Star City Special Council Meeting Minutes March 9, 2006 The Mayor called the meeting to order at 7:00 pm at the Star Elementary School and all stood for the Pledge of Allegiance. Roll Call: Council persons Tammy McDaniel, Dustin Christopherson, Tom Erlebach and Chad Bell were all present. Public Hearing: Annexation & Zoning - Sanderson Property The Mayor explained the process of the public hearing and asked the Council for any ex parte contact or conflict of interest. The Mayor disclosed that he spoke with Kristin Battey on the procedure of the public hearing and with Sandy Sanderson regarding the possible location of an elementary school on the site. Hearing no conflicts from the Council, the Mayor opened the public hearing. Applicant - Sandy Sanderson, introduced engineers Matt Weaver and Laren Bailey and AJ Tony Bohner as his legal counsel. Laren Baily, W&H Pacific, 3130 S. Owyhee, thanked the Council and staff for their help. Bailey explained the colors on the map as areas being annexed. The application is for 93 acres which has been used as agricultural land. They are requesting an R-4 designation - four units to an acre. They believe it meets the intent of the Comprehensive Plan. This is just west of the Orion Park Subdivision with the Lakeshore Subdivision to the south and to the east there are 5 to 10 acre parcels. Some of the amenities will be a neighborhood club house and pool; there will be a mix of housing types and attractive landscaping with more open space. Utilities, including water and sewer services will be coming down Munger Road to Orion Park. It will also tie into a pressurized pump station at Lakeshore. There are no other issues with services. He believes this is a good project that will provide diversity and different styles of housing. Christopherson asked about percentage of open space. Bailey could not comment as a school site has been discussed and it will impact their open space options. AJ Tony Bohner, 6061 Tonkin Drive, Boise, stated that he would like to speak briefly to the letters from neighbors who are concerned where Star is going and the Comprehensive Plan. Applicant meets the requirements of the Comprehensive Plan; he understands there are concerns about redoing the Comp Plan. There is one in place and the staff report has mentioned that it does comply with Comp Plan Map. It is consistent and compatible with zoning designations, does not ask for special privileges and is not a detriment to the public. If there is a need to amend the Comp Plan then that's where the citizens should come in. A moratorium does not fit this type of development. All elements are necessary for this to go forward and be covered in this application. He asked for approval of R4 designation. Bell asked if maximum density was needed. Sanderson asked if there were any questions. Christopherson asked about the percentage of open space. Sanderson stated that open space is going to be something similar to Orion, they won't pack houses in and there will be a recreation center that will be one of the focal points. Now with the school issue, there will be ten or more acres that may go away also. Sanderson stated that the Mayor requested this and Sanderson stated that he would consider it. The City has no authority to require this, but Sanderson stated they would try and work something out with the school. We believe in the history and we want to preserve it. Erlebach asked if they will buffer surrounding areas. Sanderson stated that they are not planning to at this time. Erlebach asked if they are blending it in with Lakeshore Subdivision. Sanderson replied no, the project would be the same architecture as Orion with some differences. McDaniel asked about the housing designs. Sanderson stated that they are single family detached, they will be denser in places, and pricing will be different. Housing in Orion will be in the $300,000 range and the new one will be different. ) Public Testimony: Eric Battey, 2420 N Munger Road, Star, stated that the passion for town is Star's greatest asset, people care enough to express our views. He believes that more involvement from citizens is critical to planning and designing our community. Through education and willingness to compromise we will continue to enjoy this town. He has lived next to the Hadleys for seven years. At the Orion Park annexation, 17 people testified against the density and one testified for it. There were a lot of comments - we heard and commented on addressing growth and controls and that it has to be a public process and we need to make changes. Changes are in the map not the plan. Battey stated that he felt the Mayor and Council have done a lot more than listen. The City is amending the Comp Plan, Zoning and Subdivision Ordinances with a respected planner with public input. This would be Battey's dream come true. Density needs to be defined, we need to be more creative and mix densities on the land left in Star. We need to flow into that and the unique parcels with larger parcels for those type of developments. Applicant does have 121 identified lots, maybe we should look at R3 at 2.8 units per acre or maybe look at a condition of approval as an R3. Tuesday was a very good meeting; the neighborhood meeting is a very good thing. These are emotional issues. Battey would like this to be considered at a lower density. Kristin Battey, 2420 N. Munger, Star, - Kristin Battey read her