Star City Council Meeting Minutes February 19, 2019 The regular meeting of the Star City Council was called to order at 7:00 pm at the Star City Hall, 10769 W. State Street, Star, Idaho. Mayor Charlten Bell called the meeting to order and all stood for the Pledge of Allegiance. Roll Call: Councilmen David Hershey, Michael Keyes, Trevor Chadwick and Kevin Nielsen were all present. Approval of the Agenda: Chadwick moved to approve the agenda as it stands, Keyes seconded the motion. Chadwick amended this motion to add to the agenda 5C – the introduction of the new Detective and 5D – the introduction of the new Planner, Keyes amended his second. All ayes: motion carried. Consent Agenda: Chadwick moved to approve the Consent Agenda consisting of: Regular Meeting Minutes of January 15, 2019, Workshop Notes of January 8 & 22, 2019, Claims Against the City for January 2019, Appointment of Julie Olson, Josh Austin and Sara Keyes to the Activities Committee, Appointment of Simon Mahler to the Economic Development Committee, Appointment of Chris Todd to the Transportation Committee and Findings of Fact and Conclusions of Law for Iron Mountain Ridge Subdivision, Star Elementary School and Martial Arts, Final Plat for Sailing Hawks Subdivision and Final Plat for Parkstone Subdivision, Phase 12. Keyes stated that under the January 15 minutes the discussion of the surplus property amount should be $65,000 not $60,000. Keyes seconded. All ayes: motion carried. Presentations/Public Input: Corey Dryden – Frisbee Golf Presentation: The Mayor stated that Mr. Dryden is ill, so the presentation has been moved to the March 5th Council agenda. Public Input: Chris Todd, 53 N. Plummer Road, Star, asked to discuss the ITD right-of-way through Star. There are people wanting to do something along State Street. He has heard three different numbers for this right-of-way. The Mayor stated we would discuss this. New Detective: Chief Vogt stated that Marc Bowman has received an advancement opportunity down at Barrister and Neil Daigle will be Bowman’s replacement as the City’s Detective. Chief Vogt stated that prior to coming to Star, Daigle has been the North Star Deputy. He has skills and the mentality to fit in with Star. Daigle will handle all felony crimes for Star. Daigle stated that he was born and raised in Caldwell. He has been the N. Star officer for two years. He stated that Star was close to the community he grew up in. New City Planner: The Mayor introduced Shawn Nickel. Nickel will be the City’s full-time Planner. Nickel started out as a Planner for a government agency and has also worked in the private sector. The Mayor stated that we are thrilled Nickel was able to join us in Star and help plan our City. Nickel is part-time this month and will be full-time in March. 1|Page Old/New Business: Public Hearing: Moon Valley Subdivision. The Mayor explained that we need to table the Moon Valley Subdivision to the March 19, 2019 meeting. Chadwick moved to table the public hearing to March 19, 2019 for the Moon Valley Subdivision, Hershey seconded the motion. All ayes: motion carried. Public Hearing: Annexation and Zoning to Residential (R3) of 11810 W. New Hope Road. The Mayor reviewed the public hearing procedures. The Mayor declared the public hearing open and asked Council for any ex parte contact or conflicts of interest. Hearing none, the Mayor asked the Applicant to speak. Applicant: Kent Brown, Kent Brown Planning, 3161 E. Springwood Drive, Meridian, stated that this parcel is one acre and will be part of a larger development that had to be tabled due to posting issues. By annexing this parcel, the entire frontage along New Hope will be developed instead of leaving an enclave parcel. There has been an old house along with a trailer house on the property, these will be removed. They would like to add this to the entire project and asked the Council for approval. Most of this property and more of the frontage along New Hope will be Ada County Highway District right-of-way. Staff: One additional letter was received from the Idaho Transportation Department. Public Input: No public input was given. The Mayor closed the public hearing. The Applicant did not have anything to add. Nielsen moved to approve File #AZ-19-01, the Annexation and Zoning of Residential (R3) of 11810 W. New Hope Road with the three standard conditions, Chadwick seconded the motion. All ayes: motion carried. Public Hearing: Trapper Ridge Subdivision. The Mayor stated that there were posting issues and this application will need to be tabled to the 5th of March. Keyes moved to table the public hearing of the Trapper Ridge Subdivision to March 5, Hershey seconded the motion. All ayes: motion carried. Ordinance No. 282 Amazon Falls II – Chadwick moved that pursuant to Idaho Code, Section 50- 902 the rule requiring an Ordinance to be read on three