MEETING MINUTES
February 17, 2004
A regular meeting of the Star City Council was held on February 17, 2004 at the Star Fire
Station, the meeting started at 7:00 pm. Mayor Nathan Mitchell called the meeting to
order. Boy Scout, Dason Boyle lead the Pledge of Allegiance.
Councilman Christopherson, Bell with Councilman Erlebach being contacted by speaker
phone: all were present.
Mayor Mitchell stated that the agenda needed to be amended as Officer Ramage would
not be attending the meeting, with Meadowbrook Phase One bonding in place of 5-A.
Approval of Agenda: Bell moved to approve the Agenda as amended, Christopherson
seconded the motion. All aye: motion carried
Approval of Minutes: Bell moved to approve the Special Meeting Minutes of February
4, 2004, Erlebach seconded the motion. All aye: motion carried.
Old Business: Ordinance No. 100 Election Ordinance Designating Seats & Hours -
It was moved by Bell and seconded by Christopherson that pursuant to Idaho Code,
Section 50-902 the rule requiring an ordinance be read on three different days, with one
) reading to be in full, be dispensed with and that Ordinance No. 100 be considered after
reading once by title only. Roll Call: Christopherson, Bell, Erlebach - all aye: motion
carried.
Bell moved to approve Ordinance No. 100 an Ordinance of the City of Star, Idaho
establishing the hours of polling places for the City elections; providing for assignment of
Council Seats; repealing conflicting Ordinances; and providing for an effective date,
Erlebach seconded the motion. Roll Call: Christopherson, Bell, Erlebach- all aye:
motion can-ied.
Old Business: Bonding for Meadowbrook Phase I-Bell moved to accept the letter of
credit for Meadbowbrook Phase I, Christopherson seconded the motion.
The motion was withdrawn. Bell moved to accept the letter of credit in the amount of
$141,500 for Meadowbrook Phase I, Christopherson seconded the motion. All aye:
motion can-ied.
Public Hearings:
Country Time Assisted Living Conditional Use Permit - The Mayor asked Council if
there was any ex parte contact or conflicts of interest with this application. Hearing none,
the Mayor opened the public hearing and asked the applicant to speak.
Katie Hackney, 277 South Main, Star, Idaho stated that they have just completed the
eight bed facility and would like to expand to have six more beds. They are an assisted
living facility, which means minimal care.
Bell asked for parking clarification. Hackney stated that the patients do not drive, they
do have the appropriate number of parking spaces - currently there are seven in the back
and two in the front.
Craig Eckles, Zoning Administrator stated that no written comments were received.
There is a correction on the fourth page the time should read 10:00 pm to 7:00 am.
The Mayor asked for public input- Pam Leverett, 946 S. Main, Star, Idaho asked about
parking in the back. Mayor Mitchell stated that there were seven spaces in the back.
The Mayor closed the public hearing and asked the Council to deliberate.
Bell moved to approve the Conditional Use Permit to a fourteen-bed facility,
Christopherson seconded the motion.
Bell amended his motion to include all standard conditions of approval and items one
through three of staff recommendations, Christopherson amended his second. All aye:
motion caiTied.
) Phil & Deb McCune Conditional Use Permit for the Trolley -The Mayor asked Council
ifthere was any ex parte contact or conflicts of interest with this application. Hearing
none, the Mayor opened the public hearing and asked the applicant to speak.
Keith Loveless, Loveless Engineering, Boise, Idaho stated that the Moxie Java would
have a sound box, additional fences, curbs and gutters and there would be no other
lighting other than two bollard lights, the facility will have an angled approach.
Bell asked the hours of operation. The facility will be open from 6:00 am until I 0:00 pm.
Staff stated that the only written comment was from Darla Jean Martin in support of this
application.
There was no comment from the public.
The Mayor closed the public hearing and asked the Council to deliberate.
Christopherson moved to approve the Conditional Use Permit for Star Moxie Java with
conditions of approval and staff recommendations of one, two, four and five, Bell
seconded the motion. All aye: motion carried.

Estrella Condo Plat - The Mayor asked Council if there was any ex parte contact or
conflicts of interest with this application. Hearing none, the Mayor opened the public
hearing and asked the applicant to speak.
Kent Brown, Briggs Engineering 1800 W. Overland, Boise, Idaho stated that they are
asking to create condo offices at Estrella. These offices will be owned not leased now.
There will be ten units. Brown showed the Council a picture of what the offices would
look like.
Christopherson asked if anything else would change. Brown stated that it would not.
Staff reported no changes to the final plat or changes to the parcel. There were no written
comments.
There was no comment from the public.
The Mayor closed the public hearing and asked the Council to deliberate.
Bell moved to approve the Condo Preliminary and Final Plat for Estrella Subdivision,
Christopherson seconded the motion. Bell amended his motion to add the standard
conditions of approval and staff recommendations of one through five, Christopherson
amended his second. All aye: motion carried.
Flood Plain Ordinance Amendment - The Mayor opened the public hearing and
) explained to the public what the amendment was.
Staff read the FEMA Tech Bulletin regarding the lowest floor being at two feet above
base flood elevation.
The Mayor drew a diagram on the bulletin board explaining the base flood elevation.
Bob Moore, 4241 Cowboy Lane, Star, Idaho asked about grade and it being possible to
have a pond under your house. Mayor Mitchell stated that yes, you could have a pond
under your house.
The Mayor closed the public hearing and asked the Council to deliberate.
It was moved by Christopherson and seconded by Bell that pursuant to Idaho Code,

amending Ordinance No. 65 pe1iaining to the flood plain regulations amending
section 5.0 rules and definitions - addition of below-grade crawlspace definition and
lowest finished floor definition, amending lowest floor definition. Amending section 8.1

(b) general building requirements and adding (d) below-grade crawl space standards.
Amending section 8.2 anchoring (a). Amending section 8.5 specific standards -
residential construction- (a) 2-3, (b) non residential construction (1) (c) manufactured
homes. Amending section 8.6 applicability- (a) and providing for an effective date,
Christopherson seconded the motion. Christopherson, Bell, Erlebach - all aye: motion
carried.
The Mayor stated that the applications for the open Council position have been closed,
interviews will start tomorrow and next week. A short list will be presented to the
Council at the next meeting.
Adjournment: Christopherson moved to adjourn the meeting, Erlebach seconded the
motion. All aye: motion carried. The meeting was adjourned at 7:40 pm.