letter into the record. ) 2 Christopherson asked how large the piece of her property butted up against the applicant. ) Battey stated that it is about a four acre parcel. Two lots bordering property, approximately 300 feet. Lois Moore chose not to speak. Bob Moore chose not to speak. Mr. & Mrs. Hoffer chose not to speak. Pam Slendorn, 2987 N. Hamlet Lane, Star, stated that the Council and citizens need to work together for Star. We are like a blank canvass waiting to move here. Why would we want to be like other places when everyone is moving here? Infrastructure cannot handle the growth, roads and schools cannot handle this; you may not believe it is your problem to deal with roads and schools, but it is. Other concerns are the area of impact going from RR to residential. There are no guidelines for transitional zones, or zoning should go from higher to lower densities. Development should not be approved every week; we need to decide what is best for Star now. Growth is inevitable, it will determine Star's future. This project has no plans for a buffer and no open space; there are no ordinances in place to protect the ten acre sites next to it. This is not in the best interest of the people. Richard Hudson, 3035 N. Hamlet Lane, Star, stated that he is speaking in opposition to ) the Hadley prope1iy annexation. He moved here due to open space. He is discouraged that developer brought an attorney. Maintaining rural densities are not R4. If approved, zoning should be more transitional from more dense to less dense to give property on borders a break. We ai·e neighbors and don't live in the City of Star - we will continue to do so - and will compromise. Would like to know if the developer will build something a little more rural. He doesn't want his animals to be a nuisance. Hudson asked the Council to reconsider and deny R4 density and consider something more transitional. Terry Opper, 3130 N. Can Ada Road, Star, stated that she lives on a five acre parcel in Ada County. She can only voice her opinion - they are alarmed at the enormous growth in Star. They feel they have no rights or control and are thankful for the Mayor and Council considering a moratorium and re-doing the comp plan. Please consider the neighbors and the impact on them. Please consider larger lots instead of the medium density that we are seeing pop up everywhere. We need more diversity, please control growth. Have concerns about education and transp01iation. She spoke with Gloria at the School District regarding enrollment numbers at Star Elementary. The capacity is 380 and current enrollment is 503 as of the end of March- they are using po1iables. Eagle Middle school has 1291 enrolled and the High School built for 1800 currently has 1964 students. Hundreds of homes are being built and not just in Star with no relief in site - new schools will be overburdened. She has concerns with public safety on roads and quality of life - can anticipate sitting in traffic and questioned how long you will be sitting in traffic commuting to Meridian and Boise. Orion Park has 379 homes with average 2 trips per day, and more and more trips coming. It takes her 30 minutes to get 3 to work - not so bad for quality of life in Star but she sees it getting longer. Her view of rooftops is what she will come home to. Mr. Mayor talks about school kids driving cars, her kid is driving a car and is a junior at Eagle High School and has to cross on Hwy 16. She is concerned about safety as school kids will be crossing Highway 16 to get to Eagle High School. Her daughter will be freshman next year, we need to think of our children and the hazards that face them. She is not here to ask to stop development, but to make diligent decisions. Opper stated that she would like to make a specific request and asked the Council and Mayor to please come visit, come look out her window and see how her life is changing and she will try to see things the Council's way. Communication is key. Allen Bent, 6306 Foothill Road, Star stated the Council should be ashamed of themselves for allowing things like this to happen. Bent asked if a house wouldn't sell better with more space around it; bump price of home up. He has been in Star for six years. Bent wonders why Council is waiting this long to look at plans. Milt Klein, 2275 Sunny Lane, asked that the annexation be refused and a moratorium be put in place on any annexation until plans are put in place and the infrastructure fixed. He is encouraged by the school talk, but discouraged because it will take awhile for a bond. He believes continuing development will jeopardize children's education and impact our traffic. He believes there will be road rage. He doesn't think that R4 zoning is consistent with transitional zones. He would like to have vision that they can support. Ann Kuck, 10399 Rolling Hills Drive, stated that she appreciates the opportunity to be ) heard and would like to speak against R4 zoning and would like to keep Star as rural as possible. Jeff Reimer, 2602 N. Munger, Star, stated that his prope1ty is contiguous to the Hadley prope1ty. He is opposed to R4 and would like to see R2 or R3 or transitional zones along the ten acres areas. We need transitional zones and he is concerned with the lack of infrastructure, there are ditches on both sides and traffic is already pretty heavy. Feels growth should slow down, he is opposed to R4; he requests a change to R2 