) Special Star City Council Meeting Minutes A special meeting of the Star City Council was held on October 19, 2004 at 8:00 pm at the Star Fire Station. Mayor Nathan Mitchell called the meeting to order and all stood for the Pledge of Allegiance. Roll Call: Council persons Tammy McDaniel, Dustin Christopherson, Tom Erlebach and Chad Bell were all present. Approval of Agenda: The Mayor stated that there were additions to the agenda. The Halloween Proclamation will be added to the Consent Agenda as 3-E; Public Input will be added to Special Reports as 4-C; and the Executive Session will be moved to #8 with adjournment to follow. Bell moved to approve the agenda as amended, Christopherson seconded the motion. All aye: motion carried. Consent Agenda: Christopherson moved to approve the Consent Agenda, McDaniel seconded the motion. All aye: motion carries. The Consent Agenda consisted of: Approval of the October 5, 2004 Meeting Minutes, Claims Against the City of October 2004 (a partial list), Estrella II Final Plat, Estrella II Condominium Plat and the Halloween Proclamation. Special Reports: ) Law Enforcement Report - Deputy Ken Ramage gave his report on the past month's law enforcement activities;-Local gang activities were discussed, the Council asked to be kept apprised of any increasing activities. Area of Impact Discussion - The Mayor gave a brief update on the Area of Impact meeting that was held earlier in the evening with the Ada County Commissioners and the citizens of Star. Another meeting will be scheduled between the Mayor and Council and the Ada County Commissioners very soon. Bell asked that the meeting be scheduled after 5 pm if possible. Public Input - John Priester, 262 N. Hullen Place, Star, Idaho wanted to point out and has experienced the unsafe speed limit in the City limits. He wants the speed to be either all 35 or all 45 mph instead of different speed limits going in different directions. The Mayor stated that the Idaho Transportation has been asked to move the signs back to the City limits. Jeannie Nail, 1011 S. Star Road, Star stated that she has mentioned it before- there are houses looking like junkyards and high weeds. Who is responsible for high weeds along road? The Mayor stated that the Highway District is responsible for their right of ways. John Moody, Estrella Subdivision - stated that he would like the speed signs changed. They will have to apply for a variance for driveways with ITD. He would like to see the speed limit down to 35 mph to help with getting approval for the driveways.  Public Hearing: Animal Control ) The Mayor opened the continuation of the public hearing. Staff - no comment. Pam Leveritt, 946 S. Main, Star, Idaho explained that the width of her lot which is 90 feet- and asked if the Council will make an exemption for lot size. Bell reminded Leveritt of the grandfather rule regarding animals now. Chris Yorgason, legal counsel added that the City does have a process to grant a variance, if needed, which will be determined on a case-by-case basis. Dennis Stegenga, 290 S Star Road, Star, Idaho thanked Council for making changes as requested. There are a few grammatical errors that need to be corrected and has provided those corrections to the City Clerk. Stegenga pointed out that Section 4 has a conflicting statement regarding non-domestic animals and the fees resolution does not address lost dog licenses and cost. The Mayor closed the public hearing. Council agreed to leave the wording in the Ordinance and provide a fee in the Resolution. Pam Leveritt, 946 S. Main, Star, Idaho asked for clarification of a horse on a half acre - does that mean the horse is the only thing on the half acre. The Mayor stated that a half-acre is ) required for maintaining a horse. McDaniel suggested wording in Section 5-c should be replacement license tag. Christopherson moved that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that the Animal Control Ordinance be considered after reading once by title only, Bell seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach and Bell - all aye: motion carries. Bell moved to approve the Animal Control Ordinance an Ordinance of the City of Star, Idaho, adopting animal control regulations within the corporate limits of Star; providing for definitions, cruelty, maintenance, licensing, at large, noise, enforcement, repealer and providing for an effective date, including changes as discussed, Erlebach seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach and Bell - all aye: motion carries. Animal Control Fees Resolution - Council agreed to add a replacement license fee, which will be half the cost of a new license. Old Business: Speed Limits in City Limits - The Mayor discussed increasing speed limits on areas where there is no development. Bell believes we need to be consistent on both sides of road. McDaniel ) asked how we are going to get people to slow down especially areas like the day care. Yorgason 2  <• suggested that the City involve the Idaho Transportation Department. Christopherson stated that an option would be to change the wording in the ordinance and define where signs are placed by resolution. John Moody, Estrella Subdivision stated that the ordinance says 35 mph in city limits. The developments are in 45 to 50 mph area and the Idaho Transportation Department (ITD) makes their determination on that speed zone. It should be either be 35 mph in City limits or change the ordinance. Becky McKay, Engineering Solutions, stated that ITD is restricting developers on driveways when speed limits are higher. McKay did pose the question to residents regarding the 35 mph speed limit and all want the 35 mph. The Mayor will bring this issue back to Council. New Business: Steven Springs Fencing- Staff reported that this has been withdrawn at this time. Council Workshop Discussion - Christopherson proposed conducting a workshop once a month. Bell wants to see workshops on a quarterly basis, maybe monthly for a while. Christopherson believes they are needed. Bell does not want to have another meeting, we have the option of a pre-council meeting. It was agreed to have workshop meetings at pre-council meetings when ) needed. The Mayor stated that there were two other items, but they will be put on the next agenda. Mary Overstreet of the Transportation Committee stated that the Transportation meeting with ACHD and City of Star will be Tuesday at the Star Fire Department. Executive Session: Bell moved to go into Executive Session under ICS 67-2345 (l)(b) Personnel, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach and Bell - all aye: motion carried. Council moved out of Executive Session into Regular session.
