Star City Council Meeting Minutes August 2, 2005 A regular meeting of the Star City Council was held on August 2, 2005 at the Star Fire Station. Mayor Nathan Mitchell called the meeting to order at 7:00 pm and all stood for the Pledge of Allegiance. Roll Call: Councilpersons Tammy McDaniel, Dustin Christopherson, and Tom Erlebach were present. Councilman Chad Bell was absent. Approval of the Agenda: Christopherson moved to approve the agenda, McDaniel seconded the motion. All aye: motion carried. Consent Agenda: McDaniel moved to approve the Consent Agenda consisting of Regular Meeting Minutes of July 19, 2005, Claims Against the City for July 2005, Finding of Facts and Conclusions of Law for Monroe Property Annexation and Zone and Star Village Conditional Use permit; Christopherson seconded the motion. All aye: motion carried. Public Input: No public input was given. Public Hearing: 2005-2006 Budget: Mayor Mitchell declared the public hearing for the 2005-2006 Budget open. Mayor Mitchell gave an overview of the proposed budget. The budget income is based on the projection of 400 building permits and an increase in various tax revenues. The City is looking at adding two new positions - a maintenance and operation /code enforcement officer and a full time planner position. Budget reflects adding a third peace officer; the third officer will be hired when needed. Inspectors’ contracts will be the same as last year. Legal counsel, Chris Yorgason, asked the Mayor to comment on the property tax rate. The tax levy rate will be minutely less than last year due to an increase in property value and the City taking the forgone amount. The Mayor asked for public testimony, hearing none, Mayor Mitchell closed the public hearing. Ordinances & Resolutions: Ordinance No. 128 Monroe Property Annexation & Zone: Mayor Mitchell explained Ordinance No. 128 and the location of the property. McDaniel moved that pursuant to Idaho Code, Section 50-902 the rule requiring an rdinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 128 be considered after reading once by title only, 1 Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, and Erlebach – all aye: motion carried. Christopherson moved to approve Ordinance No. 128 an Ordinance annexing to the City of Star certain real property located in the unincorporated area of Ada County, Idaho, and contiguous to the City of Star, establishing the zoning classification of the annexed property as residential (R-2) of approximately 26.73 acres; directing that certified copies of this Ordinance be filed as provided by law; providing for related matters; and providing an effective date, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson, and Erlebach – all aye: motion carried. Resolution No. 05-10 Emergency Building Permit Issuance: Mayor Mitchell explained the basis of Resolution No. 05-10 and why it was in front of the Council. It would allow building permits to be issued without a sewer and water permit being issued. No certificate of occupancy will be issued until a sewer and water permit is obtained from the Star Sewer and Water District and a copy brought to City Hall. Mitchell Johnson, 1066 W. Little Camas Ave., asked how many connections the District will receive from DEQ and questioned how they missed their projection and ran out of permits. Mayor Mitchell explained the District started expansion construction when the money was available. Building permit activity doubled in the first nine month of the fiscal year of what was projected for the entire year. The Sewer District is expecting to have 100 to 200 connections released around August 14th from the Attorney General’s Office and DEQ. This resolution will allow building to take place at the builders risk that water and sewer permits will become available in time to receive a certificate of occupancy. Darcell Sander, 1435 West 1st Street, questioned the amount of water and sewer connections to become available and clarification if they need them to build or just to receive the certificate of occupancy. Mayor Mitchell reiterated that builders will be allowed to pull a building permit and start construction, but only those receiving a sewer and water permit when they become available and giving a copy to the City will receive a certificate of occupancy. With the expectation of delivery in mid-September and the installation of the membrane filtration in place, DEQ will be more comfortable in releasing more hook-ups. The District expects additional connections to become available in October. Jack Warner, PO Box 67, Star, asked the Mayor how come he knew DEQ will issue permits and the Sewer and Water District did not. Mayor Mitchell stated he had received a call from the Sewer and Water District Council President, Jack Kirtley, around 5:15 informing him the Attorney General’s Office would be issuing a consent order August 14th releasing a certain amount of connections. The 2 District would issue sewer and water permits on a first come basis to those with certified plans at City Hall Georgia Mackley, 9601 W. State #203, Boise, pointed out they had originally been told they could not turn in plans for review and asked if it is now okay to bring them to the City; and would the Mayor be releasing a statement to the public. The Mayor stated yes, builders could bring in plans to the City and he would be happy to do a press release or mail a letter out to the builders stating how the City will facilitate building permits. Information on how sewer and water permits will be issued will need to come from the Sewer and Water District. Both Georgia Mackley and Darcell Sander felt putting a letter out would be a good idea. Christopherson felt the language in Section 1 “the District’s expansion project is completed and” was too restrictive and asked if it could be stricken out. The Mayor questioned the City Attorney as to whether the first sentence in Section 1 would need to be changed. Chris Yorganson stated it should be fine to remove the requested phrase and didn’t feel the first sentence would need to be changed. Yorgason pointed out the date needed to read August instead of July. Christopherson moved to approve Resolution No. 05-10, a Resolution of the City of Star, Ada County, Idaho, providing for the emergency issuance of building permits pending completion of expansions to the Star Sewer and Water District’s wastewater treatment system; and providing an effective date, McDaniel seconded the motion. Ordinance No 129 2005-2006 Budget Appropriations: Christopherson moved that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 129 be considered after reading once by title only, McDaniel seconded the motion. McDaniel moved to approve Ordinance No. 129 an ordinance, to be termed the Annual Appropriation Ordinance of the City of Star, Idaho, for the fiscal year commencing October 1, 2005, and ending on September 30, 2006, appropriating sums of money in the aggregate amount of $2,200,000.00 to defray all necessary expenses and liabilities of the City of Star for said fiscal year; specifying the object and purposes for which such appropriations are made and the amount appropriated for each object and purpose; authorizing the certification to the County Commissioners of Ada County, Idaho, the amount of $356,587.00 in property taxes to be levied and assessed upon the taxable property in the City; providing for the filing of a copy of this Ordinance with the office of the Idaho Secretary of State as provided by law; providing for publication; and providing an effective date, Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, and Erlebach – all aye: motion carried. 3 Reports: Legal Counsel, Chris Yorgason – nothing to report. Councilman Erlebach – nothing to report. Councilman Christopherson stated he attempted to get the website up – is waiting for the Mayor’s comments. Website should be up by next Council meeting. Councilwoman McDaniel informed the Mayor she would be unable to attend the Emergency Management Meeting this month and would be gone for the September 6th Council meeting. Mayor Mitchell informed the Council he has a marketing meeting tomorrow with local developers and realtors. Discussion items will include the sewer issue and lot sizes. The Sewer and Water District has a public hearing scheduled for August 9th for proposed fee increases. He attended a pre-hearing with the Department of Water Resources last Thursday regarding the City of Eagle’s applications for water rights. The City’s Area of Impact public hearing is scheduled for August 25th at 6:00 pm at the County Court House; the AOI Ordinance will be in front of the Planning and Zoning Commission.