or transitional. Clint Hinkley, 12728 W. Band, thanked the Mayor and Council for an opp01tunity to voice input; we really do appreciate it and thanked the Council for looking at a possible moratorium and revising the Comp Plan and for the applicant being here tonight. As he looked over the ordinances, he is not in the City of Star; but he finds that they are very good for maintaining the City. We do have ordinances for parking, setbacks and heights that are good. The problem is that most of the comments are regarding growth. Clear to see the large acreages in the zoning districts and believes it should fit into a RT zone - he read the ordinance. Hard to tell from map but believes they are mostly ten acres and not less than two acres. The parcel is proposed to be residential and he read the ordinance section. Designation is made by centralized services. When he looks at city ordinances they are good for order; he could not find anything to deal with growth especially with the residential next to ten acre parcels. We need some minimum guidelines set so that people who live in RUT zones have some protection and talk can be reserved for another 4 time. He came uncommitted - school would be donated and he applauded developers that come and donate back to the community. He does not see how we can say it meets the plan. Feels he is walking away with less than he came with. He would like the Council to consider this parcel be at least tabled to make sure it protects the bordering property and the City. Ifwe don't have information we can't make a good decision. Carla Montrose, 1859 N, Spring Hallow Way, stated that she moved here from Colorado. She looked in Meridian and Eagle and decided to move to Star because of the rural area. Star is a lovely community and beautiful - with the road system it takes 20 minutes to get to Meridian to work with her leaving at 5:30 in the morning. Takes over an hour to get to Boise, traffic is atrocious. One nice thing is she can walk the backstreet almost every night with her dog and it is not overly busy. Munger is very busy would like it to remain a rural area. She is a city girl who has lived in high density subdivisions. She loves hearing cows and geese. Idaho is a beautiful State - keep the density down. The designation R4 didn't mean anything to her. Street needs to be widened and then there is Star Elementary. She is not against growth in Star. She has bigger property - numbers don't mean anything to her. She doesn't want to see her neighbor. Growth is going to happen - keep in mind your quality of life, you don't want to lose it. Pam Leveritt, 946 South Main, Star, stated she use to live at Overland in Boise and saw an increase in population and moved to Star. She was on the original committee to incorporate Star. We wanted a say to what happened to us - Meridian and Eagle were threatening us. They went house to house and nobody wanted the City and sewer. We ) thought if we became a City we would be a Council of people from Star who understood us. Keep us rural, that's what we incorporated for. Karen Geld, 2689 N. Brandon Road, stated she has a pond on her property. She is a baby boomer and has seen development; which has been the story of her life growing up in California. She rode horses where a freeway is now. Where she grew up it was rural, subdivisions came and there was no land left. Doesn't like living next to rural people. She came from n01ihern California, where it was a destination place with minimum of five acres, restaurants and bike paths. She couldn't live there but her husband worked there; she didn't have to leave California. She thought she was buying parcels of ten acres. What concerned her tonight was thinking ahead flnd she doesn't understand us not having a Comprehensive Plan. What she is surprised about is that the developer is so vague on the development and wondered if they really don't know what is planned? She thinks he should have a plan - he will build so many houses - so there is a clubhouse, big deal, a clubhouse doesn't mean anything. Agrees with transition, we need to transition our land. She has been here for a little over a year because she wanted animals. She doesn't want to disturb other people, and doesn't want people complaining about her animal noises because they don't like it. She also doesn't want to listen to someone else's music. We need transition and this is perfect transition prope1iy. They can look and move away. She commutes into N01ihview and Cole and may have to leave earlier. She is used to traffic as she is from California and will be able to transition to it. Help us keep it. What is the plan, where is the road plan etc - do we need to live with it. She is concerned. She will be the last one here and doesn't want to move her horse. City needs 5 to have a plan for roads, utilities and schools. She appreciates the time and asked to have Mr. Sanderson give us more on the plan. McDaniel asked that having lived in LA and worked in Beverly Hills would Geld like to see more business so you don't have to commute so far. Geld stated yes, but not an industrial area, would like to see more quaint business. Storage facility should be a park. McDaniel do you think we could have a mix. Geld does not know. We could have a trail system and we could have restaurants. We are still rural enough- would give easement for trails and possibly neighbors would if it meant keeping