CITY OF STAR COUNCIL MEETING MINUTES JUNE 5, 2001 A meeting of the Star City Council was held on June 5, 2001 at 7:00 pm at the Star Fire Station, Mayor Gussie O’Connor presiding. ROLL CALL: Benedict, Stegenga, Dias and Glasgow – all were present. AMEND AGENDA: Glasgow moved to amend the agenda adding item 12A – Exercise Option on Boyer Property, Dias seconded the motion. All aye: motion carried. MINUTES: Stegenga moved to approve the minutes of July 5, 2001 with the following correction: page 5 – Ordinance 55 was approved by roll call vote. Dias seconded the motion. All aye: motion carried. PUBLIC INPUT: Bill Sargent, 1087 W. State Street, Star, Idaho – Sargent stated he had four items for the Council: 1) he does not want to see an airport go in, 2) he wants to have a Recreation Center in Star, 3) he would like an accurate traffic report for State Street, 4) he would like to see flashing yellow lights at the cross walks on State Street. Heidi Carlson, 960 S. Main, Star, Idaho – With the new Zoning Ordinance, she would like to see a meeting be included with new developers and the neighborhood organization. Pam Leverett, 946 S. Main, Star, Idaho – Concurred with Carlson. Pat Freitag, 264 S. Main, Star, Idaho – Would like to know more about what is going on in Star, we need to get the information out to the citizens. Connie Spence, 486 S. Star Road, Star, Idaho – Spence commended the City Clerk for getting information out to the public. She would like to see new developers meet with the neighborhood group added to the Zoning Ordinance, as they want to be able to make comments. She would also like to have a pre-application subcommittee to work with the Zoning Ordinance. She would like the GCA grant monies to go to five-year planning rather than streetlights. Brad Carlson, 960 S. Main, Star, Idaho – He concurs with previous testimony. There are approximately 50 Star Neighborhood Alliance members. He has met with one of the developers and the developer would like a pre-application meeting. Cheryl Cronk, 1015 S. Main, Star, Idaho – She concurred with previous testimony and believes communication should go both ways. The Mayor stated that Attorney Susan Buxton has stated that the pre-application meeting with the neighborhood organization should be placed in the Subdivision Ordinance. 1 The Mayor also stated that the City will have the web page up very soon and information may be seen there and a newsletter will be forthcoming. The library has agreed to put a community bulletin board up in the library. PUBLIC HEARING: The Mayor opened the public hearing. Moore stated that the reason for the public hearing was to appropriate an extra $100,000 into the budget. This money does not incur any advelorum tax. The money will be used to purchase property for the City. The Mayor asked for public input. Brad Carlson, 960 S. Main, Star, Idaho – Stated that he believed this was good planning on the part of the City. Discussion was held on penalties for pulling the money out early. The City Clerk will find out if there are any penalties. UNFINISHED BUSINESS: A. Area of Impact – Discussion was held on density for the new areas for zoning. This issue will need to come before the Council in a public hearing. It was decided to notify all parties in the area regarding being included in the area of impact. We will need to notify Canyon County Commissioners, City of Middleton and citizens within 300 feet of the area affected. The public hearing will be held the second meeting in July. B. Findings of Facts and Conclusions of Law – Meadowbrook: Benedict moved to accept the Findings of Facts and Conclusions of Law for Meadowbrook, Stegenga seconded the motion. Glasgow asked if the legal description was correct, Clerk stated that it was. All aye: motion carried. C. Findings of Facts and Conclusions of Law – Rockbridge Subdivision: Benedict moved to accept the Findings of Facts and Conclusions of Law for Rockbridge, Dias seconded the motion. All aye: motion carried. NEW BUSINESS: A. Ada County Assessor, Marilee Fuller spoke to the Council regarding the assessments that have been sent out, market values and new construction rolls. B. Ada County Highway District, Dale Kaparis & Joe Roseland discussed the widening of Star Road and how the project would proceed. Kaparis stated that conduit would be included in the new road so that streetlights may be added. They stated that the Idaho 2  Transportation Department would like to remove all parking on State Street. The ditch will be piped along North Star Road. The project will start in October of 2002. ORDINANCES AND RESOLUTIONS: A. Ordinance No. 57 Amending Appropriation to Budget – Moved by Stegenga and seconded by Dias that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 57 be considered after reading once by title only. All aye: motion carried. Stegenga moved to approve Ordinance No. 57 an Ordinance amending sections one and two of Ordinance No. 43, adopted on August 21, 2000, the same being the annual Appropriation Ordinance of the City of Star for the 2000-2001 fiscal year, to appropriate the additional sum of $100,000 from un-appropriated cash balances of the City to the Capital Expenditures Budget, all in the manner provided by Section 50-1003, Idaho Code; and providing an effective date. Dias seconded the motion. Roll Call: Benedict – yes, Stegenga – yes, Dias – yes, Glasgow – yes; motion carried. B. Ordinance No. 58 Meadowbrook Annexation – Moved by Dias and seconded by Benedict that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 58 be considered after reading once by title only. All aye: motion carried. Dias moved to approve Ordinance No. 58 an Ordinance annexing to the City of Star certain real property located in the unincorporated area of Ada County, Idaho, and contiguous to the City of Star; establishing the zoning classification of the annexed property as R-3 Residential district; directing that certified copies of this ordinance be filed as provided by law; providing for related matters; and providing an effective date. Stegenga seconded the motion. Benedict – yes, Stegenga – yes, Dias – 7es, Glasgow - yes: motion carried. C. Resolution 01-4 Vendor Fees – Glasgow moved to adopt Resolution No. 01-4 a Resolution of the City of Star, Idaho, establishing daily permit for craft exhibitors and food vendors participating in the annual Mule Days celebration; providing for related matters; and providing an effective date. Dias seconded the motion. All aye: motion carried. CLAIMS AGAINST THE CITY: Glasgow moved to approve the claims against the City for May 2001. Benedict seconded the motion. All aye: motion carried. REPORTS: 3 Mayor – She reported that there will be a public hearing on June 21st for the Zoning Ordinance. If the public would like a copy it may be purchased at City Hall for $13.00 to cover the costs of copies or emailed to your address. We will be collecting for Ada County Highway District Impact Fees at City Hall now. Dias stated that there will be a Sewer & Water meeting on the 19th of this month and the Parks & Recreation meeting will be scheduled for the 27th or 28th. Dias stated that thanks to Dale Blake and Frank Cobb the playground equipment from Eagle has been brought to Star. Stegenga stated that he attended the COMPASS meeting on May 21st. City dues will be $1,452 next year. Treasure Valley Partnerships will be holding workshops and one will be held in Star on September 24th & 25th. Glasgow stated that ViaTrans is sending him to Oregon, Nevada and Utah to look at their programs for commuter busses. The Mayor stated that the City Clerk will be meeting with Idaho Power tomorrow regarding street lights. Benedict stated that he has met with Myron Amsden regarding the Gem Committee and has a re- application for the Gem Committee. EXECUTIVE SESSION: Benedict moved to go into Executive Session under Idaho Code, Statute 37-2345 (1)(f) Impending litigation, Dias seconded the motion. All aye: motion carried. The Executive Session was adjourned. EXECUTIVE SESSION DECISION: Stegenga moved to direct the Attorney to exercise the option on the property and to pay half the amount as agreed now and the other half in September for a total price of $165,000. Dias seconded the motion. ROLL CALL: Benedict – yes, Stegenga – yes, Dias – yes, Glasgow – no; motion carried. ADJOURNMENT: Dias moved to adjourn the meeting, Benedict seconded the motion.
