CITY OF STAR, IDAHO CITY COUNCIL REGULAR MEETING MINUTES City Hall - 10769 W State Street, Star, Idaho Tuesday, April 04, 2023 at 7:00 PM 1. CALL TO ORDER – Welcome/Pledge of Allegiance Mayor Chadwick called the meeting to order at 7:00 pm. 2. INVOCATION – Pastor Tim Nay, LifeSpring Church Pastor Nay was unavailable, so an American Legion representative led the invocation. 3. ROLL CALL Elected Officials: Council President David Hershey, Council Member Kevan Wheelock, Mayor Trevor Chadwick, Council Member Jennifer Salmonsen and Council Member Kevin Nielsen. Staff: City Attorney Chris Yorgason, City Clerk – Treasurer Jacob Qualls, City Planner Shawn Nickel, City Engineer Ryan Morgan and Public Information Officer Dana Partridge, Star Police Chief Zach Hessing and Star Deputy Fire Chief Victor Islas. 4. PRESENTATIONS A. Star Police Report - February 2023 - Chief Zachary Hessing Chief Hessing gave his February 2023 Police Report. B. American Legion Check Presentation - For the Mayor's Youth Council Scholarship Fund American Legion Fred Web, commander of Post 39 introduced other members of the American Legion. Commander Web then presented Mayor Chadwick a check in the amount of $1,000 for the Mayor’s Youth Council Scholarship program. Chadwick explained the city had 19 scholarship applications from Star Seniors graduating from local high schools this year. 5. CONSENT AGENDA (ACTION ITEM) A. Approval of Claims: B. Findings of Fact / Conclusion of Law: First Street Townhomes Subdivision (FILE: PP-22-16 / PR-22-07) C. Findings of Fact / Conclusion of Law: Star River Ranch North Subdivision (FILE: RZ-22-01, DA-22-03, PP-22-05)  Council Member Salmonsen moved to approve the Consent Agenda; Council President Hershey seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. 6. PUBLIC HEARINGS with ACTION ITEMS: A. PUBLIC HEARING: Oliver Estates Subdivision (FILE: AZ-22-01, DA-22-01, PUD-22-01, PP-22-01) - The Applicant is seeking approval of an Annexation and Zoning (R-3-DA), Development Agreement, Planned Unit Development and Preliminary Plat for a proposed residential subdivision consisting of 88 residential lots, 2 office lots (PUD) and 16 common lot. The property is located at 22491 N. The applicant has requested this item be tabled until April 18, 2023. (ACTION ITEM)  Council Member Wheelock moved to table the Public Hearing for Oliver Estates Subdivision to April 18, 2023; Council Member Salmonsen seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. B. PUBLIC HEARING - Naismith Commons Subdivision (FILES: AZ-22-10, DA-22-11 & PP-22-15) (The application was tabled on March 7, 2023 to March 21, 2023 and again to April 4, 2023 to allow the applicant time to redesign the preliminary plat. This item is being postponed to April 18, 2023 at Staff Recommendation. (ACTION ITEM)  Council President Hershey moved to table the Public Hearing for Naismith Commons Subdivision to April 18, 2023; Council Member Wheelock seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. 7. ACTION ITEMS: A. Freedom Park Construction Agreement - Approve / Authorize to Sign (ACTION ITEM) Mayor Chadwick pulled the Freedom Park Construction Agreement from the agenda indicating it was not ready at this time. B. Temporary License Agreement - ACHD (Signal Cabinet Art Wraps) - Approve / Authorize to Sign (ACTION ITEM) Council Member Salmonsen explained this was a similar agreement the city had signed last year. The locations of the boxes are in front of Star Elementary School; at State Street and Highbrook and to replace the one at the intersection of Star Road and State Street to better match the community at this time. Council Member Nielsen asked if the city was going to have a theme for the artists. Council Member Salmonsen indicated there would be a theme and would be similar to previous years projects. Council Member Wheelock asked if the project could be a photograph or just a drawing, Council Member Salmonsen indicated it would up to the panel of judges.  Council Member Salmonsen moved to approve and authorize the mayor to sign the Temporary License Agreement for the ACHD Signal Cabinet Art Wrap; Council President Hershey seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. Mayor Chadwick thanked everyone for donating eggs for the Eggstravaganza put on by the Star Chamber of Commerce and close to 30,000 eggs have been donated and he encouraged the community to come out for the event. Executive Session: 74-206 (c): To acquire an interest in real property not owned by a public agency (ACTION ITEM)  Council Member Nielsen moved to proceed into Executive Session 74-206 (c) to acquire an interest in real property not currently owned by the City of Star; Council Member Salmonsen seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. Mayor Chadwick, Council President Hershey, Council Members Kevan Wheelock, Jennifer Salmonsen and Kevin Nielsen and City Attorney Chris Yorgason, City Clerk – Treasurer Jacob Qualls and City Planner Shawn Nickel went into executive session at 7:18pm. Mayor Chadwick, Council President David Hershey and Council Members Kevan Wheelock, Jennifer Salmonsen and Kevin Nielsen and present staff came back into regular session at 7:42pm Action Items after Executive Session (If appropriate)  Council Member Kevin Nielsen moved to authorize the city to negotiate the purchase of real property up to and including the amount discussed in executive session; Council President Hershey seconded the motion. ROLL CALL VOTE: Hershey – aye, Wheelock – aye, Salmonsen – aye, Nielsen – aye. Motion carried. 8.