Star rural. McDaniel asked if we don't have economic development where can kids play. Geld wants Sanderson to clarify plan, number of houses and development. Robe1i Morrison, 11800 Feramorz Lane, stated that he wants rural transitional zones. We need to do some planning, he has never seen anything like this you're giving him a blank check. He was shocked until he heard the attorney. We have Comp Plan in the works and they are trying to sneak things in before they have to have any neighborhood meetings. Recommend denying the application. If you approve you will be giving them a blank check for what's in their best interest not ours. Should have the right to ask what the open space is. Mayor wants to clarify if we put a specific open space there is a set percentage of open space. Morrison feels they are trying to avoid a neighborhood meeting, that's why they don't have the information. He suggested denying the plan until we get information. ) Jim Jesper, 5775 High Country Way, stated that he moved to Star for a better life for wife and kids. Coming from LA he knows about high density - there is good density and bad. He gave up seniority to move here for his family. People he has talked to say California 30 years ago is Idaho today. If he wants to walk around in underwear here he can- all neighbors would see him in California. All ten-acre parcels will soon be gone. He would love to see Star stay the way it is. Need to make lots of parks, schools, roads and playgrounds. He has a forty-minute commute to Garden City. Traffic on Eagle Road doesn't touch the LA freeway. If there was a vision we should do this before it happens to us. We've got to have a plan. He likes it the way it is. Bob Moore, 4241 N. Cowboy Lane, stated that we are talking about a couple different things - annexation into Star - matches Comp Plan - how often can Comp Plan be changed what latitude do you have. Developer is bound by old Comp Plan; all citizens should get involved in new Comp Plan and how much latitude you have on this parcel. He doesn't understand. Everyone likes a transitional zone, they can meet the code and it is cut and drawn with ordinances that are in place now. He runs around in shorts and he likes it. Chris Yorgason, legal counsel, pointed out there are two applications before them - annexation and how to zone the prope1ty tonight. Annexation is discretionary by the Council; zoning has to meet with the Comprehensive Plan Map that designates the prope1ty at a ce1iain density. The City doesn't have a lot of leeway to do what it wants. } To deny the application, they have to say it doesn't meet ce1tain qualifications. 6 Mayor pointed out the timeframe to change the comprehensive plan Land Use Map is six months. Can't change maps at any time. Tia Frisk, 605 Aspen Lakes Way, Star, stated that she has a lot of compassion, she just moved to the City of Star and she has moved quite a bit. The roadways are horrendous, they are poorly planned. Frisk stated that if we continue the growth at this rate you're looking at an outrageous rate. Sanderson needs to have a better plan. She wants to see the plan. Organization needs to be done. It can be done right and people want to move in or do it bad and everyone wants to leave. Emotions are high - she runs a business in her home. (CHILDCARE) More children in the school, problems now and it will get worse. Crime will increase if development continues. She likes the ten acres for schools. School projections are 28 per class this coming year with no aide. Better priorities should be set sooner rather than later. DaITel Gorrola, 1710 Willow Glenn, stated he may have the last half acre lot in Star. If they are asking for annexation, they should have a plan and they should be proud to be part of the City- they understand that they need to make their money. Everyone has a fear that they will be swallowed; he wants transitional - like lot sizes near each other. Opinion is it is backward once they can do what ever they want to do - want plans - mixed housing no justification. He would like more information. Kirk Pulver, 1900 Willow Glen Way, Star stated that he is a recent resident and thanked ) the Mayor and City Council for pushing this from Tuesday as there were a lot of people. He is part of the problem, as he has been here less than sixty days and feels for the residents that have been here. Hadley's have been here for ninety years - appreciative of welcoming them. Lot of things that have been said tonight because of what the developer has shown, this is the first look and the Council has not seen a plat. Residential R4 can vary and asked for an explanation - 100 acres 20 percent open space. Numbers of units per acre is behind zoning designation gross acres - our ordinances require different amounts of open space, which include sidewalks and will dictate the number of houses per acre. (Mayor) Densities are different with open space. In Nampa this relates to about 3.4 houses per acre. Mayor stated Nampa is different than ours; it is more predictable. Our ordinances allow for more flexibility. Typically R4 ends up being three point something per acre. Are there plats that offer more than half or one acre parcels - Mayor yes. So many people that are so new - Hadley this prope1iy is a dream come true to him to hear shot guns on the prope1iy. Corey Barton is on one side and he would ask that they consider the like size prope1iy