City Council Regular Meeting

CITY OF STAR  COUNCIL MEETING JUNE 2, 1998 The Star City Council met in regular session on June 2, 1998. Mayor Watson presiding. Roll call: Amsden, Embury, Winkle, O’Connor, Kirtley. Absent: Ross. Moved by Winkle and seconded by Kirtley to approve the minutes of May 5, 1998 as presented. Motion carried. MIDDLE CREEK SUBDIVISION #2-FINAL PLAT – PHASE ONE: A planned residential development consisting of 26 lots. Property is located on the East Side of Star Rd., approximately ¼ m N. of State Hwy. 44. Kirtley and O’Connor abstained due to a conflict of interest. The application for final plat was presented by Sean Nickels, Ada County Development Services planner. Moved by Embury and seconded by Amsden to approve the plat and findings of fact and conclusions of law as presented. Aye: Winkle, Embury, Amsden. Abstain: Kirtley and O’Connor. Motion carried. ORDINANCE NO. 9-NUISANCE ORDINANCE: An Ordinance relating to public nuisances; defining public nuisance; establishing a procedure for civil abatement of public nuisances; providing for severability; providing for related matters; and providing an effective date. Moved by Embury to table this ordinance until the public has had time to review it. The motion died for lack of a second. Moved by Kirtley and seconded by O’Connor to open the discussion of the ordinance to the public. All Aye: motion carried. Speakers: Jim Eagan: All ordinances should be discussed by the public at meetings. Dennis Stegenga: Inquired of the City attorney the three reading rule for ordinances. The Mayor outlined the contents of the ordinance for the public. Embury advised the public that the agenda was always posted and the public should review the agenda, obtain information from the City Clerk and consult a Council member with their concerns. Only land use issues are considered public hearings and the public is noticed. It is appropriate and ordinary to use the “dispensing rule” to pass ordinances rather than reading the ordinance three different days. Moved by Embury and seconded by Winkle that pursuant to Idaho Code, Section 50-902 the rule Page 1 of 3 requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 9 be considered after reading once by title only. Moved by Amsden and seconded by O’Connor to approve Ordinance 9, An Ordinance relating to public nuisances; defining public nuisance; establishing a procedure for civil abatement of public nuisances; providing for severability; providing for related matters; and providing an effective date. RESOLUTION 98-6: A Resolution approving an agreement for Legal Services between the City of Star and Moore & McFadden, Chartered. Moved by Winkle and seconded by Amsden to approve the Resolution and agreement as presented. All Aye: motion carried. ADA COUNTY TRANSMITTAL 98-04-A DEAN E. SORENSEN/RON KUENZLI. An appeal of the Ada County Planning and Zoning Commission’s decision denying a conditional use permit for a private air strip and a 3,000 sq. ft. aircraft hangar. Sean Nickel, Ada County Development Services planner presented the appeal to the Council. Mr. Nickel indicated that the applicant was brought back to Star City Council because the Ada County staff had initially approved the application, but there were changes made that prompted the staff to reverse their decision and - deny the application. The Council needed to be aware of that decision. Moved by Winkle and seconded by Embury to have the City Clerk or Mayor write the Ada County Commissioners a letter concurring with Ada County staff to deny this application. All Aye: motion carried. Council reports: a. Zoning Ordinance (Planning and Zoning) Committee-Kirtley, Winkle. Winkle advised the Council that they were working on the design standards and parking standards for the City. Other than those two areas the zoning ordinance is complete and will go to the public in the near future. They plan on another town meeting to discuss zoning in Star. b. Police Powers & Public Safety, (Animal Control, Curfews) John Embury: Embury reported that he has obtained Ordinances on curfews and animal control from Eagle and will be reviewing them until a future time. c. Area of Impact/Comp Plan-John Embury, Gussie O’Connor: Embury reported the progress on the committee’s efforts to complete a Star Comprehensive Plan d. Gem Community Committee report-Myron Amsden, Gussie O’Connor: Amsden advised the Council that they might be ready to introduce a resolution and members of the Committee at the next meeting. ITD (IDAHO STATE TRANSPORTATION) SIGNAL LIGHT – Corner of State Street (Hwy. 44) and Star Rd.,- speed limit reduction on State St. within the City Boundaries and signs at the corner of State St. and Star Rd. prohibiting parking of any vehicles over 6 ft. tall . Page 2 of 3 Discussion regarding the proposal took place by Council members. Amsden inquired about intersections that are obstructed by trees and shrubs. The City Clerk stated that ACHD would restrict such obstructions but that for vehicles the Council could choose to restrict vehicle height or restrict parking in certain areas altogether. Moved by Winkle and seconded by O’Connor to send the letter introduced tonight, but to keep in contact with State Transportation until these projects are completed. All Aye: motion carried. ATTORNEY REPORT: Dave Bieters reported on the progress toward franchises. He introduced a proposed ordinance for the council to review for the next agenda on Cable Franchises. After discussion the City Clerk was asked to contact Idaho Power and set up a special meeting to discuss an Idaho Power franchise. A memorandum was submitted to Council from Jerome Mapp regarding franchises. CITY CLERK’S REPORT: The City Clerk has no report at this time. CLAIMS AGAINST THE CITY: Moved by Amsden and seconded by Kirtley to approve the claims as presented. Motion carried. Moved by Winkle and seconded by O’Connor to adjourn. The time was 8:05 PM.
