Star City Council Meeting Minutes December 20, 2005 The Pre-Council meeting was cancelled. Mayor Mitchell called the meeting to order at 7:00 pm and all stood for the Pledge of Allegiance. Roll Call: Councilpersons Tammy McDaniel, Dustin Christopherson and Chad Bell were present. Councilman Tom Erlebach was absent. Approval of the Agenda: Christopherson moved to approve the agenda, McDaniel seconded the motion. All aye: motion ca1Tied. Consent Agenda: The Consent Agenda consisted of Approval of December 6, 2005 Meeting Minutes, Findings of Facts and Conclusions of Law for: Gray/Small Property Annexation and Zoning and Rhoades Property Rezone, and Confirmation of setbacks for Heron River Development. It was moved by Bell and seconded by Christopherson to approve the Consent Agenda. All aye: motion carried. Public Input: Law Enforcement Report - Rod Marshall passed out a report for the Council and reviewed stats for the month. Public InP!!! - No public gave input. Public Hearings: Sanderson Development - Preliminary Plat - The Mayor explained that this application was cancelled and will be re-heard on January 3, 2006. The property was not posted properly. Bell moved to table this application and continue it until January 3, 2006, Christopherson seconded the motion. All aye: motion carried. Star City Development - Comprehensive Map Amendment - Rezone - The Mayor explained that this application was also cancelled and will be re-heard on January 3, 2006. McDaniel moved to continue the public hearing until January 3, 2006, Bell seconded the motion. All aye: motion carried. New Business: Pristine Meadows (Pavilion Commons) - Amended Final Plat - Wayne Forrey with Kastera Homes introduced Ken Fermage of Diamond Homes and Thomas Casino and :1 Paul Hilbig with Kastera Homes. 1 �. Mr. Forrey read a letter into the record thanking the Council and staff for adding Pavilion Commons to the agenda. They agree with findings and will comply with the recommendations. They are asking for approval of phase one and asked for 15-foot rear yard setbacks. Christopherson asked if the homes will range from 6,000 to 10,000 sq feet or does that mean lots. Forrey stated that those are the sizes of lots. Forrey stated that they have a video for public relations for Star, but is still not complete. They would like to come back in January. Bell moved to approve File #AFP-06-01 Amended Final Plat for Pristine Meadows (Pavilion Commons) with the 17 conditions - the 17'11condition being approval of the 15- foot rear yard setbacks, McDaniel seconded the motion. All aye: motion carried. Discussion/Approval of Streetlight location and expenditure - Council discussed the locations of the lights in question. Bell moved to leave the three lights where they are located, McDaniel seconded the motion. All aye: motion carried. Ordinances& Resolutions: Ordinance No. 142 Conner/Carson Prope1ty Annexation & Zoning-The Mayor stated ) that this would need to be tabled until January 17, 2006 due to the Development Agreement. Christopherson moved to table Ordinance No. 142 until January 17, McDaniel seconded the motion. All aye: motion carried. Ordinance No. 143 Gray/Small Annexation & Zoning - Christopherson moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 143 be considered after reading once by title only, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson and Bell - all aye: motion carried. Bell moved to approve Ordinance No. 143, an Ordinance annexing to the City of Star certain real property located in the unincorporated area of Ada County, Idaho, and contiguous to the City of Star, establishing the zoning classification of the annexed property as Residential (R-2) of approximately 13 acres; directing that ce1tified copies of this Ordinance be filed as provided by law; providing for related matters; and providing an effective date, Christopherson seconded the motion. Roll Call: McDaniel, Christopherson and Bell - all aye: motion carried. Ordinance No. 144 Electrical Ufer Concrete - McDaniel moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 144 be considered after reading once by title only, Bell seconded the motion. Roll Call: ) McDaniel, Christopherson and Bell - all aye: motion carried. 2 ' ') Christopherson moved to approve Ordinance No. 144 an Ordinance of the City of Star, a municipality of the State ofldaho, adopting primary ground electrode guidelines; providing for severability; repealing any conflicting ordinances; and providing for an effective date, Bell seconded the motion. Roll Call: McDaniel, Christopherson and Bell - all aye: motion carried. Ordinance No. 145 Rhoades Property Rezone - Christopherson moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 145 be considered after reading once by title only, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson and Bell - all aye: motion carried. McDaniel moved to approve Ordinance No. 145, an Ordinance rezoninf certain real property located in the City of Star, Ada County, Idaho, at 11470 W. 3r Street, to Residential (R-4) from Rural Transitional (RT) and Residential (R-2) classifications; amending the Zoning Map of the City of Star to reflect such changes; and providing an effective date, Bell seconded the motion. Roll Call: McDaniel, Christopherson and Bell - all aye: motion carried. Reports: Bell stated that the playground equipment should be arriving and we will need to store it until we can put it together. Ward asked if the Council wanted her to look for funding for a gazebo for Blake Haven Park. They would. Mayor stated that we have several annexations coming up. The Council Workshop on January 20th will staii at 1:00 and will go until 4 pm on Saturday. We will be before the Ada County Commissioners on December 28th for our Area of Impact. Adjournment: Christopherson moved to adjourn the meeting, Bell seconded the motion. All aye: motion carried. The meeting was adjourned at 7:45 pm.