surrounding it - developer may lrnow - they wouldn't be rolling the dice to put a horseshoe of half acre lots and high density inside. Not asking to stop, but you need to transition, asking to keep surrounding people in mind. Will be a more prized community; there is actually a view up there. He came from a subdivision they called a fish bowl, he couldn't escape neighbors. People coming here would knock down the door for half-acre parcels. Mark Rodeghiero, 3581 N. Vindant Pl., stated he feels privileged to be in front of the people in Star. He moved from Montana from a small community that reminds him of 7 what Star was six years ago. He moved to Eagle first and he could look over and see what his neighbor was eating. The more houses there are the more money he makes. Would like to remain on track with it being a privilege to live here. Takes a lot of effort to put together to make an effort to the Hadley's in the same time he would hope that they would bring due diligence to Star and treat as a privilege. Understand if we don't annex it gives us time to rework Comprehensive Plan and Zoning Plan. The developer will be back. Applicant Rebuttal: Laren Bailey clarified two points. First they submitted the application on January 31st and there was no talk of a moratorium and to talk about why we are here tonight. There are two hearings in talking with Mrs. Ward the goal is annexation and zoning, the maps are not required at this point - it is at the next step that will be taken at the preliminary plat stage - it is his understanding. If we need to provide something else we will. Sanderson stated he could use a coffee break and appreciates the comments from the public - we are sincere with ours. He has looked at and listened to folks share their feelings about Idaho; this is the same type of situation as when he was young. He wonders how families felt when their 100 acres had people moving in with 10 acres parcels - it changed. They are looking at a whole bunch of people now. Growth has been going on for a long time. Hadley's and Rosti's want to get out. Now we have development that is imposing on the five year people; it is no different than from back then. There are misconceptions about schools and roads -we've got to stop growth because schools are overcrowded and roads that won't handle traffic. The new homes build the schools and the roads. Munger is a 20-foot road and they are required to make it wider and add sidewalks. We have a road, park way and sidewalk. It will be a safer road. New development is what will bring new schools and yes they are overcrowded. That is why Mayor called and asked for a site for a new school. As Mr. Bailey mentioned we are required to come here without a plan. Do we know what we have planned - no we really don't. We can have a plan in the next 30 days; no one is trying to sneak anything on it. It is a little late for a neighborhood meeting. They are following laws of the City and the State. They followed the ordinances, are in the impact area and it follows the Comp Plan. Rather than answer every ones remarks he has summarized his comments. He keeps hearing moratorium - not sure it is legal for things like that. Doesn't believe it fits with wanting to re-do the Comprehensive Plan. AJ Bohner stated he would like to emphasize he is an advocate for Mr. Sanderson. No one forced the Hadley's to sell their property. Mr. Sanderson bought it and relied on the Comprehensive Plan and put in an application and hired a land use planner in accordance with the law of Idaho. First he has to be annexed and then zoned with the Comprehensive Plan and then they will talk about pathways, do we need plans, etc. Then this body will make a decision. Many talked about not knowing about what zoning is. This was done in January. Only asking for plan to go forward- allow R4- this is not 8 time for specifics. Applicant has met the requirements dealing with annexation and zoning of the City and the State of Idaho and this application should be adopted. Bell talked about Council trying to set aside property for other things other than houses told developer make application subdivision set aside 15% for something other than homes and a school would not be 15% it would be 10 acres. Number one question - if we are willing to grant not just 15 acres would you consider it. Sanderson would like consideration for an R4, the school site will take up a lot of land; the remaining percent is going to be enough for park space. He would like to have a zone of R4 and come in with a plan. Truly does not know what lot count is, haven't built neighborhoods yet. We are going to have a school site and will probably put another 10% in parks. They would like approval tonight. Bell asked if he was aware that we've taken away minimum lot sizes. A lot of people want transitional areas around the outside. Sandy is aware of this. Erlebach asked if we approve this with the idea that there will be a ten acre site and the school backs out would you be willing to donate the land. Sanderson stated they wouldn't donate it, it would become a park. If ten acres - 15% would be 14 acres don't know how big the plan would be. The Battey's requested that transitional lots - Sanderson moved road for Battey's so they moved it. May have a road along the property line which would be noise for them - ACHD may want it to be there. Sanderson stated they are too preliminary at this point, ) but