Star City Council Meeting Minutes July 15, 2008 The regular meeting of the Star City Council was held on July 15, 2008 at the Star City hall. The pre-Council meeting began at 6:30 pm. Pre-Council: Allied Waste Presentation – Rachele Klein from Allied Waste discussed fuel savings for their company. Klein discussed increased fuel costs. A list of what Allied Waste is doing to save fuel was given to the Council. They would like to start October 1st with mandatory garbage pick up and would like the Council to okay a ninety-five cent increase to the garbage customers. Dave Fisher, 22900 Conrad Court, Middleton, also with Allied Waste, discussed having everyone use wheeled carts. He discussed the benefits of using these carts. Council President Bell stated that they would get back to Allied with a decision. Police Budget Presentation/Monthly Report – Chief Ramage presented the monthly report and stated that crime is down in Star. Budget Report – The Chief introduced Dr. Amy Anderson. She is the person who helped put all the statistics together for the Sheriff’s office. Handouts were given to the Council showing budget requirements. Chief Ramage is requesting a fourth officer. The final budget number is $501,202. Regular Council Meeting: Council President Chad Bell called the regular meeting to order and all stood for the Pledge of Allegiance. The meeting was convened at 7:12 pm. Roll Call: Council persons Tammy McDaniel, Dustin Christopherson, Tom Erlebach and Chad Bell were all present. Mayor Nathan Mitchell was absent. Approval of the Agenda: Christopherson moved to approve the Agenda, Erlebach seconded the motion. All aye: motion carried. Consent Agenda: The Consent Agenda consisted of Meeting Minutes of June 17, 2008, Special Meeting Minutes of June 23, 2008, Time Extension Requests for: Duntisborne Subdivision and Pavilion Subdivision; Findings of Fact & Conclusions of Law for Fat City Fireworks Conditional Use and the Final list of Claims Against the City for June 2008. McDaniel moved to approve the Consent Agenda, Christopherson seconded the motion. All aye: motion carried. Public Input /Presentations: Committee Reports – Gary Smith, Economic Development Chair stated the committee did not meet this month as they are asking for a special workshop meeting with the Council. They have a preliminary plan to present to the Council. Palmer Natural Products were interviewed by the “Idaho Business Review”, a copy of the article has been given to the Council. Palmer’s time line has been pushed out just a little to October and November. Smith has been working with Boise Valley Economic Partners. He attended the FAM meeting and has been attending the regular meetings. Smith stated that the Mayors of Star and Eagle are looking at a Tech corridor between Eagle and Star encouraging tech in the area. Public Input: Emily Ducket, 3521 S. Arcaro, Meridian, stated that she was with Kastera and thanked the Council for their time extension and stated it was a pleasure working with staff. Justin Walker, Keller Associates, Meridian, Idaho, also thanked the Council and stated that it was a pleasure to work with staff. Public Hearings: Covered Load Ordinance – Council President Bell reviewed public hearing procedures. He then explained the Covered Load Ordinance, stating that it would cover all loads on the road and give law enforcement authority to cite persons with uncovered loads. Public Input – Kevan Wheelock, 1481 N. Star Road, Star, asked if this applied to beet trucks and farmers. Council President Bell stated that there was an agriculture exception in the ordinance. Council - Erlebach asked Chief Ramage if this is a concern. Ramage stated that he didn’t know of any citations that had been issued for this, but there have been numerous complaints. Bell stated that there have been two fatalities due to unsecured and uncovered loads. Bell closed the public hearing. Supervision of Juveniles Ordinance – Bell opened the public hearing and asked Chief Ramage to explain the ordinance. Chief Ramage stated that the ordinance gives Law Enforcement a tool to cite the parents for not controlling their children. This ordinance is working very well in surrounding cities. Public – No public spoke. Council President Bell asked Council for questions, hearing none he closed the public hearing. Electrical/Mechanical/Plumbing Resolutions – Dennis Holte, Plumbing Inspector for Star explained that the State of Idaho has changed their fees and Inspectors wanted to keep everything uniform. There are a few differences than the State, but they fall in line with what the fees were before. Public – Having no comments from the public or Council, Council President Bell closed the public hearing. Ordinances & Resolutions: Ordinance No. 188 Covered Loads - McDaniel moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 188 be considered after reading once by title only, Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. McDaniel moved to approve Ordinance No. 188, an Ordinance prohibiting the transportation of uncovered loads, insuring that the load does not drop, sift, leak or otherwise escape from the vehicle, Erlebach seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Ordinance No. 191 Juvenile Enforcement - McDaniel moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 191 be considered after reading once by title only, Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Christopherson moved to approve Ordinance No. 191, an Ordinance of the City of Star, Idaho adopting regulations for the supervision of juveniles within the corporate limits of the City of Star; providing parental responsibility, police authority, violations, severability; and providing an effective date, Erlebach seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Resolution 2008-10 Electrical Fees – Christopherson moved to approve Resolution 2008- 10 a Resolution of the City of Star, Idaho, establishing a schedule of fees for electrical permits and inspections pursuant to the fees of the State of Idaho Electrical Code; repealing Resolution 2002-04 adopted on March 18, 2004; and providing an effective date, Erlebach seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Resolution 2008-11 Plumbing Fees – McDaniel moved to approve Resolution No. 2008- 11, a Resolution of the City of Star, Idaho, establishing a schedule of fees for plumbing permits and inspections pursuant to the fees of the State of Idaho Plumbing Code; repealing Resolution 2000-13 adopted on December 5, 2000, Resolution 2006-4, Section 3 adopted on February 8, 2006; and providing an effective date, Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Resolution 2008-12 Mechanical Fees – Christopherson moved to approve Resolution 2008-12, a Resolution of the City of Star, Idaho, establishing a schedule of fees for mechanical permits and inspections pursuant to the fees of the State of Idaho Mechanical Code; repealing Resolution No. 03-01 adopted on February 4, 2003 and Resolution 2006- 04, Section 2 adopted on February 8, 2006; and providing an effective date, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell – all aye: motion carried. Reports: Staff – A Budget Workshop will be held on July 29th at 7pm. The new web page should be done by August 1. Council - McDaniel stated that she received a call from a concerned citizen complaining about weeds at Star & State. Shaw-Taylor stated that letters have gone out about weeds and the owners of the property have been contacted several times. Christopherson state that he attended the BVEP FAM trip. This is a familiarity trip for outsiders to relocate in Idaho. Erlebach stated that he met with Ward and Connie Hill regarding parks and recreation. They reviewed concerns. Erlebach stated that there was a letter in packets regarding events at the fairgrounds from Julia Fenwick on July 26. Bell stated he would be attending the Board of Directors meeting for Valley Regional Transit tomorrow. They are working on legislation for next year. They are also looking at purchasing a second bus.
