CITY OF STAR
COUNCIL MEETING
AUGUST 21, 2000
The Star City Council met in regular session on August 21, 2000 at the Star Fire Station.
Mayor O’Connor presiding.
ROLL CALL: Benedict, Glasgow, Dias and Stegenga were present.
MINUTES: Moved by Dias, seconded by Stegenga to approve the August 1, 2000
meeting minutes with the following changes: page 2 under Water & Sewer Report – the
meeting lasted only seven minutes. It was not canceled due to no quorum. All aye:
motion carried.
PUBLIC INPUT: Glasgow thanked Dale Blake for his efforts with the city cleanup.
Mr. Blake stated that he has donated a trailer to the Sheriff’s Department so that they can
continue the cleanup work.
UNFINISHED BUSINESS:
A. Mule Days – There was no report.
B. Permits – Stegenga was unable to contact the inspectors, but will try to talk with
them and report back.
C. Area of Impact Discussion – The Mayor reported that on August 3, the Committee of
Nine met and came to an agreement on Star’s Area of Impact. On September 18th there
will be a Public Hearing on the ordinance and map for the Area of Impact. It was noted
that Ada County will hold its Public Hearing on October 11th.
NEW BUSINESS:
A. Public Hearing – Budget 2000-2001: The Mayor called the Public Hearing to
order. The Council members were asked if they had any conflicts of interest – they had
none.
The Mayor asked for comment from the public – there was none. The Mayor closed the
Public Hearing.
Councilman Dias discussed the carry over line item. Attorney Moore stated that the city
may have surplus dollars - we can accumulate cash balances and we don’t have to
appropriate money the City doesn’t intend to expend, but we need to have part of the
carry over money to operate the city until tax revenues come in and that part needs to be
budgeted and appropriated.
Discussion was held on how to move money into the carry over line item. Councilman
Dias moved to subtract $50,000 from the Building Inspector income line item and move
it to the carry over income line item. Stegenga seconded the motion. All aye: motion
carried.
The Mayor asked about the forgone amount. Attorney Moore stated that this relates to
property taxes and that we have three years to collect this amount, if the Council chooses
to do so.
ORDINANCES & RESOLUTIONS:
A. Ordinance #43 – Annual Appropriations - Moved by Glasgow and seconded by Dias
that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on
three different days, with one reading to be in full, be dispensed with and that Ordinance
No. 43 be considered after reading once by title only. All aye: motion carried.
Councilman Dias moved to amend the Ordinance and make a change in the title section
and section 3 it should read $100,000 in property taxes to be levied. Glasgow seconded
the motion. All aye: motion carried.
Councilman Glasgow read by title only Ordinance #43 An ordinance, to be termed the
annual appropriation ordinance of the City of Star, Idaho for the fiscal year commencing
October 1, 2000, and ending on September 30, 2001, appropriating sums of money in the
aggregate amount of $319,375 to defray all necessary expenses and liabilities of the City
of Star for said fiscal year; specifying the object and purposes for which such
appropriations are made and the amount appropriated for each object and purpose;
authorizing the certification to the County Commissioners of Ada County, Idaho the
amount of $100,000 in property taxes to be levied and assessed upon the taxable property
in the city; providing for the filing of a copy of this ordinance with the office of the Idaho
Secretary of State as provided by law; providing for publication; and providing an
effective date. Dias seconded the motion. Roll Call: Benedict – yes, Glasgow – yes,
Dias – yes, Stegenga – yes. Motion carried.
B. Ordinance #44 – Flood Plain Discussion – Councilman Stegenga discussed the
ordinance and that it just meets the FEMA rules. He stated that he is under the
impression that Eagle has a Flood Plain Ordinance that is one of the better ordinances and
that we should look at it.
The Mayor asked Attorney Moore to do comparisons with the FEMA and Eagle
Ordinance and report back to the Council.
Discussion was held on insurance requirements, existing loans and rates prior to an
ordinance. Attorney Moore stated that cities generally can’t be sued for not passing
ordinances.
REPORTS:
A. Mayor – The Mayor thanked the Blake’s for the clean up of the city and stated that
thank you letters would be sent out to all participants.
The Mayor attended the Association of Idaho Cities meeting on annexation matters.
Discussions were held about annexation and area of impacts. The Mayor read other
topics that were discussed. Attorney Moore also attended the meeting.
B. COMPASS – Councilman Stegenga attended the meeting this afternoon. Discussions
were about transportation and the Destination 20-20 plan. Items passed had conditions
for their projects. The City Clerk was asked to call and find out what the conditions
were.
C. Water & Sewer – Councilman Dias reported that the meeting was canceled and
moved to tomorrow at 5 pm. They will hold their budget hearing then.
D. Gem Committee – Councilman Benedict was unable to talk with Kathy Hutton for a
Report on Mule Days, but she did try to contact him.
Councilman Benedict is working on getting a high speed internet access in Star. They
need to find property to put up a tower.
Benedict is working with the library for training on the internet for senior citizens.
Stegenga stated that AT&T will need to make application for a franchise in Star, as they
have purchased Chambers Cable. A resolution is needed.
E. VIATRANS – Councilman Glasgow stated that there was no quorum for a meeting.
ADJOURNMENT: Councilman Dias moved to adjourn the meeting, Glasgow
seconded. All aye: motion carried. Meeting was adjourned at 8:13 p.m.
