City Council Regular Meeting- EMERGENCY MEETING

STAR CITY COUNCIL EMERGENCY MEETING MAY 19, 2011 An emergency meeting of the Star City Council was held on May 19, 2011 at the Star City Hall at 1:00 pm. Mayor Nathan Mitchell called the meeting to order. Roll Call: Councilman Gary Smith and Tom Erlebach were present; Councilman Chad Bell was present via telephone. Approval of Flood Plain Ordinance: The Mayor stated that the meeting was called to order to approve the Flood Plain Ordinance, and due to the time requirement from FEMA we need to adopt this or make changes. Shawn Nickel, 1589 N. Estanica, Eagle, Idaho, explained the changes to the Flood Plain Ordinance. A majority of the changes were definitions that FEMA requested. Nickel explained that FEMA has a model ordinance that they want all communities adopting. Other changes were: designating a Flood Plain Administrator and designating out the two feet above base flood elevation as the Flood Protection Elevation. The Mayor asked for questions. Smith asked if this was already in place were we not in compliance. The Mayor stated that we were, FEMA just wanted it to be in their format. Smith asked who policed the ordinance. The Mayor stated that if it is with a building, then our Building Inspector will review it and then it goes on to our Engineer. Smith asked who maintains the levies. The Mayor stated that we don’t have any levies. Erlebach asked about ponds and displacing water. The Mayor stated that if someone creates a pond in the flood district, they need to apply for a redevelopment permit and meet the no net clause. If they fail to do that, they are guilty of a misdemeanor. Smith asked if everything at the River Walk was approved. The Mayor stated that it had been through all the permitting process. Bell moved that pursuant to Idaho Code, Section 50-902 the rule requiring an Ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 218 be considered after reading once by title only, Erlebach seconded the motion. Roll Call: Smith, Erlebach, Bell – all aye: motion carried. Erlebach moved to approve Ordinance No. 218, an Ordinance of the City of Star, Idaho, a Municipal Corporation of the State of Idaho, amending Star City Code Title 10, “Flood Control”, Chapter 1 “Flood Control Regulations”, Sections 1, 5, 6, 8, 9, 10 and 11; providing a repealer 1 clause; providing for severability; and providing an effective date, Smith seconded the motion. Roll Call: Smith, Erlebach, Bell – all aye: motion carried. Adjournment: The Mayor adjourned the meeting at 1:45 pm.