they are willing to work with everyone. He has been doing planning for 40 years and feels New Hope is a natural breaking point. Jerome will look at and decide. This will not be the end of the City and it may make sense that one-acre parcels abut this property. We will continue to have this explosive growth. We don't have very much land and a whole lot of people. Mayor asked if they would be willing to put acre lots abutting the Battey prope1ty. Sanderson stated they don't want to see acreages next to the Battey's but are willing to buffer the property. Bell asked if they would be willing to do a development agreement. Sanderson doesn't want to be held to that right now, he wants to put a plan together before it comes to Council. He will work within an R-4 zone. Land is becoming expensive; Orion's 75xl 10 home lots will be priced at $300,000-$350,000 per lot. He would like to bring a different product and they won't be inexpensive. They have a development team on this project. They don't know what they will have. Tell them a pledge of 2000 dollars per home. Infrastructure money pays for development. It can add to community. In Grass Valley a 3200 unit amenity project offered $10 million for a new library. Without public financing cities would not be able to afford it in Idaho. The Mayor closed the public hearing and moved to deliberation on this application. 9 Bell noted they don't have to have a preliminary plat and asked if it could be tabled for 30 days until they can see a preliminary plat. Yorgason stated that it can be requested, though without it being in a development agreement it is not binding. Zoning and Annexations are not conditional - a development agreement is the only way to condition zoning such that it would be binding on developer. Having them bring a concept plan it could change drastically - if a picture was brought prior to annexation it would be possible. Bell stated he is not uncomfortable with this project. Mr. Sanderson has done a great job with other development and our best interest in a lot of ways. He is a little uncomfo1iable with R4 when everything around it is R3 and R2. He understands the R4 flexibility but not willing to do it without seeing the concept. He would like to get more of an idea; he has no problem annexing but is not comfortable zoning this without seeing a little more in front of them due to the R3 zoning surrounding it. He would like to table this and would like to see a neighborhood meeting occur before he comes back to the Council. Bell would like to table to a date certain - can ask applicant what date that he would like to see. Christopherson stated lots of information has been presented and he has taken note of it. A lot of good things were said and it boils down to not a whole lot specific to this project but specific to the City. We need to narrow information down to this specific prope1iy, which is hard with something like this. We want a development agreement and shouldn't be looking at a preliminary plat; it can change hands several different times. He can understand the process. Schools and zoning - if we have a school we need an R4 development - want kids to walk to school to and not to bus. He disagrees with Councilman Bell; we need to look at the annexation separately, than review the preliminary plat. He would like to see the 15% and would like to see school - we either move forward or we don't. Bell stated he doesn't mind annexing but has a problem with the zoning. Not comf01iable with the sun-ounding zoning. The Mayor stated that they cannot annex without zoning. The Council can either deny or approve - zoning has to be doe if you annex. Erlebach stated he does not feel good about it; there is plenty of area there for R3 and he would like to see some type of drawing on this. Not in favor of R4 at all. McDaniel agrees with Christopherson regarding the application before them. She would like to see it R3 and they should be commended for setting aside property for a school. She feels that Sanderson does have the best interest of Star. Would like to see R3 and she thinks we should approve annexation and zoning. Bell stated that if Council wishes we can make a motion. Not sure if it is justified or not; he's not saying he wants to deny R4, there may be a good justification for it. He is not ) comfo1iable with it tonight and he appreciates what Mr. Sanderson is trying to do. 10 ) The Mayor sympathizes with what everyone is saying. He asked the applicant for a reason for not presenting a picture. Sanderson suggested annexing with an R3 and they will come back with a plan. The school will want ten acres, which he feels is a little lean, they usually use 12 to 14 acres. He doesn't just want a school site, he is willing to kick in money. He would rather see a decision tonight then holding it over. Density may be at 3.3 and they may ask for a reconsideration of zoining. Christopherson wants to move forward and if it means going to R3 then he will do it. Bell stated that we have a lot of ability to do development agreements and to do preliminary plats and extraordinary to work with us. Bell moved to approve the Sanderson Property annexation and zoned it Residential (R3), seconded by Erlebach. Yorgason reminded Council that development agreements can only be done at the time of zoning, though there is a lot of latitude through PUD or straight preliminary plat. All aye: motion carried.
