marshall/Kruse). Motion carried.
18. Adjournment: MOTION to adjourn at 9:37 pm (Kruse/Marshall). Motion carried.