separate days, with one reading to be in full, be dispensed with and that Ordinance No. 282 be considered after reading once by title only, Keyes seconded the motion. Roll Call: Hershey – aye, Keyes – aye, Chadwick – aye, Nielsen – aye: motion carries. Chadwick moved to approve Ordinance No. 282 Amazon Falls II, an Ordinance annexing into the City of Star certain real property owned by the Miller Family Trust, in the unincorporated 2|Page area of Ada County, Idaho, and contiguous to the City of Star, located at 7672 & 7884 W. State Street, Ada County Parcel Numbers R3720000151 and R3720000105, establishing the zoning classification of the annexed property as Mixed Use (MU) with a Development Agreement of approximately 19.66 acres; directing that certified copies of this Ordinance be filed as provided by law; providing for related matters; and providing an effective date, Keyes seconded the motion. Ordinance No. 283 River Birch Golf Course – Nielsen moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three separate days, with one reading to be in full, be dispensed with and that Ordinance No. 283 be considered after reading once by title only, Keyes seconded the motion. Roll Call: Hershey – aye, Keyes – aye, Chadwick – aye, Nielsen – aye: motion carries. Nielsen moved to approve Ordinance No. 283 River Birch Golf Course, an Ordinance annexing to the City of Star certain real property owned by Carney’s River Birch LLC, in the unincorporated area of Ada County, Idaho, and contiguous to the City of Star, located at 3740 N. Pollard Lane, Ada County Parcel Numbers R8525440021 and R8525440010 and R8525440400, establishing the zoning classification of the annexed property as Mixed Use (MU) and Residential (R2) of approximately 189.92 acres; directing that certified copies of this Ordinance be filed as provided by law; providing for related matters; and providing for an effective date, Keyes seconded the motion. All ayes: motion carried. Reports: Staff – Chief Vogt stated he had nothing beyond the new detective. Council – Hershey stated that due to the government shutdown, he did miss the fire meeting. The Activities Committee is meeting this Thursday. Keyes stated that he attended the City Officials Day at the Capitol where they reviewed proposed legislation. Items coming up are liquor license reform, campaign reform, transportation initiative, discussion of other tax issues and they had lunch with the Legislators, it was a good day. His Committee has been busy, they recognized a volunteer and hoped everyone saw the new sign out front. We should have signs out maybe in a couple weeks. Keyes attended the Open House for Sewer and Water District’s new well and listened to their project to improve the treatment plant so they are in compliance. The Council participated in the canned food drive with their own design. He also serves on the Air Quality Board, they have new software and it will save taxpayers money. Chadwick stated he also participated in the canned food drive, he attended the Threads Open House by Helina Marie’s. The Pathways Committee will be moving forward, and it will be nice to have a planner on his committee to help with pathways. The Mayor, Nickels, Szplett and himself met with ITD. They continued to go over the area between Plummer and Highway 16. There are different ideas with lights and turns. The Idaho Transportation Department has let them know about how the right-of-way will impact the City. We need to know how we want to plan our City. 3|Page Nielsen stated that regarding committees, he is pleased with activities and excited about Simon Mahler. Nielsen also attended the Idaho Cities Day with Legislators and he did sit next to Mr. Keyes. It was a great discussion on state legislation. Mayor – The Mayor had a meeting with Keyes and Olson and one of the items that was discussed was the decorative streetlights along Highway 44. Most have brackets to hold flags, we don’t have the flags. Looking at possibly getting more brackets and flags. It looks like $2200-2300 shortfall in purchasing these. The Mayor will talk to the Star Lions about what they want to do. Also, he thanked the Councilmen that went to the Capitol. Keyes stated there is a bill being proposed for local elections that will require declaring a party, he is not sure why it’s being proposed. It creates division. Be aware of this bill and let the Legislators know how you feel. Next Monday, the Mayor stated that he will be hosting all the Mayors in the valley and will be discussing several issues. The City is continuing to work on the Unified Development Code. Mark Butler is working on the Comp Plan and has several open houses scheduled. Nielsen asked if we set aside money for converting all lights at City Hall. The Mayor stated that the lights have been done and it will take about 18 to 19 months to pay for the change-over.
